INTRODUCTION

Republic Act No. 9163

Republic Act No. 9163, also known as the “National Service Training Program (NSTP) Act of
2001”declares that “it is hereby affirmed the prime duty of the government to serve and protect its
citizens. In turn, it shall be the responsibility of all citizens to defend the security of the State and in
fulfilment thereof, the government may require each citizen to render personal, military or civil service.

Recognizing the youth's vital role in nation-building, the State shall promote civic consciousness
among the youth and shall develop their physical, moral, spiritual, intellectual and social well-being. It
shall inculcate in the youth patriotism, nationalism, and advance their involvement in public and civic
affairs.

In pursuit of these goals, the youth, the most valuable resource of the nation, shall be
motivated, trained, organized and mobilized in military training, literacy, civic welfare and other similar
endeavours in the service of the nation.”

National Service Training Program

According to RA 9163, NSTP is a program aimed at enhancing civic consciousness and defense
preparedness in the youth by developing the ethics of service and patriotism while undergoing training
in any of its three (3) program components. Its various components are specially designed to enhance
the youth's active contribution to the general welfare.

NSTP Components

 Reserve Officers' Training Corps (ROTC)


o A program institutionalized under Sections 38 and 39 of Republic Act No. 7077 designed
to provide military training to tertiary level students in order to motivate, train, organize
and mobilize them for national defense preparedness.
 Literacy Training Service (LTS)
o A program designed to train students to become teachers of literacy and numeracy skills
to school children, out of school youth, and other segments of society in need of their
service.
 Civic Welfare Training Service (CWTS)
o programs or activities contributory to the general welfare and the betterment of life for
the members of the community or the enhancement of its facilities, especially those
devoted to improving health, education, environment, entrepreneurship, safety,
recreation and morals of the citizenry.

NSTP law

AN ACT ESTABLISHING THE NATIONAL SERVICE TRAINING PROGRAM ( NSTP) FOR TERTIARY
LEVEL STUDENTS, AMENDING FOR THE PURPOSE OF REPUBLIC ACT NO.7077 AND
PRESIDENTIAL DECREE NO. 1706, AND FOR OTHER PURPOSES.

1. Sec 2. (Declaration of policy) R. A 9163 hereby affirms the prime duty of the government to
serve and protect its citizens. In turn, it shall be the responsibility of all citizens to defend the
security of the state and in the fulfillment thereof, the government may require each citizen to
render personal, military or civil services.

2. Sec 4. (Establishment of the National Training Service Training Program (NSTP) which shall
forms part of the curricula of all baccalaureate degree courses and at of least two (2) year
technical – vocational courses. The course shall be a requisite for graduation, consisting of the
following service components.

a. Reserve Officer’s Training Corps (ROTC), which is hereby made optional and voluntary upon
the effectivity of this Act.

b. Literacy Training Services; and

c. Civic Welfare Training Service

3. Section 4, Article II of the Constitution provides that the prime duty of the Government is to
serve and protect the people. The Government may call upon the people to defend the State
and in the fulfillment thereof, all citizens may be required, under conditions provided by law, to
render personal military or civil service.

4. Section 38, Article VII, Republic Act 7077 – states that, “Military training for students
enrolled in colleges, universities and similar institutions of learning is mandatory pursuant to the
provisions of the National Defense Act of 1935 and the 1987 Constitution.”

5. Commonwealth Act Number 1, otherwise known as the National Defense Act, was the very
first statutory enactment by the Commonwealth government on December 23, 1935.
Commonwealth Act Number 1 required the compulsory military training of all college students.
Executive Order Nr 207 was later issued by President Manuel L Quezon requiring all college
students to undergo military instructions pursuant to Commonwealth Act Nr 1. The very
rationale of military training is the defense of the state, whether actual or in preparation to make
it more effective in case of need.

The National Defense Act was amended in 1980 by Presidential Decree 1706 (The National
Service Law) which directs that military service will no longer be compulsory, but leaving the
national service or training to be in effect. Military Training Service (MTS), Civic Welfare Service
(CWS), Law Enforcement Service (LES) make up the National Service Program. But the CWS
and LES component were suspended, leaving only the MTS program, which is the present
ROTC program. In SY 1993-1994 DND, CHED and DILG formed a tripartite committee, the
Basic ROTC Program was expanded upholding three (3) programs of the National Service Law
(MTS, LES and CWS). It was implemented in 1996 but failed since only five percent (5%) of the
students enrolled in CWS and LES components while ninety-five percent (95%) took the MTS
(ROTC). The rising agitation and recent events call for the reexamination and review of the
sixty-year-old law requiring college students to undergo military training. This resulted to the
enactment of Republic Act Number 9163 which makes ROTC Optional and requires male and
female freshmen students taking baccalaureate degree and at least two (2) year
vocational/technical or associate courses to take the National Service Training Program (NSTP)
with any of the three (3) Program Components namely: ROTC, Literacy Training Service and
Civic Welfare Training Service Implementing Rules and Regulation of RA 9163:

Pursuant to Section 12 Republic Act No. 9163 otherwise known as the National Service
Training Program (NSTP) Act of 2001, the Commission of Higher Education (CHED), Technical
Education and Skills Development Authority (TESDA), and Department of National Defense
(DND), in consultation with concerned government agencies, the Philippine Association of State
Universities and Colleges (PASUC), Coordinating Council of Private Educational Association of
the Philippines (COCOPEA), Non-government Organizations, hereby jointly issue, adopt and
promulgate the following Implementing Rules and Regulations to implement the provisions of
this Act.

1. Sec 1, Rule I, IRR to R. A. 9163 (Guiding Principle). While the prime duty of the
government is to serve and protect its citizens, in turn, it shall be the responsibility of all citizens
to defend the security of the state, and in the fulfillment thereof, the government may require
each citizen to render personal military or civil service.

2. Sec 2. Rule I, IRR to R. A. 9163 ( Role of the Youth)

a. In recognition of the vital role of the youth in nation building, the state shall promote civic
consciousness among them and shall develop their physical, moral, spiritual, intellectual and
social being. It shall inculcate the ideals of patriotism, nationalism, and shall advance their
involvement in public and civic affairs.

b. As the most valuable resources of the nation, they shall be motivated, trained, organized
and involved in military activities, literacy service, civic welfare programs and other similar
endeavors in the service of the nation.

3. Sec. 4, Rule III, IRR to R. A. 9163 (Coverage)

a. All incoming freshmen students, male and female, starting School Year (SY) 2002 –2003,
enrolled in any baccalaureate and in at least two (2) year Technical – Vocational or associate
courses, are required to complete one (1) NSTP component of their choice as a graduation
requirement.

b. All higher and technical-vocational educational institutions must offer at least one (1) of the
NSTP components.

1). State Universities and Colleges (SUCs), shall offer the ROTC Program and at least one
(1) other NSTP component. 2) The Philippine Military Academy (PMA), Philippine
Merchant Marine Academy (PMMA), Philippine National Police Academy (PNPA), and other
SUCs of similar nature, in view of the special character of these institutions, are exempted from
the NSTP. 3) Private higher and technical-vocational education institutions with at least 350
midshipmen may offer the ROTC Program and consequently establish/maintain a Department
of Military Science and Tactics (DMST), subject to the existing rules and regulations of the
Armed Forces of the Philippines (AFP).

4. Sec. 6 Rule III, IRR to R. A. 9163 (Duration/ Equivalent Course Unit):

a. Each of the aforementioned NSTP components shall be undertaken for an academic period
of two (2) semesters. It shall be credited for three (3) units per semester, for fifty four (54) to
ninety (90) training hours per semester.

b. A one (1) summer program in lieu of the two (2) semester program may be designed,
formulated and adopted by the DND, CHED and TESDA, subject to the capability of the school
and the AFP to handle the same.

5. Sec. 11, Rule V, IRR to R. A. 9163 (Organization of NSTP Graduates): a. Graduates of


the CWTS and LTS components of the NSTP shall belong to the National Service Reserve
Corps (NSRC) and could be tapped by the state for literacy and civic welfare activities, through
the joint efforts of DND, CHED and TESDA, in coordination with DILG, DSWD and other
concerned agencies/ associations. b. The CHED, TESDA and DND, in consultation with other
concerned government agencies, shall issue the necessary guidelines for the establishment,
organization, maintenance and utilization of the National Reserve Corps. c. Graduates of the
ROTC program shall form part of the Citizen Armed Force, pursuant to R. A. 7077, subject to
the requirements of DND.

6. Sec. 13, Rule VI, IRR to R. A. 9163 (Transitory Provisions):

a. Male students who are currently enrolled but have not taken any of the Military Service
(MS), Civic Welfare Service (CWS) or Law Enforcement Service (LES) programs shall be
covered by the NSTP law. b. Male students who have completed two (2) semesters of the
Expanded ROTC (E-ROTC) National Service Program) are deemed to have complied with the
NSTP law. c. Students who are not covered by Section 13 of this Rule and have taken only
one (1) semester or Basic ROTC or E-ROTC/ NSP, shall be take one more semester of any
NSTP components to qualify for graduation purposes. d. Students who want to qualify for

enlistment in the Reserve Force or attend the Advance ROTC program shall undertake a
special program for this purpose.
