SYNOPSIS OF SHOOTING BASED ON THE OFFICERS’ ACCOUNT:

On March 22, 2007, at approximately 10:00 p.m., Officer Rivera and Senior Corporal Lovy Page,
# 6941, were dispatched on a disturbance call regarding a shoplifter at the 7-11 Store, located at
7037 Lake June Road. Upon arrival, Officer Rivera was told the suspect (Brandon Washington)
left walking westbound from the location. The officers then began searching for Suspect
Washington but did not find him and returned to the 7000 block of Lake June Road. As the
officers were leaving the location, Officer Rivera observed Suspect Washington walking
eastbound on the sidewalk in the 7000 block of Lake June Road. Officer Rivera instructed
Suspect Washington to come to his vehicle, and Suspect Washington turned his head in Officer
Rivera’s direction and continued walking. Officer Rivera again instructed Suspect Washington to
stop, and Suspect Washington looked at Officer Rivera and then began crossing the street. The
officers drove eastbound on Lake June Road in an attempt to catch up with Suspect Washington.
Suspect Washington had crossed the street and continued walking eastbound. Suspect
Washington was almost at the intersection of Lake June Road and N. Jim Miller Road when the
officers caught up with him. Officer Rivera exited his vehicle and took a position behind the
driver’s door and instructed Suspect Washington to stop and come to his vehicle. Suspect
Washington stopped and began walking toward Officer Rivera with both of his hands in his pants
pockets. Officer Rivera instructed Suspect Washington to remove his hands from his pockets, but
he refused and continued walking directly toward Officer Rivera. Officer Rivera drew his
weapon, pointed the weapon at Suspect Washington, and instructed him several more times to
remove his hands from his pockets. Suspect Rivera removed his left hand, leaving his right hand
in his pants pocket, and continued to walk directly toward Officer Rivera. Suspect Washington
told Officer Rivera that his hands weren’t in his pockets. Officer Rivera, by this time, could see a
bulge in Suspect Washington’s right pants pocket, and it appeared as if Suspect Washington was
gripping something with his right hand. Officer Rivera again instructed Suspect Washington to
remove his hand from his pocket, and Suspect Washington now appeared to be concealing an
object with his right hand which was still in his pocket as he continued to walk aggressively
toward Officer Rivera. Officer Rivera, believing the object in Suspect Washington’s pocket was a
gun, was in fear for his life, and he fired his service weapon at Suspect Washington striking him
two times. Suspect Washington was taken to Parkland Memorial Hospital where he was
pronounced deceased at 11:12 p.m. No officers were injured. A theft offense was prepared
listing Suspect Washington as the suspect on service number 201597-T.
