TDS on property
• As per Finance Bill of 2013, TDS is applicable on sale
of immoveable property wherein the sale
consideration of the property exceeds or is equal to
Rs 50,00,000 (Rupees Fifty Lakhs).

• Sec 194 IA of the Income Tax Act, 1961 states that


for all transactions with effect from June 1, 2013, Tax
@ 1% should be deducted by the purchaser of the
property at the time of making payment of sale
consideration.
Payment of Tax

Tax so deducted should be deposited to the


Government Account through any of the
authorized bank branches using the e-Tax
payment option available at NSDL
E-payment
• E-Payment facilitates payment of taxes online by
taxpayers.

Pre-requisite

– To have a net-banking account with any of the Authorized


Banks

To do the required TDS payment,


please click on ‘Submit to the Bank’
button

• On clicking on Submit to the Bank, deductor will have to login


to the net-banking site with the user ID/ password provided
by the bank for net-banking purpose.

• On successful login, enter payment details at the bank site.

• On successful payment a challan counterfoil will be displayed


containing CIN, payment details and bank name through
which e-payment has been made. This counterfoil is proof of
payment being made.
Points to remember
• Deduct tax @ 1% from the sale consideration.

• PAN of Seller as well as Purchaser should be mandatorily


furnished in the online Form for furnishing information
regarding the sale transaction.

• Do not commit any error in quoting the PAN or other


details in the online Form as there is no online mechanism
for rectification of errors. For the purpose of rectification
you are required to contact Income Tax Department.

• While completing the Online form, please note the


following points:-
– Fields marked with * are mandatory
– Do not enter double quotes (“ ") in any of the fields.

TDS Procedure - <Project Name>

You would have to log in to website: https://onlineservices.tin.egov-


nsdl.com/etaxnew/tdsnontds.jsp

And click on ‘Form 26 QB’.

1. Select option: Income tax other than companies


2. Select financial year: as per payment made to builder
3. Mention PAN of Transferor/Seller - <PAN no.>
4. Mention PAN of Buyer : Mention your pan number
5. Provide Complete address of Transferor/Seller - <Address>
6. Provide Complete address of Buyer : Mention your Indian address
7. Whether more than one Buyer: Incase more than one applicant select Yes otherwise No
8. Whether more than on transferor/Seller: Select No
9. Provide Complete address of Property transferred - (Your Flat No.), <Address>
10. Mention the date of Agreement/Booking of property - Booking date as per Application
form
11. Mention the Total value of consideration (Property Value) - (Mention agreement value
as per Application form)
12. Mention if the above payment is done in Lump sum or in Installments – Instalments
13. Please select the amount paid/credited (Enter the amount paid to the Transferor/Seller
100% including TDS) – Enter the amount as per demand letter or term sheet
14. Please enter the TDS rate (Tax rate at which the TDS was deducted by the purchaser
at the time of purchase of the property) – 1%
15. Please enter the TDS amount to be paid (amount deducted by the purchaser at the time
of purchase of the property) – 1% of the demanded amount
16. Mode of Payment: 1. In case of online transfer through net banking select 1st option: Pay
immediately 2. In case of over the counter select 2nd option: Pay on subsequent date
17. Payment Date: The day when you have made the payment to builder
18. Date of tax deduction: The day when you are making TDS payment

You are required to take prints of the following:

1. Form 26 QB that you would be filling online (email soft copy on the same day of
payment)
2. TDS Challan as soon as you make the online payment (email soft copy on the same day
of payment)
3. Form 16B should be submitted within a week’s time of paying TDS online (email duly
signed soft copy and courier duly signed hard copy) – for Form 16 B you need to register
yourself on traces website and then you will be able to download form 16 B.
Below given is the procedure to register yourself on traces and download form 16 B:

- On completion of TDS payment and generation of Form 26QB and subsequently the payment
challan, within seven days the details should be reflected on TRACES web site –
https://www.tdscpc.gov.in/app/tapreg1.xhtml.

- As a first time user, you will have to register on this website as a “tax payer”, you will be able
to obtain the Form 16B or 26QB which has been approved and is reflected against your PAN
in your Form 26AS in Part F of the Form 26 AS under ‘Details of Tax Deducted at Source on Sale
of Immoveable Property u/s 194(IA) [For Buyer of Property].

- This will give you details such as the TDS certificate number (generated by TRACES), name of
deductee, PAN of deductee, acknowledgement number, total transaction amount,
transaction date, TDS deposited, date of deposit, status of booking and date of booking.

- Once the payment is reflected in 26AS as above, you will have to go to the TRACES again login
to the website, and click on ‘Downloads’ tab. In the dropdown menu click on ‘requested
downloads’, and kindly print the same.

KINDLY NOTE: It is mandatory that you send us the original hard copy of Form 16B, duly signed by
the applicant and on receipt of the same the amounts will be nullified or refunded accordingly.
