AFFIDAVIT
(RE: WITHDRAWAL OF APPLICATION
FOR REGISTRATION OF ADVERSE CLAIM)

I, ERROL JOSEPH CRUZ, of legal age, Filipino, with postal

address at 235 Ibuna St., Bgy. Onse, San Juan City, after being duly
sworn, hereby depose and state that:

1. In 2013, I filed with the Registry of Deeds of Quezon City a Notice

of Adverse Claim over a condominium unit located at Quezon City
consisting of 106.68 square meters and covered by Condominium
Certificate of Title (“”CCT”) No. 3241 issued by the said Registry of
Deeds in the name of Plutus Holdings Inc. The property is now
covered by CCT No. N-62633 in the name of Pacific Union
Insurance Company, the predecessor-in-interest of Plutus Holdings
Inc. over the said property.

For reference purposes, attached hereto as Annex “A” is a copy of

CCT No. N-62633, the present title covering the subject property.

2. The Quezon City Registry of Deeds subsequently denied the

registration of the Notice of Adverse Claim on the ground that my
application for registration is based on a pure money claim.

For reference purposes, attached hereto as Annex “B” is a copy of

the Notice of Denial dated 3/11/2013 issued by the Registry of
Deeds of Quezon City.

3. Considering the said Notice of Denial and due to supervening

circumstances which clearly made the registration of the Notice of
Adverse Claim already superfluous and/or unnecessary, I hereby
formally withdraw, for the record, my application for the annotation
of the adverse claim on the subject title.

4. I am executing this affidavit to put on the records of the Registry of

Deeds of Quezon City the withdrawal of my application for
registration of the Notice of Adverse Claim. Further, I am filing this
affidavit to clear/remove from the said records any other notice,
including the above-mentioned Notice of Denial, affecting CCT No.
N-62633 which may have arose as a result of my application for
registration of the adverse claim.
