1.3) Discussion of the amendments and changes to important Codes:

1 January 2017 – Polar Code

The International Code for Ships Operating in Polar Waters (Polar Code) and related
amendments to make it mandatory under both SOLAS and MARPOL enter into force.
The Polar Code will apply to new ships constructed after 1 January 2017. Ships constructed
before 1 January 2017 will be required to meet the relevant requirements of the Polar Code by
the first intermediate or renewal survey, whichever occurs first, after 1 January 2018

1 January 2017 – MARPOL Annex I – oil residues

Amendments to regulation 12 of MARPOL Annex I, concerning tanks for oil residues (sludge).
The amendments update and revise the regulation, expanding on the requirements for discharge
connections and piping to ensure oil residues are properly disposed of.

1 January 2017 – SOLAS – IGF Code

International Code of Safety for Ships using Gases or other Low-flashpoint Fuels (IGF Code),
along with amendments to make the Code mandatory under SOLAS enter into force.
The amendments to SOLAS chapter II-1 (Construction – Structure, subdivision and stability,
machinery and electrical installations), include amendments to Part F Alternative design and
arrangements, to provide a methodology for alternative design and arrangements for machinery,
electrical installations and low-flashpoint fuel storage and distribution systems; and a new Part G
Ships using low-flashpoint fuels, to add new regulations to require ships constructed after the
expected date of entry into force of 1 January 2017 to comply with the requirements of the IGF
Code, together with related amendments to chapter II-2 and Appendix (Certificates).

The IGF Code contains mandatory provisions for the arrangement, installation, control and
monitoring of machinery, equipment and systems using low-flashpoint fuels, focusing initially
on LNG.
The Code addresses all areas that need special consideration for the usage of low-flashpoint
fuels, taking a goal-based approach, with goals and functional requirements specified for each
section forming the basis for the design, construction and operation of ships using this type of
fuel.

Amendments to the International Convention on Standards of Training, Certification and
Watchkeeping for Seafarers (STCW), and STCW Code, to include new mandatory minimum
requirements for the training and qualifications of masters, officers, ratings and other personnel
on ships subject to the IGF Code, also enter into force on 1 January 2017.

1 January 2017 – SOLAS – venting

Amendments to SOLAS regulations II-2/4.5 and II-2/11.6, clarifying the provisions related to the
secondary means of venting cargo tanks in order to ensure adequate safety against over- and
under-pressure in the event of a cargo tank isolation valve being damaged or inadvertently
closed, and SOLAS regulation II-2/20 relating to performance of ventilation systems.

1 January 2017 – STCW Manila amendments transitional provisions end

From 1 January 2017, STCW certificates must be issued, renewed and revalidated in accordance
with the provisions of the 2010 Manila Amendments.

1 September 2017 – MARPOL amendments sewage special area, NOx tier III reporting

MARPOL amendments adopted in April 2016 (MEPC 69) enter into force:

1. Amendments to MARPOL Annex IV relating to the dates for implementation of the


discharge requirements for passenger ships while in a special area, i.e. not before 1 June
2019 for new passenger ships and not before 1 June 2021 for existing passenger ships;

2. Amendments to MARPOL Annex II, appendix I, related to the revised GESAMP hazard
evaluation procedure;

3. Amendments to MARPOL Annex VI regarding record requirements for operational


compliance with NOX Tier III emission control areas;

4. Amendments to the NOX Technical Code 2008 to facilitate the testing of gas-fuelled
engines and dual fuel engines.

1 January 2018 – Revised FAL Convention

The revised Annex to the Convention on Facilitation of International Maritime Traffic (FAL)
includes mandatory requirements for the electronic exchange of information on cargo, crew and
passengers.

A new recommended practice encourages the use of the “single window” concept, to enable all
the information required by public authorities in connection with the arrival, stay and departure
of ships, persons and cargo, to be submitted via a single portal without duplication.

Other revised standards cover shore leave and access to shore-side facilities for crew, including
the addition of a paragraph in the standard to say that there should be no discrimination, in
respect of shore leave, on grounds of nationality, race, colour, sex, religion, political opinion, or
social origin, and irrespective of the flag State of the ship on which seafarers are employed,
engaged or work.

Standards and recommended practices relating to stowaways are also updated, to include
references to relevant sections of the International Ship and Port Facilities’ Security (ISPS)
Code. A new standard requires Governments, where appropriate, to incorporate into their
national legislation legal grounds to allow prosecution of stowaways, attempted stowaways and
any individual or company aiding a stowaway or an attempted stowaway with the intention to
facilitate access to the port area, any ship, cargo or freight containers.

The IMO Standardized Forms (FAL forms), which cover IMO General Declaration; Cargo
Declaration; Ship’s Stores Declaration; Crew’s Effects Declaration; Crew List• Passenger List
and Dangerous Goods have also been revised.

1 March 2018 – MARPOL Annex VICollection and reporting of ship fuel oil consumption
data

Adopted by MEPC 70. New mandatory fuel oil data collection system. Amendments to chapter 4
of annex VI of the International Convention for the Prevention of Pollution from Ships
(MARPOL) add new Regulation 22A on Collection and reporting of ship fuel oil consumption
data. Under the new requirements, ships of 5,000 gross tonnage and above will have to collect
consumption data for each type of fuel oil they use, as well as other, additional, specified data
including proxies for transport work. Also new appendices covering Information to be submitted
to the IMO Ship Fuel Oil Consumption Database and form of the Statement of Compliance,
which would be issued to the ship once the relevant data had been reported. Other regulations are
amended to cater for the new requirement, including those related to certificates, surveys and
port State control.

1 March 2018 – MARPOL Annex I (IOPPC), MARPOL Annex V (HME products)

Adopted by MEPC 70:

 Amendments to MARPOL Annex I to update Form B of the Supplement to the


International Oil Pollution Prevention Certificate, in relation to segregated ballast tanks;

 Amendments to MARPOL Annex V related to products which are hazardous to the


marine environment (HME) and Form of Garbage Record Book. The amendments provide
criteria for the classification of solid bulk cargoes as harmful to the marine environment and
are aimed at ensuring that such substances are declared by the shipper if they are classed as
harmful and are not discharged.

Adopted by MEPC 71:
Amendments to MARPOL Annex VI to designate the North Sea and the Baltic Sea as emission
control areas (ECAs) for nitrogen oxides (NOX) under regulation 13 of MARPOL Annex
VI. Both ECAs will take effect on 1 January 2021, thereby considerably lowering emissions of
NOx from international shipping in those areas.
Amendments to the information to be included in the bunker delivery note relating to the supply
of marine fuel oil to ships which have fitted alternative mechanisms to address sulphur emission
requirements.
1 January 2019 - IMSBC Code
The 2017 set of draft amendments (04-17) to the International Maritime Solid Bulk Cargoes
Code (IMSBC Code), to update requirements for a number of cargoes. The amendments also
included those relating to paragraphs 4.5.1 and 4.5.2, highlighting the responsibility of the
shipper for ensuring that a test to determine the transportable moisture limit (TML) of a solid
bulk cargo is conducted. Also included were amendments related to substances which are
harmful to marine environment, to require the shipper to declare whether or not a solid bulk
cargo, other than grain, is harmful to the marine environment.
8 April 2019 - Electronic data exchange under FAL Convention
Under the revised Annex to the Convention on Facilitation of International Maritime Traffic
(FAL), from 8 April 2019, it becomes mandatory for ships and ports to exchange FAL
data electronically. The revised Convention also encourages use of the so-called “single
window” concept in which all the many agencies and authorities involved exchange data via a
single point of contact.
1 September 2019 MARPOL Annex VI amendments

Amendment to Regulation 13 – Nitrogen oxides (NOX) to make clearer emission control areas
for NOx, by replacing the words "an emission control area designated under paragraph 6 of this
regulation" with the words "a NOX Tier III emission control area";
Amendments to Regulation 21 – Required EEDI to update the reference values for Ro-ro cargo
ship and Ro-ro passenger ship.

13 October 2019 Amendments to the BWM Convention
The amendments to the International Convention for the Control and Management of Ships'
Ballast Water and Sediments, 2004 (BWM Convention) relate to the implementation of the
treaty, including the schedule for ships to comply with the requirement to meet the so-called D-2
standard (amendments to section B).
Other amendments (to sections A and D) make mandatory the Code for approval of ballast water
management systems, which was also be adopted at the session. Further amendments relate to
section E on survey and certification.
1 January 2020 - MARPOL Annex VI 0.50% sulphur limit
The global limit for sulphur in fuel oil used on board ships of 0.50% m/m (mass by mass) enters
into effect from 1 January 2020. This will significantly reduce the amount of sulphur oxide
emanating from ships and should have major health and environmental benefits for the world,
particularly for populations living close to ports and coasts. See here for further information. .

Amendments adopted by MSC 98:
A set of amendments to SOLAS chapter II-1 relating to subdivision and damage stability. The
amendments were developed following a substantive review of SOLAS chapter II-1, focusing in
particular on new passenger ships. The review has taken into account recommendations arising
from the investigation into the 2012 Costa Concordia incident. In conjunction with the adoption
of the aforementioned amendments, the MSC adopted the Revised Explanatory Notes to SOLAS

chapter II-1 subdivision and damage stability regulations. The MSC also approved the Revised
guidance for watertight doors on passenger ships which may be opened during navigation.
Amendments to SOLAS regulation II-2/3.56, relating to the definition of vehicle carrier and draft
new SOLAS regulation II-2/20.2 on fire safety requirements for cargo spaces containing vehicles
with fuel in their tanks for their own propulsion, specifically vehicles which do not use their own
propulsion within the cargo space.
Amendments to SOLAS regulation II-2/9.4.1.3 to clarify the requirements for fire integrity of
windows on passenger ships carrying not more than 36 passengers and on special purpose ships
with more than 60 (but no more than 240) persons on board.
Amendments to SOLAS regulations III/1.4, III/30 and III/37 on damage control drills for
passenger ships, to require damage control drills to take place on all passenger ships from 2020.
Amendments adopted by MSC 99:
Amendments to SOLAS regulations II-1/1 and II-1/8-1, concerning computerized stability
support for the master in case of flooding for existing passenger ships.
Amendments to chapter IV of SOLAS, and the appendix to the annex to the 1974 SOLAS
Convention, replacing all references to "Inmarsat" with references to a ”recognized mobile
satellite service" and consequential amendments to the International Code of Safety for High
speed Craft, 1994 (1994 HSC Code), the International Code of Safety for High-speed Craft, 2000
(2000 HSC Code) and the Code of Safety for Special Purpose Ships, 2008 (2008 SPS Code).
Amendments to update the IMDG Code (Amendment 39-18) in line with the latest
recommendations from the United Nations Recommendations on the Transport of Dangerous
Goods, including new provisions regarding IMO type 9 tank, a set of new abbreviations for
segregation groups and special provisions for carriage of lithium batteries and of vehicles
powered by flammable liquid or gas.
Amendments to annex 3 to the International Code for the Application of Fire Test Procedures,
2010 (2010 FTP Code), concerning fire protection materials and required approval test methods
for passenger ships and high speed craft.
Amendments to the model forms of the Certificates of Fitness, clarifying the requirement for an
approved loading and stability manual/booklet to be supplied to the ship, under the International
Code for the Construction and Equipment of Ships Carrying Dangerous Chemicals in Bulk (IBC
Code), International Code for the Construction and Equipment of Ships Carrying Liquefied
Gases in Bulk (IGC Code), Code for the Construction and Equipment of Ships Carrying
Dangerous Chemicals in Bulk (BCH Code), Code for Existing Ships Carrying Liquefied Gases
in Bulk (EGC Code), and the Code for the Construction and Equipment of Ships Carrying
Liquefied Gases in Bulk (GC Code).

1 March 2020 - MARPOL Annex VI amendments - carriage ban on non-compliant fuel oil
Adopted by MEPC 73: The amendment will prohibit the carriage of non-compliant fuel oil for
combustion purposes for propulsion or operation on board a ship - unless the ship has an exhaust
gas cleaning system ("scrubber") fitted, if accepted by the flag State as an alternative means to
meet the sulphur limit requirement.

The amendment supports consistent implementation of the 0.50% limit on sulphur in ships fuel
oil. The 0.50% limit on sulphur in ships' fuel oil is in force from 1 January 2020, with benefits
for the environment and human health.

1 October 2020 MARPOL amendments – use of electronic record books


Adopted by MEPC 73: MARPOL Amendments to allow for electronic record books to be used
were adopted, for Annex I - Oil Record Book Part I – Machinery space operations and Oil
Record Book Part II – Cargo/ballast operations; Annex II - Cargo Record Book; and Annex V -
Garbage Record Book; and Annex VI for records relating to Regulation 12 – Ozone-depleting
substances, Regulation 13 – Nitrogen oxides (NOX) and Regulation 14 – Sulphur oxides (SOX)
and particulate matter. Guidelines for the use of electronic record books under MARPOL have
been adopted.
1 October 2020 - MARPOL amendments - EEDI regulations for ice-strengthened ships
Adopted by MEPC 73: Amendments to MARPOL Annex VI , relating to the Energy Efficiency
Design Index (EEDI) regulations for ice-strengthened ships, replacing the words "cargo ships
having ice-breaking capability" with "category A ships as defined in the Polar Code".
1 January 2021 - MARPOL amendments - Cargo residues and tank washings of persistent
floating noxious liquid substances
Adopted by MEPC 74:
Amendments to MARPOL Annex II to strengthen, in specified sea areas, discharge requirements
for cargo residues and tank washings containing persistent floating products with a high-
viscosity and/or a high melting point that can solidify under certain conditions (e.g. certain
vegetable oils and paraffin-like cargoes), following concerns about the environmental impact of
permissible discharges.
The amendments add new paragraphs to MARPOL Annex II Regulation 13 – Control of
discharges of residues of noxious liquid substances, to require prewash and discharge of
residue/water mixture generated during the prewash to a reception facility, for specific products,
in specified areas (North West European waters, Baltic Sea area, Western European waters and
Norwegian Sea).

A comprehensive set of amendments to the International Code for the Construction and
Equipment of Ships Carrying Dangerous Chemicals in Bulk (IBC Code), including the revised
chapters 17 (Summary of minimum requirements), 18 (List of products to which the code does
not apply), 19 (Index of Products Carried in Bulk) and 21 (Criteria for assigning carriage
requirements for products subject to the IBC Code).
The consolidated edition of the International Maritime Solid Bulk Cargoes Code (IMSBC Code),
incorporating amendment 05-19. The 2019 amendments include updates to various schedules,
such as new individual schedule for BAUXITE FINES as a Group A cargo, as well as editorial
amendments. The amendments are incorporated into a consolidated IMSBC Code, to include all
amendments to date, since the IMSBC Code was first adopted in 2008.
Amendments to the International Code on the Enhanced Programme of Inspections During
Surveys of Bulk Carriers and Oil Tankers, 2011 (2011 ESP Code), to update the Code. (Entry
into force: 1 January 2021)

Adopted by MSC 101:
Amendments to the appendix to the annex to the 1974 SOLAS, concerning the addition of a
footnote to Forms C, E and P in the Records of Equipment.
Amendments to chapter 15 of the International Code for Fire Safety Systems (FSS Code),
relating to inert gas systems.
Amendments to parts A and A-1 of the International Code of Safety for Ships using Gases or
other Low-flashpoint Fuels (IGF Code), including those relating to regulations on loading limit
for liquefied gas fuel tanks, regulations for fuel distribution outside of machinery space,
regulations for internal combustion engines of piston type and fire protection for fuel storage
hold space; and amendments relating to the protection of the fuel supply for liquefied gas fuel
tanks, aimed at preventing explosions.
Amendments to chapters IV and VI of the International Life-Saving Appliance Code (LSA

amendments, Affecting the survey and Certification of ships

1. 2016 Amendments to the Maritime Labour Convention:


Summary: ILO has prepared amendments to the MLC 2006 with regards to:
Regulation 4.3: Health and safety protection and accident prevention
The intention is to eliminate shipboard harassment and bullying by including relevant provisions
in the code of the MLC 2006
Regulation 5.1: Flag State Responsibilities
The amendment will now allow an extension of not more than five months of the validity of the
Maritime Labour certificate issued for ships. This will apply in cases where the renewal
inspection has been successfully completed, but a new certificate cannot immediately be issued
to the ship. E.g.,where the flag administration issues the full term certificate.
The amendments were approved by the 105th ILO Conference (7 June 2016, Geneva). The final
entry into force date is pending.

2.Draft amendments to the Ballast Water Management Convention,


SECTION E Survey and Certification Requirements for Ballast Water
Management
Summary: At MEPC 71, IMO approved a draft amendment to regulation B-3, subject to final
adoption by MEPC 72 scheduled for April 2018. The expected entry into force date is 1st
November 2019.
The amendment is summarized as follows ,
The deadline for installing ballast water Treatment system for existing ship’s either:
 No later than the first IOPP renewal survey on or after 8th September 2017( Providing
that this survey takes place on or after 8 September 2019; or the vessel has undertaken an IOPP
renewal survey on or after 8 September 2014 but prior to 8 September 2017 ); or
 No later than second IOPP renewal survey on or after 8 September 2017( Providing that
the first IOPP renewal survey on or after 8 September 2017 takes place before 8 September
2019, and the vessel has not undertaken an IOPP renewal Survey on or after 8 September 2014
but prior to 8 September 2017 )

Application: All ships subject to the BWM Convention (survey and certification - 400 GT or
above that have ballast capacity). This includes offshore structures (MODU etc.) The date is 24
months after the entry into force - tentatively - 1 November 2019.

3. Draft amendments to the IBC, BCH, IGC, GC and EGC Codes - Certificate
of Fitness
Estimated Entry into Force: 1 January 2020
Background: It was noted that the changes to the Certificate of Fitness introduced to require a
means of confirming that any specific loading condition complies with damage stability
requirements (Demonstration of compliance with damage stability requirements for tankers
above) required further modification to make it clear that an approved stability manual is still
required.
Summary: Amendments to the Certificate of Fitness will include the loading and stability
information has been provided and a paragraph which states “that the ship must be loaded in
accordance with the loading conditions provided in the approved loading and stability
information booklet referred to in 6 above;” in paragraph 7

4. Draft amendments to MARPOL Annexes I, II, V and VI - Use of electronic


record books
Estimated Entry into Force: 1 December 2020
Background: IMO periodically reviews the administrative provisions of mandatory
requirements and considers ways to make these more efficient.
Summary: The use of electronic record books as an alternative to the current paper versions
required under MARPOL Annexes I, II, V and VI has been agreed. Amendments to the relevant
Annexes of MARPOL addressing the issue of electronic record-keeping are under progress.
Further documentation will be created and existing procedures will be revised to support the
amendments (see Related Instruments below).
The exact MARPOL format should be used to facilitate the transition to electronic record-
keeping and any possible flexibility in the format can be considered again in the future.
Implication:
Shipowners and Ship Managers can select to switch to electronic record books to reduce
administrative burden and the amount of paper waste on board. Any electronic system used for
this purpose will need to meet the specified criteria and be provided with written confirmation by
the Administration which is to be carried on board the ship for the purpose of regulatory surveys
or inspections.

5. Draft amendments to MARPOL Annexes I, IV and VI concerning the
exemption of UNSP barges from survey and certification requirements
Estimated Entry into Force: 1 September 2021
Background: The issue raised at the IMO was whether an unmanned non-self-propelled (UNSP)
barge which does not constitute a source of pollution has to be certified under the MARPOL
Convention and hold certificates with all blank entries in their supplement. A proposal to exempt
UNSP barges from the survey and certification requirements of MARPOL is under discussion.
Summary: The exemption will be granted after an initial survey to ensure there is no source of
pollution on board the barge and the exemption certificates for UNSP barges should be part of
the individual MARPOL Annexes I, IV and VI. It is considered that the period of exemption is
not lifetime but 5 years.
The text of the amendments was expected to be finalized at the fourth session of the III Sub-
Committee (III 4) for approval and adoption at subsequent MEPC sessions, but this was
postponed to III 5 so it cannot enter into force until at least 2021.
