Act is rightfully credited with a reach
that extends far beyond the minimum
health care coverage package into
virtually every health care crevice,
including electronic medical records,
accountable care organizations,
meaningful use, alternative payment
models and the physician quality
reporting system.
To be fair, however, the shift was
underway well before the passage of
the Affordable Care Act. Management
consulting firm, Accenture, which
has tracked the evolution of physician
practice models from 2000 to 2012,
found that, while there has been an
increase in the number of practicing
physicians, the number of independent
physician practitioners has decreased.
An estimated 57% of the 682,470
physicians practicing in 2000 were
considered independent practitioners.
By 2012, the number of practicing
physicians had increased to 783,526, but
fewer of them (39%) were categorized
as “independent.”
Clearly, the demand for alternative
practice options isn’t solely attributable
to third party or governmental
marketplace forces. The demand
is driven by doctors too, as a new
generation of practitioners with their
own priorities assumes prominence in
the workforce. And this generation,
even as their members are encumbered
with a staggering student debt load,
places a higher value on work-life
balance, f lexibility and guaranteed
income than did its predecessors.
Whether you love it or hate it, the Affordable Care Act is rightfully
credited with a reach that extends far beyond the minimum healthcare
coverage package into virtually every healthcare crevice.
Also contributing to the changing face
of healthcare practice is the escalating
cost of opening a solo practice. Rising
costs for supplies, labor and capital
equipment, especially information
technology, uncertain reimbursement
rates, student debt and collection
difficulties, continue to consume a
growing portion of the bottom line.
If physicians and dentists are trending
away from the individual or small
practice, what are they trending
towards? A variety of business models as
it happens; dental service organizations,
dental management organizations,
accountable care organizations,
single-specialty group practices,
multi-specialty group practices, and
employer hospitals are but a few of the
available options. These may be just
the beginning. In the coming years we
may expect to witness the birth and
consolidation of even more practice

each of these incarnations will have
a few features in common, it is likely
that their operating distinctions will
outweigh their similarities.

As an OMS who helped found a large,
medical/dental practitioner-owned
specialty practice, I can tell you that
the factors that led to the creation of
my group in 1999 are much the same
as those leading others to follow a
similar path today. I can attest to the
fact that practicing in such a business
model can be professionally stimulating,
intellectually challenging and
financially rewarding. In short, there is
no right way to practice our specialty.
Your practice route is your own, and
AAOMS is committed to supporting
its members in whatever shape or form
their practice takes. I recently appointed
a Special Committee on Evolving
Practice Models to examine current
trends and develop recommendations to
assist the membership in understanding
and responding to these challenges.
Meanwhile, I encourage you to
investigate your opportunities closely
and carefully before making your
practice choice. Be certain you are
fully informed about your duties,
responsibilities and your rights as an
OMS and a member of the practice.
And then you can focus on what led
you to oral and maxillofacial surgery
in the first place—caring for patients in

CGA Holds Annual Meeting in Washington, DC

T he AAOMS Committee on
Governmental Affairs (CGA)
met on Monday, January 26,
2015 at the JW Marriott Hotel in
Washington, DC. This was the annual

Schwartz, professional staffer for the
Subcommittee on Health of the Senate
Health, Education, Labor and Pensions
(HELP) Committee, who briefed them
on repealing the Sustainable Growth
Rate (SGR) formula used to determine
Medicare physician reimbursement
rates, the need for more patient
f lexibility in using f lexible spending
and health savings accounts (FSAs and
HSAs), the odds of Congress delaying
implementation of ICD-10, the high
likelihood of Congress repealing the
medical device tax in 2015, and the
level of interest legislators currently
have for pursuing more improvements
to preventing drug shortages.
On Monday afternoon committee
members heard a special presentation
from Nick Sloey, an associate attorney
at Bryan Cave LLP, who specializes in
antitrust law. Mr. Sloey provided an
in-depth explanation of antitrust law,
the antitrust exemption that health
insurance companies currently enjoy in
the US, and the implications that stem
from this exemption.

n The 114th Congress opened on Jan.
6, and immediately reelected Rep.
John Boehner (R-OH) Speaker of
the House, overcoming an effort by a
number of conservatives determined
to oust him as speaker. Rep. Boehner
garnered a total of 216 votes out of
408 cast.
n On Jan. 16, Marilyn Tavenner,
administrator of the Centers for
Medicare & Medicaid Services,
announced that she would step down
at the end of February. According
to the DHHS, Principal Deputy
Administrator Andy Slavitt will take
over as acting administrator. Tavenner,
who joined the CMS in 2010, was the
first agency head to be confirmed in
over six years.
n On Jan. 21-22, the House Energy
and Commerce Health Subcommittee
held a hearing on Medicare physician
reimbursement and the sustainable
growth rate (SGR). Witnesses
testified that any plan to permanently
fix the way Medicare reimburses
physicians under the SGR must be
offset if it’s to have any chance of
passing both the House and Senate.
Lawmakers still disagree on how to
do this. Republicans have proposed
structural changes to Medicare, while
Democrats think war funds should be
used. The current patch for the SGR
expires March 31. If lawmakers do
not pass another patch—long-term or
short-term—Medicare payments to
doctors will be reduced by 21 percent.

n On Feb. 3, the House passed
HR 596, which would repeal the
Affordable Care Act and provide
instructions to specific House
committees on crafting replacement
legislation within 180 days of the bill’s
passage. The vote marks the 56th time
House Republicans have voted to
repeal or modify the law since it was
enacted. The White House has said
it will veto the bill if it advances to
President Obama.
n On Feb. 5, the FDA confirmed that
Commissioner Margaret A. Hamburg
will step down at the end of March.
Dr. Stephen Ostroff has agreed
to serve as Acting Commissioner.
Hamburg is one of the agency’s
longest serving commissioners, having
been in the post for six years.
STATE ISSUES
n AAOMS has published a summary
of the 2014 legislative and regulatory
activity that may impact the specialty.
The document was announced in
the February 4 President’s e-letter
and is available upon request by
contacting the AAOMS Department
of Governmental Affairs.
n Vermont Governor Peter Shumlin
(D) made a surprise announcement
during a December 17 press
conference that he would abandon
his plans to implement a single-
payer health system in the state. The
Vermont legislature enacted legislation
in 2011 to establish Green Mountain
Care, the state’s proposed single-
payer system, but its implementation
hinged on a number of factors,
including funding, integration with
the Affordable Care Act, and approval
from HHS and CMS. After years of
investigation and planning, it was
determined that the state would
need to raise more in revenue than
initially estimated, requiring higher
income and payroll taxes, to finance
the new system. Given the high
cost, the Governor felt it would not
be prudent to move forward with
implementation.
n In February, South Dakota
Governor Dennis Daugaard (R)
signed legislation (HB 1045) into
law that, among other things, adopts
the American Dental Association
(ADA) Definition of Dentistry. The
definition was included in a larger
dental practice act package, which was
promoted by the South Dakota Dental
Association. The ADA definition
was adopted by the ADA House of
Delegates in 1997, and is supported
by the AAOMS. More than 20 states
have now adopted the ADA definition
of dentistry. The new South Dakota
law takes effect July 1, 2015.

have an 80%–90% survival rate.
Unfortunately, the majority of cases
are found as late stage cancers,
and this accounts for the very high
death rate of about 43% at five
years from diagnosis.
It doesn’t have to be this way
and the dental community is the
first line of defense through the
process of early discovery. This is
a great opportunity for your office
to not only get involved with your
community by doing a great service,
but also to potentially build your
practice while positioning your

T he goal of the AAOMS
Informational Campaign
is to acquaint public and
professional audiences, legislative
and regulatory agencies, insurance
and third party carriers, and other
communities of interest with the
training and skill of today’s oral and
maxillofacial surgeons, the range of
conditions we treat and the procedures
we perform.
The Campaign was conceived in 2013
by the AAOMS Board of Trustees in
response to survey data that showed a
majority of young adults, their parents,
and older adults had little knowledge
of oral and maxillofacial surgery, and
were in fact confused by the word
“maxillofacial.” The campaign was
subsequently approved by the 2013
House of Delegates, with funding
expenditures of $800,000 in year one.
During the initial year, AAOMS and
Athorn Clark & Partners, the New
York marketing firm engaged by
AAOMS to create the advertisements
and overall appearance and message
of the campaign, took a relatively
conservative approach to the project
with the intent of laying a foundation
for future expansion. Central to the
campaign’s success was MyOMS.
org, the new AAOMS public Web
site, which lent its design and brand
elements to provide a cohesive and
recognizable appearance to the
advertisements and other campaign
elements. Three areas of the OMS
scope of practice - third molars, dental
implants and anesthesia - were selected
for promotion in the first year. Print
and digital advertising relating to
these topics was placed in professional
journals, newsletters and Web sites
that focused on general dentists,
orthodontists, pediatric dentists and
dental hygienists, and on Web sites
favored by young adults age 25 to 30,
mothers of teenagers and young adults,
and older adults age 40 and older.
The full thrust of the Informational
Campaign did not get underway
until April 2014, and while anecdotal
reports indicated the campaign was
well-received by its target audiences,
there had not been enough time
to gather hard impact data for the
2014 Annual Meeting in Hawaii.
Regardless, the new videos on third
molars, dental implants and anesthesia
were praised by annual meeting
attendees who indicated they would
use them in their practices and on their
practice Web sites. A comprehensive
presentation by the principals of
Athorn Clark & Partners recapping the
campaign’s first year further impressed
those attending the Reference
Committee hearings. The House of
Delegates signaled their support of the
campaign by approving a second year
and increasing funding to $1.9 million.
With this increased budget, year two
of the campaign will see an expansion

of the topics promoted to public and
professional audiences. Joining third
molars, dental implants and anesthesia
will be corrective jaw surgery, head,
neck and oral cancer, TMJ and
obstructive sleep apnea. Videos will be
developed for these new areas and the
current advertising campaign will be
enlarged to accommodate them. The
audience for the campaign will also
increase with the addition of dental
and pre-dental students, as well as
support for AAOMS’s state and federal
advocacy efforts. Our investment in
Google Adwords will continue, as will
our efforts to quantify the campaign’s
results.
Additionally, there are plans to branch
out into public service announcements
(PSAs) that encourage patients to
regularly perform self-examinations
for oral cancer. If patients see
something unusual, they are advised
to see their dentist or an oral and
maxillofacial surgeon for a professional
examination. We anticipate these PSAs
will run during April’s Oral Cancer
Month observance.
The Board of Trustees’ decision
to propose the continuation of the
Informational Campaign in 2015 was
carefully considered. We began with
an in-depth look at the healthcare

What Patients Don’t Know Can’t Hurt Them
W hereas we are all familiar
with the placebo effect
and its beneficial aspects
on improving treatment success, we
often fail to consider the opposite
aspect—the nocebo effect—in which
adverse events can be triggered by
patients’ negative expectations. I
remember doing a double-blind
study of a drug many years ago in
which one of the known side-effects
was that it could cause drowsiness.
Obviously, we were required to
inform all patients of this possibility.
What we found was that more
patients who received the placebo
complained of drowsiness than those
on the actual drug. One wonders
how this plays out in patients taking
some of the drugs currently advertised
on television in which the listing
of potential side-effects takes twice
as long as presentation of the drug’s
possible benefits.
We now know that a patient’s
expectations of how a treatment will
affect them can have a profound effect
on the side-effects that can occur and
the ultimate success of the treatment.
Such things as the prior occurrence of
unwanted adverse effects with other
medications or previous drug failures
can translate into similar results with
other pharmacologic approaches.
Moreover, nocebo drug effects do
not necessarily have to be based on

the patient’s own prior experience.
Studies have shown that just hearing
about unwanted adverse effects in
the media or in advertisements can
have the same result. As a negative
consequence of such experiences,
patients who then blame their
symptoms on the drug may stop
taking what could be a potentially
beneficial treatment.
“A patient’s expectations of
how a treatment will affect
them can have a profound
effect on the success of the
treatment.”
Being told about a procedure’s possible
side-effects can also have negative
results. For example, although it has
been suggested that properly preparing
patients for a painful situation by
informing them of its occurrence will
reduce anxiety and lessen the adverse
experience, it has now been shown
that stating “It might hurt a bit” or
using words like “sting or burn a
little” actually resulted in the opposite
effect. Patients who expected to suffer
painful symptoms were more likely to
do so.
While there are potential negative
effects of informing patients
about possible side-effects and
complications, not doing so creates
medico-legal and ethical dilemmas.

or should we be more concerned
about limiting patient discomfort?
Although there is no definitive
answer to this question, there are
two possible recommendations. One
is to reframe your warnings about
complications and side-effects to
emphasize the positive aspects, using
phrases such as “Most patients tolerate
this (medication, procedure) well,”
or “This complication rarely occurs.”
The other is to ask patients if they
want to hear about mild or minor
side-effects. Choosing our words
carefully and emphasizing the positive
may not resolve all of the problems,
but it can go a long way toward
reducing the nocebo effect. T

Question: What is the difference
between an incisional biopsy and
an excisional biopsy?
Answer: An incisional biopsy is
defined as the removal of a portion of
the lesion for microscopic study. When
performing an excisional biopsy, the
entire lesion is removed for examination.
As noted in the January/ February
2015 issue of the AAOMS Today, the
codes used to report incisional biopsies
(D7285 and D7286) have been revised
in the 2015 CDT© manual. These
codes now better clarify when to
report an incisional versus an excisional
biopsy.
Below are some general biopsy
coding tips:
• When coding a biopsy or a more
extensive surgical procedure,
always report the final diagnosis
on the claim, ie, the postoperative
diagnosis listed on the operative
report or the final diagnosis from
the pathology lab. While this
may delay the claim submission
process, it is consistent with coding
guidelines.
• If a biopsy and a related therapeutic
procedure occur during the same
operative encounter, only the
therapeutic procedure is reported.

For example, if a biopsy of the
vestibule of mouth and an excision
of the same area are performed in
the same operative session, only
the excision should be reported.
• If a biopsy of one location and a
therapeutic procedure of another
location are performed during the
same operative encounter, both
procedures can be reported.
• Local anesthesia is included in the
biopsy service. Simple suture repair
of the biopsy site is also included in
the service.
Excision of Lesions Coding Tips
As stated previously, an excision is a
full-thickness removal of the entire
lesion. Consider the following when
selecting the correct excision code:
• What is the lesion type (benign or
malignant)?
• What is the anatomic site?
• What is the lesion diameter,
including margins? This should
ref lect the greatest clinical
diameter of the lesion plus the
margin required for complete
excision in linear centimeters.
Question: The 2015 CDT manual
contains new code D9219-
evaluation for deep sedation or
general anesthesia. Can this code

Answer: No. Code D9219 is not

code D9219 may be reported on the
same date as the surgical procedure

anesthetic evaluation is necessary prior
to performing surgery.
Question: We often have
patients that miss or cancel their
appointment and I noticed that
there are two new CDT codes
D9986- missed appointments and
D9987- canceled appointments.
How are these codes to be
reported to the carrier?
Answer: The new CDT codes D9986-
missed appointments and D9987-
canceled appointments are non-clinical
procedure codes. These codes are for
internal tracking. The codes were not
created for reimbursement purposes.
On a related note, Medicare adopted
a policy in October 2007 that states
they will not reimburse a provider for
an appointment missed by one of its

beneficiaries but that providers may bill beneficiaries directly. 

Medicare has also stated it would not be appropriate to only
charge Medicare beneficiaries, and that non-Medicare patients
would have to be charged at the same rate

M
edicare’s Physician Quality
Reporting System (PQRS)
is a voluntary program that
uses payment adjustments to promote
the reporting of quality information by
eligible professionals through the use of
PQRS measures and their correlating
Quality Data Codes (QDC).
WHO IS ELIGIBLE TO REPORT?
Oral and maxillofacial surgeons and
other professionals who render services
for which PQRS measures exist are
eligible to report those measures. (see
list of measures applicable to OMSs at
http://www.aaoms.org/docs/practice_

WHAT ARE THE PQRS
MEASURES?
Quality measures help quantify
healthcare processes, patient outcomes
and/or perceptions, and address various
aspects of care, including prevention,
chronic and acute care management,
procedure-related care, resource
utilization and care coordination.
Providers may report either individual
measures or measure groups. While 23
measure groups have been established
for the 2015 Physician Quality
Reporting System, there are no

measure groups applicable to oral and
maxillofacial surgery at this time.
Individual Measures: There are over 250
individual PQRS measures for claims
or registry-based reporting, 17 of
which are applicable to OMS. To avoid
a payment adjustment, an applicable
measure is to be reported each time
a procedure is performed during the
reporting period.
For example, when the OMS reports
a mandibular fracture repair code
(ie, 21461-21462) and documents
the order for prophylactic parenteral
antibiotics prior to the fracture repair
in the patient’s record, PQRS measure

National Quality Strategy Domains:
Quality measures selected must cover
at least three of the six available
National Quality Strategy (NQS)
domains, which represent the
Department of Health and Human
Services’ (HHS) NQS priorities for
health care quality improvement.
The 6 NQS domains are:
1. Patient and Family Engagement
2. Patient Safety
3. Care Coordination
4. Population/Public Health
5. Efficient Use of Healthcare
Resources
6. Clinical Process/Effectiveness
Cross-Cutting Measures: Beginning in
2015, eligible professionals or group
practices are also required to report
at least 1 of 18 cross-cutting measures
if they have a face-to-face encounter
with at least one Medicare patient. The
CMS defines a face-to-face encounter
as an instance in which the Eligible
Physician billed for services that are
associated with face-to-face encounters
under the Physician Fee Schedule
(PFS). This includes general office
visits, outpatient visits and surgical
procedure codes. CMS does not

consider telehealth visits face-to-face
encounters.
WHAT ARE PQRS PAYMENT
ADJUSTMENTS?
PQRS payment adjustments are made
two years after the reporting calendar
year. For example, if an OMS failed to
participate in the 2014 PQRS program,
his/her Medicare payment in 2016 will
ref lect a 2% reduction.
In addition to the PQRS payment
reduction of 2%, the Affordable Care
Act established the “value-based
payment modifier,” which will also be
applied to all doctors beginning with
the 2015 PQRS program. Those who
do not successfully report for PQRS
during the 2015 calendar year will
receive a value-based modifier payment
reduction of 2% for solo practitioners
and groups with two to nine EPs and
for groups with 10 or more EPs in
2017. For more information on the

REPORTING OPTIONS
Medicare providers may report quality
measures as an individual or under
the Group Practice Reporting Option
(GPRO). Under the 2015 Physician
Quality Reporting, a GPRO consists
of a physician group practice using
a single Tax Identification Number
(TIN) with two or more individual
eligible professionals (each identified
by a different National Provider
Identifier (NPI)) who have reassigned
their billing rights to the group
TIN. Group practices reporting via
GPRO must register for their selected
reporting method by June 30, 2015.

to the CMS:

• Qualified Electronic Health

• Qualified PQRS data submission
vendor (new for 2014),
• Qualified Clinical Data Registry
(new for 2014), or
• The Group Practice Reporting
Option (GPRO).

control be incorporated into
office design?
Answer: When designing an office,
keep in mind six main considerations
for the safety of patients and workers:
(1) office f low; (2) cabinetry; (3)
laminate wall and f loor coverings;
(4) fixtures, dispensers, and waste
drops; (5) support equipment; and (6)
ventilation.
Office f low should facilitate moving
from one area to another with
minimal cross-contamination. In
cabinetry, the number of drawers and
their contents should be minimized
to ease clean-up and reduce possible
cross-contamination. Drawers should
also be no less than five inches deep
to accommodate support instruments.
Laminate wall and f loor coverings
allow cleaning and disinfection of
all surfaces. Fixtures, dispensers
and waste drops should require
minimal hand contact to maximize
the infection control effectiveness.
Support equipment should be
positioned strategically with operator
ease, comfort and team safety in mind.
Finally, work areas must have positive
ventilation to rid areas of harmful
vapors.

2015 Gies Awards in recognition of their outstanding
vision, innovation, and achievement. The Awards were
presented March 9, 2015, during the ADEA Annual
Meeting in Boston, MA. AAOMS President William
J. Nelson, DDS, presented the 2015 Gies Award for
Outstanding Innovation by a Dental Educator to Dr.
Rodriquez, the oral and maxillofacial surgeon who in
2012, led the team at the University of Maryland in
performing the most extensive full face transplant to date
on 37 year-old Richard Lee Norris, who was injured
in a gun accident in 1997.  Dr. Rodriquez, chair of the
Department of Plastic Surgery at the NYU Langone
Medical Center, discussed his innovative surgical
techniques last fall at the 2014 AAOMS Annual Meeting
in Honolulu. Walter C. Guralnick, Professor Emeritus
of Oral and Maxillofacial Surgery, Harvard School of
Dental Medicine, was also honored with the Gies Award
for Outstanding Innovation by a Dental Educator.

every year since 1998, to provide free dental services to
indigent people in Guatemala, Honduras, Mexico, the
Dominican Republic and Peru. He learned Spanish in order
to better communicate with his patients.
Dr. Caton founded and funded the dental clinic at Gainesville
Community Ministries to provide dental services to hundreds
of needy patients a year for a small payment. In addition, he
has provided more than $20,000 worth of free dental services
to a program for at-risk teenage girls. T

Healthcare Law Offers New Insurance Options
For Small Employers
I f you’re an employer with 50
or fewer full-time equivalent
employees, the Affordable Care
Act offers you a new way to buy health
insurance. It’s called the Small Business
Health Options Program (SHOP) and
it is part of the new Health Insurance
Marketplace.
Purchasing a SHOP-qualified health
plan for your employees does have
some important advantages—including
access to tax credits worth up to 50% of
your premium contributions if you meet
the other eligibility requirements for the
tax credit.
Additionally, SHOPs in many states
have added a number of exciting new
features, including online enrollment
for small groups and an option to offer
employees a choice among different
health plans.
Remember, the ACA does not
require employers with fewer than 50
employees to offer health insurance and
there’s no penalty if you choose to not
do so.
But if you’re an eligible employer
interested in providing employee health
coverage, the SHOP Marketplace offers
you a variety of advantages: a choice
of quality, private health insurance
plans, different coverage levels, online
information and tools to help you

coverage between November 15 and
December 15 in any year.
THE SMALL BUSINESS HEALTH
CARE TAX CREDIT
Buying insurance through the SHOP
Marketplace can also bring substantial
tax benefits. You may be able to
claim a Small Business Health Care
Tax Credit worth up to 50 percent of
your premium contributions (up to
35 percent for tax-exempt employers)
if you have fewer than 25 employees
with average wages of $50,000 or less.
Small employers have already received
more than $1.5 billion since this tax
credit was created in 2010.
HealthCare.gov also now offers an
online Tax Credit Estimator to help
you learn if you might be eligible for
the Small Business Health Care Tax
Credit, and how large a credit you
might be able to receive.
The credit can be claimed for any
two consecutive tax years that begin
in 2014 or later, even if you claimed
the Small Business tax credit between
2010 and 2013, before the SHOP
Marketplace began operating. The
credit during those years was worth
up to 35% of a for-profit employer’s
premium contribution (25% for a tax-
exempt employer).
OTHER ACA PROTECTIONS
THAT HELP SMALL
EMPLOYERS
Every plan in the SHOP Marketplace
covers a comprehensive set of benefits,
including doctor visits, hospital stays,
preventive care, and prescriptions.
New rules require these plans to treat
you fairly; insurance companies can’t
raise premiums for the group just
because of an employee’s preexisting
health condition, or because an
employee gets sick or injured. There
are new restrictions on charging small
groups higher premiums for older
employees.

SHOP Employer Call Center toll-free
at 800/706-7893. TTY users should
call 711 to access the SHOP Employer
Call Center. Tell the customer service
representative if you need help in a
