This SUB-LEASE contract is entered into by and between: CHARMIE JILL V. REDONA, of legal age, married and a resident of No.12, rd 3 st. Happy Valley, V.Rama, Cebu City hereinafter referred to as SUB-LESSOR, And JERWIN C. NONO and BELLE QUIMBO both of legal age, and residents of Room 116 Bldg 17, Urban Homes Tipolo, Mandaue City, hereinafter reffered to as SUB-LESSEE. WITNESSETH: WHEREAS, the SUB-LESSOR is the LESSEE of a portion of a building located at F. Ramos corner Liman Tian Teng Sts, Brgy Sta. Cruz, Cebu City, owned by Mr. Kevin Y. Lim per contract of Lease herein forming a part of this contract of Sub-Lease; WHEREASE, the SUB-LESSEE desires to sub-lease a portion of the area from the SUB-LESSOR described as Door 3-C, 3rd Floor of the said building. NOW, THEREFORE, for and in consideration of the foregoing premises and of the terms and condition hereunder enumerated, the SUB-LESSOR and the SUB-LESSEE have mutually agreed as follows: 1. The original Contract of Lease between the SUB-LESOR and Mr. Kevin Y. Lim shall form part of this Contract of Sub-Lease, binding upon the herein SUB-LESSEE all its aspects, terms and conditions in the same manner, force and effect that it is binding upon the SUB-LESSOR; hereby creating obligations in favour of the SUB-LESSOR in the same way the Contract of Lease creates obligations in favour of the original Lessor; 2. The SUB-LESSE shall use the premises solely for the purpose of doing MILKTEA & SNACK BAR business subject to the same rules and regulations prescribed in the original Contract of Lease, particularly condition No. 11 thereof; 3. The duration of this SUB-LEASE is coterminous with and under the same terms and conditions of the original Contract of Lease; 4. The SUB-LESSEE shall pay to the SUB-LESSOR a monthly rental equivalent to one-half (1/2) of the rental to be paid by the SUB-LESSOR to the original Lessor, under the same terms and conditions prescribed in the original Contract of Lease governing the manner and time of payment, the option and penalties set forth therein, which shall now form part of the rights of the herein SUB-LESSOR. Provided that, the monthly rental shall be paid on or before the third day of every month; 5. Upon signing hereof, the SUB-LESSEE shall tender to the SUB-LESSOR the amount of P41,775.00 which forms part of the deposit tendered by the SUB- LESSOR to the lessor in the original contract of lease; 6. The parties shall equally share and observe all the rest of the financial and administrative obligations and responsibilities set forth in the original Contact of Lease. Provided that, the payment, rental and other expenses for the use of the electric generating machine in the area shall be defrayed by the party who uses the generator.
