telegram,telephone, faxorsimilarothermeansincluding special messenger
within4hoursincaseoffatalaccidentsand71hours, incaseof
otheraccidentsinvolvingworkers,to
(i)Boardwith whichtheworkerinvolvedin accidentwasregistered
asabeneficiary;
(ii)ChiefInspectorof Inspectionof Buildingandconstruction;and
(Iii)Thenextkinorotherrelativeofbuildingworkerinvolvedin accident.

cranesusedinconstructionwork;fallingof objectsfrom height;
(b)collapseorsubsidence ofsoil,anywall,floor,gallery,roofor
anyotherpartofanystructure,platform,staging,scaffoldingor
anymeansofaccessincludingformwork;
(c)contractwork,excavation,collapseoftransmission;
(d)explosion ofreceiver orvesselusedforstorage, atapressure
greaterthanatmospheric pressure,ofanygasorgasesorany
liquidorsolidusedasbuildingmaterial;
(e) fire and explosion causing damage to any place on
constructionsite whereworkersareemployed;
(f)spillageorleakageofhazardous substances anddamageto
theircontainer;
(g)collapse,capsizing,topplingorcollisionoftransportequipment;
(h)Leakage orreleaseofharmful toxicgasesattheconstruction site.
(6)Incaseoffailureofaliftingappliance, loosegear,hoiston
constructionworkmachinery andtransportequipmentata construction
siteshallasfaraspracticable,bekeptundisturbed
untilinspectedbytheInspectorhavingjurisdiction.
(7)Every noticegivenundersub-rule(1),sub-rule(2)orsub-rule (4)orsub-

rule(5)shallbefollowedbyawritten reporttotheChief
Inspector,authorityundersection 39oftheAct,theBoardandthe

EnquiringOfficer,asthecasemaybe, whomaybe interestedin or
beconcerned withthecauseofanaccidentormay have knowledge
aboutsuchcauseorislikelytogivematerialevidence
orproducearelevantdocument inconnectionwithsuchaccident
ordangerousoccurrence.
(3)Incase theentitledpersonreferredtoinsub-Rule(2)isabody corporate, a

company or any other organization, association, groupof
personssuchgroupmayberepresentedthroughan
authorizedrepresentativeincludingaCounselor aSolicitor.
(4)Subjecttotheprovisionsofsub-Rule(5)theenquiry shallbe heldinpublic.
(5)Incase where-
(a)theStateGovernment isoftheopinionthatthematterofthe
enquiryoranypartofitareof suchnaturethatitwouldbeagainst
theinterestsofnationalsecurity toholdtheenquiryinpublicand
directsthesaidauthority ortheEnquiry Officer,asthecase may
be,toholdtheenquiryincamera;or
(b)onanapplication madebyanyparty totheenquiry,the
authorityortheEnquiryOfficer,asthecasemaybe,referredtoin sub-
rule(1),ifitorheisoftheopinionthattheholdingofpublic

(6) Informationdisclosed byany person during the course of

hearingorevidenceinthecasescovered undersub-Rule(5)shall
notbedisclosedtoanypersonexceptforthepurposeof the Enquiry.
(7)Thepersonentitledtoappearundersub-Rule (2),calledfor evidenceor

representinginanenquiryshallbeentitledtomakean
openingstatement,giveevidence,requesttheEnquiry Officerto
callforspecifieddocumentorevidence,cross-examine other
personortotheextentandatthestagepermitted bytheauthority
orEnquiryOfficerholdingtheenquiry.
(8)Anyevidenceinanenquirymaybeadmittedatthediscretion
oftheauthorityorEnquiryOfficerduringtheenquiry,whomay
alsodirectthatdocumentstobetenderedinevidence maybe inspected
byanypersonentitledorpermitted toappearatsuch
enquiryandthatfacilitiesbeafforded tosuchpersontotakeor
obtaincopiesthereof.
(9)TheauthorityortheEnquiry Officerholdinganenquiry may authorizeany
person,beinganofficer oftheGovernmenttoassist suchauthority
orenquiryofficerwherenecessary,forthepurpose
ofconductingtheenquiry,andtheofficersoauthorized mayenter the
premisesof the concerned establishment during working
hours,inspecttherecordsrelevanttosuchenquiry,investigate
andtakesuchevidenceasmayberequiredto conductsuch enquiry.
(10)Thefindingsoftheenquiryalongwithallevidence,inoriginal, including
statementofwitnessshallbeforwarded totheauthority specifiedunder
Section39 of the Act within five days of the
completionoftheenquiryincaseswheresub-enquiry wasnot

(11)Acopyofthefindingsalongwithabriefstatement offacts relatingto
