CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:

This Contract of Lease, made and entered into this _______ day of ______, 2019
in Taguig City, Metro Manila, Philippines, by and between:

___________, Filipino, of legal age, and a resident


__________________, Taguig City, Metro Manila, referred to and
designated as the LESSOR.

-AND-

(Name of Lessee), Filipino, of legal age, and a resident of (address),


referred to and designated as the "LESSEE".

WITNESSETH THAT:

WHEREAS, the LESSOR is the owner of an apartment unit specifically situated


at _________________________________, hereinafter referred to as the LEASED
PREMISES.

WHEREAS, the LESSEE desires to lease the above mentioned premises and the
LESSOR is willing to lease the same unto the LESSEE subject to the terms and
conditions herein specified;

NOW, THEREFORE, for and in consideration of the foregoing and mutual


covenants herein contained, the LESSOR has let and by these presents does and hereby
let and lease unto the LESSEE the aforesaid apartment unit and the LESSEE hereby
accepts the same by way of lease subject to the following terms and conditions:

1. TERM -The term of this lease shall begin on ______________ up to


__________. Unless earlier terminated as herein provided and may be
renewed subject to the terms and conditions to be negotiated and mutually
agreed upon by the parties not later than sixty (60) days prior to the expiry date
of the lease.

2. RENTAL-The parties herein agree that the monthly rental of the LEASED
PREMISES shall be PESOS: EIGHT THOUSAND PESOS (Php8,000.00)
Philippine Currency, which shall be due and payable every ___ day of the
month, without any need of demand.

3. MANNER OF PAYMENT - The LEESSEE shall pay the LESSOR in the
following manner:

3.1 Upon the signing of this Contract of Lease, the LESSEE shall pay the
LESSOR the Two (2) Months Security Deposit in the amount of SIXTEEN
THOUSAND PESOS (Php16,000.00) Philippine Currency. This deposit
is for the faithful compliance by the LESSEE of the covenants herein
contained and to answer for any unpaid bills for water, gas, electricity,
telephone, internet, television cable dues, and or damages to the premises, if
any. Such amount shall be deducted from this security deposit and the
balance, if any, shall be refunded by the LESSOR to the LESSEE interest free,
upon the settlement of such accounts and which shall not exceed sixty (60)
days after the termination of this CONTRACT OF LEASE and a formal turn-
over of the LEASED PREMISES. The Lessor shall provide receipts of all the
deductions made from the said deposit. It is also further understood that the
deposit shall in no case be applied as rental payment. The LESSEE shall
likewise pay the LESSOR, also upon singing of this Contract of Lease, the
amount EIGHT THOUSAND PESOS (Php8,000.00) Philippine Currency,
as one–month advance rental payment, which can be applied and used by
the LESSEE as rental payment on the last month prior to the expiration or
termination of this Contract.

4. WATER , ELECTRICITY, ETC. -All utility expenses, such as but not limited to,
water, gas, electricity, telephone shall be for the account of the LESSEE.

5. RESIDENTIAL PURPOSES-The LEASED PREMISES shall be used exclusively


for residential or dwelling purposes of the LESSEE and his family, and for no
other purpose without prior written notice to the LESSOR. The LEASED
PREMISES may not be sub-leased without the written consent of the LESSOR.

6. IMPROVEMENTS, ALTERATIONS, ETC.- The LESSEE shall not make any


major structural changes, alterations, or improvements in the LEASED PREMISES
without the consent of the LESSOR. However, any major alterations or
improvements made and introduced by the LESSEE, shall, upon termination of
this LEASE CONTRACT, automatically inure to the benefits of the said premises
and becomes the property of the LESSOR without any obligation on the latter’s
part to pay or refund its value or cost to the LESSEE.

7. SANITATION AND REPAIRS- The LESSEE shall keep the LEASED PREMISES
clean and in good sanitary condition. The LESSEE has inspected the LEASED
PREMISES and has found the same to be in good and tenantable condition.

The LESSEE, at his expense, shall repair, replace or restore major or
minor damages in the LEASED PREMISES as well as the lights and fixture and
appliances, thereon, arising from the fault or negligence of the LESSEE or any
member of his household, live-in guest or visitors and pets.

Minor repairs incurred through ordinary usage amounting to PESOS:


FIVE THOUSAND PESOS (P 5,000.00) Philippine Currency and below shall
be for the account of the LESSEE including but not limited to:

a) Replacement of light bulbs and fuses;


b) Breakage or loss of faucet handles, drawer or cabinet pulls and
catches, keys, locks, toilet mechanisms (seats and water tank
covers), electrical switches or outlets and buzzers, minor faucet
leaks and damaged door knobs.

Major repairs amounting to more than PESOS: FIVE THOUSAND


PESOS (P 5,000.00) Philippine Currency and below shall be for the account
of the LESSOR provided that the same was incurred through ordinary usage and
not arising from the fault or negligence of the LESSEE or any member of his
household, live-in guest or visitors and pets.

8. FIRE HAZARD AND OBNOXIOUS SUBSTANCE- The LESSEE shall not keep,
deposit or store in the LEASED PREMISES any obnoxious, toxic and inflammable
materials and/or substance that might constitute a fire hazard, cooking materials
excepted.

9. TAXES AND INSURANCE - Real Estate Taxes or government assessments shall


be for the account of the LESSOR.

10. THIRD PARTY LIABILITY- The LESSEE, during his occupancy of the LEASED
PREMISES shall hold the LESSOR free and harmless from any damage, liability or
responsibility to any person or property arising out of or as a consequence of the
use of the LEASED PREMISES by the LESSEE, his/her agents, family members,
domestic helps and guests. When such damage or liability is caused by
fortuitous events or acts of God, such as typhoons, the latter shall not be liable
to the LESSOR.

11. KEEPING OF PREMISES -The LESSEE likewise agrees to cooperate with the
LESSOR in keeping the said premises in good tenantable condition.

12. PRE-TERMINATION- The LESSEE is bound by the period stated in this
Contract of Lease; therefore, should the LESSEE terminates the Lease Contract
before its expiration, the advance rental shall be forfeited in favor of the LESSOR
but the security deposit shall be refunded by the LESSOR to the LESSEE.

13. SALE, TRANSFER, MORTGAGE - In the event of sale, transfer, mortgage or


any other encumbrance of the LEASED PREMISES or any existing sale, transfer,
mortgage or encumbrance of the same, the LESSOR shall warrant that the
purchaser/mortgagee or encumbrance shall respect all the terms and conditions
of this Contract of Lease including the provisions for renewal thereof. The
LESSEE shall allow the LESSOR or its authorized representative to show the
LESEAD PREMISES to the prospective buyers at reasonable hours and with prior
notice to the LESSEE.

14. RETURN OF LEASED PREMISES- Upon termination of this Contract of Lease


for any reason whatsoever, the LESSEE shall immediately vacate the LEASED
PREMISES and return possession thereof to the LESSOR without any demand
from the latter, unless this Contract of Lease is extended. Thirty (30) days prior
to the return of the LEASED PREMISES, the LESSOR may affix a “FOR RENT”
sign on the subject premises and may show the premises to prospective tenants
during those thirty (30) days period at reasonable hours and with prior notice.
The LESSEE shall return the LEASED PREMISES to the LESSOR in clean and
orderly condition.

15. VIOLATION - Any violation of the terms provided for in this Contract on
the part of the LESSOR or the LESSEE shall be sufficient ground for the
termination of this Contract of Lease by the aggrieved party.

IN WITNESS WHEREOF, the parties hereto have caused this instrument to be


duly executed on this _______ day of _______, 2019 at Taguig City, Metro Manila,
Philippines.
