Section 31.

Continuing Professional Education (CPE) and/or


Development Programs. - All registered Professional Electronics
Engineers, Electronics Engineers, and Electronics Technicians, shall comply
with pertinent rules and regulations already prescribed by and/or as may be
prescribed and promulgated by the Commission and/or the Board, the
Accredited Professional Organization and other government agencies,
pursuant to this Act and other relevant laws, international treaties,
agreements and/or covenants to which the Philippines is a signatory and has
ratified, with respect to continuing professional education and/or
development and/or other similar/related programs.

REQUIREMENT(S)/PRESCROPTION(S)/REQUISITE(S)
1. All registered Professional Electronics Engineers, Electronics Engineers,
and Electronics Technicians, shall comply with pertinent rules and
regulations already prescribed by the Commission, the Accredited
Professional Organization and other government agencies, pursuant to
this Act and other relevant laws, international treaties, agreements to
which the Philippines is a signatory and has ratified, with respect to
continuing professional education and/or development and/or other
similar/related programs.
Explanation:
1. Accredited Professional Organization- refers to the single national
organization endorsed by the board and approved by the
commission to represent a given profession pursuant to the
provision of the respective professional regulatory laws.
2. Registered Professional Electronics Engineers- degree holder of
Bachelor of Science in Electronics and Communications Engineering
and board exam passer
3. Electronics Engineers- degree holder of Bachelor of Science in
Electronics and Communications
4. Electronics Technicians -help design, develop, test, manufacture,
install, and repair electrical and electronic equipment such as
communication equipment, medical monitoring devices,
navigational equipment, and computers.
5. Board- Professional Regulation Commission (PRC).
6. Treaty- is a formally concluded and ratified agreement between
countries.
7. Act- refers to a Republic Act
 The first requirement states that as all registered Professional
Electronics Engineers, Electronics Engineers, and Electronics
Technicians should follow the rules and laws given by the
constitution. They should also learn and follow other rules,
treaties and agreements that the Philippine constitutions
agreed to.

Iteration of Statutory Construction


I. Constitutional Provision
Citation: Section 5, Article II, Philippine Constitution
“The maintenance of peace and order, the protection of life, liberty,
and property, and the promotion of the general welfare are essential
for the enjoyment by all the people of the blessings of democracy”
Justification:
 Section 5, Article II, Philippine Constitution states that peace and
order must be maintained by following the laws and rules given
by a legal agency or department. Therefore, Section 5, Article II,
Philippine Constitution is an implied construction of Section 31,
R.A. 9292.
Citation: Section 9, Article II, Philippine Constitution
Art. II. SECTION 9. The State shall promote a just and dynamic social
order that will ensure the prosperity and independence of the nation
and free the people from poverty through policies that provide
adequate social services, promote full employment, a rising standard
of living, and an improved quality of life for all.
Justification:
 Section 9, Article II, Philippine Constitution they promote just
and dynamic social order that must be followed by everyone for
an improved quality life for all. Therefore, Section 9, Article II,
Philippine Constitution is an implied construction of Section 31,
R.A. 9292.
Citation: Section 23, Article III, RA 9292
“The Board shall, upon proper notice and hearing, revoke or suspend
the validity of a Certificate of Registration and accordingly the
Professional Identification Card, or cancel a Special Permit granted
under Section 26 herein, for any of the causes mentioned in the
preceding sections, or for unprofessional or unethical conduct,
malpractice, incompetence or any violation of this Act and its
implementing rules and regulations, the Code of Ethics and the Code
of Technical Standards of Practice, or where fraud, deceit, or false
statement was found to have been employed in obtaining said
Certificate of Registration, Professional Identification Card or Special
Permit.”
Justification:
 Section 23, Article III, R.A. 9292 states that the validity of a
certificate of registration will be taken away if any violation from
that act is made.

CITATION: Section 35 h, Article VI, R.A. 9292


“The following shall be punished by a fine of not less than One
hundred thousand pesos (P100,000.00) nor more than One million
pesos (P1,000,000.00), or by imprisonment of not less than six (6)
months nor more than six (6) years, or both, in the discretion of the
court:
(h) Any person holding a Certificate of Registration and Professional
Identification Card as Professional Electronics Engineer, Electronics
Engineer or Electronics Technician who shall be involved in illegal wire-
tapping, cloning, hacking, cracking, piracy and/or other forms of
unauthorized and malicious electronic eavesdropping and/or the use of
any electronic devices in violation of the privacy of another or in
disregard of the privilege of private communications and/or safety to
life, physical and/or intellectual property of others, or who shall
maintain an unlicensed and/or unregistered communications system or
device; and
Justification
 As a as Professional Electronics Engineer, Electronics Engineer or
Electronics Technician, one must avoid to do illegal conducts to
avoid penalties & punishments. They must abide by the rules.

REQUIREMENT(S)/PRESCROPTION(S)/REQUISITE(S)
2. All registered Professional Electronics Engineers, Electronics
Engineers, and Electronics Technicians, shall comply with pertinent
rules and regulations already prescribed by the Commission, the
Accredited Professional Organization and other government agencies,
pursuant to this covenants to which the Philippines is a signatory and
has ratified, with respect to continuing professional education and/or
development and/or other similar/related programs.
Explanation

1. REGISTERED PROFESSIONAL- The term professional refers to


anyone who earns their living from performing an activity that
requires a certain level of education, skill, or training. There is
typically a required standard of competency, knowledge or
education that must be demonstrated (often in the form of an
exam or credential), as well as adhering to codes of conduct and
ethical standards.

2. COMPLY- To comply is to do what is asked of you or to act in


accordance with a set of standards. To conform, submit, or
adapt (as to a regulation or to another's wishes) as required or
requested.

3. PERTINENT-belonging or related to the subject or matter in hand;


fit or appropriate in any way; adapted to the end proposed;
apposite; material; relevant; as, pertinent illustrations or
arguments; pertinent evidence.

4. PRESCRIBED- to lay down, in writing or otherwise, as a rule or a


course of action to be followed; appoint, ordain, or enjoin.

5. BOARD- A committee of persons organized under authority of law in


order to exercise certain authorities, have oversight or control of
certain matters, or discharge certain functions of a magisterial,
representative, or fiduciary character.

6. PURSUANT- Conformance to or in agreement with; in reference to.


For example, an attorney may state that pursuant to a specific
law, a company is operating fairly within a certain situation.

7. RATIFIED-sign or give formal consent to (a treaty, contract, or


agreement), making it officially valid.

8. Accredited Professional Organization - the integrated and accredited


national organization of Professional Electronics Engineers,
Electronics Engineers and Electronics Technicians.

 Registered Professional Electronics Engineers, Electronics


Engineers and Electronic Technicians should follow and obey the
on hand rules that were already prescribed by the board,
commissions, accredited professional organizations and other
government agencies in conformance to the act and the law.

CITATION: RA. 9292 ARTICLE V. Sec. 32,36

Sec 32. Integrated and Accredited Professional Organization. -


There shall be one (1) integrated and Accredited Professional
Organization of Professional Electronics Engineers, Electronics
Engineers and Electronics Technicians in the country, which shall be
registered with the Securities and Exchange Commission as a non-
stock, non-profit corporation and recognized by the Board, the
Commission and all government agencies as the one and only
integrated and accredited national organization for the said
professionals. Every Professional Electronics Engineer, Electronics
Engineer and Electronics Technician, upon registration with the
Commission as such, shall ipso facto become a member of this
Accredited Professional Organization. Those who have been previously
registered by the Board but are not members of this Accredited
Professional Organization at the time of effectivity of this Act, shall be
allowed to register as members of this organization within three (3)
years after the effectivity of this Act. Membership in this Accredited
Professional Organization shall not be a bar to membership in other
associations of the electronics engineering and electronics technician
professions.

The Accredited Professional Organization shall implement the


continuing professional education, accredit other organizations or
entities to provide continuing professional education, and/or
development program promulgated by the Board and/or the
Commission, compliance with which shall be one of the requisites for
the maintenance of membership in good standing of the professional in
the Accredited Professional Organization. All members of good
standing of this Accredited Professional Organization shall be issued an
annual membership card indicating the membership number and
validity period of the membership, which shall be affixed to all plans,
specifications and any document signed by the member in the course
of practice of his/her profession. Failure to maintain membership in
good standing in the Accredited Professional Organization shall be a
cause for listing of the individual as delinquent in the roster of
professionals.

Sec. 36. Assistance of Law Enforcement and Other Government


Agencies. - Any law enforcement agency shall, upon call or request of
the Board and/or the Commission, render assistance in enforcing this
Act including the Code of Ethics, Code of Technical Standards of
Practice and the implementing rules and regulations and measures
promulgated hereunder, by prosecuting violators thereof in accordance
with law and the Rules of Court. Any department, instrumentality,
office, bureau, institution or agency of the government including local
governments, upon call or request from the Board and/or the
Commission, shall render such assistance as it may require, cooperate
and coordinate with it in carrying out, enforcing or implementing this
Act, the codes, policies, measures, programs or activities of the Board
and/or the Commission that it may undertake pursuant to the
provisions of this Act.

JUSTIFICATION:

 Every Professional Electronics Engineer, Electronic Engineer


should be a member of Accredited Professional Organization
such as IECEP (Institute of Electronics Engineer of the
Philippines) stated on the new ECE Law RA. 2929 Sec. 32 and
36. And all Professional Electronics Engineers, Electronics
Engineer, Electronics Technician should follow the rules and
regulation implemented by the organization and other
government agencies. Failure to obey this rules and regulation
shall be penalized and shall be cause for listing of the individual
as delinquent in the roster of the professionals

1. Professional Electronics Engineer - a person who is qualified to hold


himself/herself out as a duly registered/licensed Professional
Electronics Engineer under this Act and to affix to his/her name the
letters "PECE".
2. Electronics Engineer - a person who is qualified to hold
himself/herself out as a duly registered/licensed Electronics
Engineer under this Act and to affix to his/her name the letters
"ECE".
3. Electronics Technician - a person who is qualified to hold
himself/herself out as a duly registered/licensed Electronics
Technician under this Act and to affix to his/her name the letters
"ECT".
4. Board – refers to the professional regulatory board
5. Accredited Professional Organization - the integrated and accredited
national organization of Professional Electronics Engineers,
Electronics Engineers and Electronics Technicians.
 Therefore, the requirement means that Enginners and
Technicians, specifically in the study of Electronics, must follow
the regulations made by the Board, and the Accredited
Professional Organization that withholds the agreements that the
Philippines has agreed and made possible to, while still
continuing in their own professional study and development.

I . Constitutional Provision

Citation: Rule 2, Section 3 (b) and (c) of Resolution No. 2018-

“A professional organization shall be disqualified from applying for


accreditaion as APO if it has failed to comply with the lawful orders
and/or policies of the Board and/or the PRC”

“A professional organization shall be disqualified from applying for


accreditaion as APO if it has failed to comply with the regulatory
policies of other government agencies like SEC, BIR and local
government units.

1. Accreditation - refers to the formal or official approval granted to a


person, a program or an organization, upon meeting essential
requirements of achievement standards, including qualifications or
unit(s) of a qualification, usually for a particular period of time, as
defined by an accrediting agency
2. Accredited Professional Organization - the integrated and accredited
national organization of Professional Electronics Engineers,
Electronics Engineers and Electronics Technicians.
3. Board – refers to the professional regulatory board
4. PRC – Professional Regulatory Commission

Understanding:

 These statements mean that an APO that violates any law or


regulation of the Board, PRC, or any government agencies will be
stripped of the accreditation of the Organization.

Citation: Article VI, Section 35 (t) of RA 9292

“Any person who shall violate any provision of this Act or any rules,
regulations, the Code of Ethics and the Code of Technical Standards of
Practice promulgated under this Act shall be punished by a fine of not
less than One hundred thousand pesos (P100,000.00) nor more than
One million pesos (P1,000,000.00), or by imprisonment of not less
than six (6) months nor more than six (6) years, or both, in the
discretion of the court”
1. Code of ethics - A code of ethics is a guide of principles designed to
help professionals conduct business honestly and with integrity within
Electronics
2. Code of technical standards –code of technical standards is an
established norm or requirement for repeatable technical tasks in ECE

Understanding:

 This states that Engineers and Technicians that do not comply or


violate rules and regulations by the government shall be
penalized by the court.

Justification:

 Therefore, all Engineers and Technicians, professional or not,


and Organizations shall all follow the laws stated by the Board,
PRC, and government agencies to avoid being penalized and
punished by the court even when continuing their study or
professional development.

and Electronics Technicians, shall comply with pertinent rules and
regulations as may be prescribed and promulgated by the Commission,
the Accredited Professional Organization and other government
agencies, pursuant to this Act and other relevant laws, international
treaties, agreements to which the Philippines is a signatory and has
ratified, with respect to continuing professional education and/or
development and/or other similar/related programs.

professional regulatory laws.

3. Treaty- is an agreement in written form between nation-states


(or international agencies, such as the United Nations, that have been
given treaty-making capacity by the states that created them) that is
intended to establish a relationship governed by International Law.
4. Act- refers to a Republic Act, which is a piece of legislation used to
create policy in order to carry out the principles of the Constitution. It is
crafted and passed by the Congress of the Philippines and approved by
the President of Philippines. It can only be repealed by a similar act of
Congress.

 All electronics related workers should follow the commission, the


APO, or the Philippine government tells them to do so, whether in a
form of laws, orders, or even international treaties the the
government has agreed upon, in terms of the development of
electronics industry in the state.

legislative district must be represented by at least three per centum of

REQUIREMENT(S)/PRESCROPTION(S)/REQUISITE(S)
8. All registered Professional Electronics Engineers, Electronics
Engineers, and Electronics Technicians, shall comply with pertinent rules
and regulations as may be prescribed and promulgated by the Board, the
Accredited Professional Organization and other government agencies,
pursuant to this covenants to which the Philippines is a signatory and has
ratified, with respect to continuing professional education and/or
development and/or other similar/related programs.

Explanation:

4. Board- refers to the Professional Regulation Commission (PRC).

5. Accredited Professional Organization- refers to the single national


organization endorsed by the board and approved by the commission
to represent a given profession pursuant to the provision of the
respective professional regulatory laws.

6. Covenant-
An agreement, contract, or written promise between two individuals t
hat frequently constitutes a pledge to do or refrain from doing someth
ing.

 All electronics practitioners should follow the commission, the


APO, or the Philippine government tells them to do so in a form
of a covenant in terms of the development of electronics
industry in the state.

I. CONSTITUTIONAL PROVISION:

“Except as otherwise specifically provided in this Act, all applicants


seeking to be registered and licensed as Electronics Engineers and
Electronics Technicians, shall undergo the required examinations to be
given by the Board in such places and dates as the Commission may
designate in accordance with the provisions of Republic Act No. 8981.”
