CHAPTER SEVEN (7) LOCAL INSTITUIONAL CAPABILITY

1. ORGANIZATIONAL AND MANAGEMENT The existing general organizational


structure of the Cavite City Government, as shown, gives a specific function of each
office concerned. As Local Chief Executive, the City Mayor exercises general
supervision and control over all programs, projects, services, and activities of the
fourteen line offices/departments under the local executive branch. These are: the
Offices of the City Administrators, City Treasurer, City Assessor, City Budget
Officer, City Accountant, City Planning and Development Coordinator, City
Engineer, City Health Officer, City Civil Registrar, City Legal Officer, City Social
Welfare and Development Officer City General Services Officer, City Veterinarian,
and City Agricultu re Office r. In the same vein the City Mayor exercises supervisory
authority over each of the eighty-four component barangays of the City.

A local special body or the City Development Council/Executive Committee chaired


by the City Mayor initiates the formulation of comprehensive multi-sectoral
development plans among its other functions. Organizationally, functional
relationships exist between the CDC/EC and the Barangay Development
Council/Executive Committee of each of the eighty-four component barangays in
the formulation, implementation, monitoring, and evaluation of local and national
development programs and projects.

In regard to the national goverh ment agencies among others stationed in the city,
viz., Department of the Interior and Local Government, Office of the City Election
Officer Register of Deeds, Public Attorney's Office, Department of Education,
Culture and Sports, Philippine National Police, Bureau of Fire Protection, Bureau of
Jail Management and Penology, Philippine Atmospheric Geophysical and
Astronomical Services Administration's Weather Tracking Station, Bureau of
Telecommunication, and Bureau of Posts, there exists functional coordination
between these and the City Mayor.

Under the local legislative body or Sangguniang Panlungsod being presided by the
City Vice Mayor, there are twelve Sanggunian Members, ten of which are elected,
and two are appointed. The Department/Office of the Secretary to the Sanggunian
provides staff functions to the Sangguniang Panlungsod. functional relationships
between the Sangguniang Panlungsod and the Sangguniang Barangay, as well as
between the Sangguniang Panlungsod and the Sangguniang Kabataan.
Organizationally, there exists policy and functional relationships between the
Sangguniang Panlungsod and the Sangguniang Barangay, as well as between the
Sangguniang Panlungsod and the Sangguniang Kabataan.
2. FUNCTIONS AND ACTIVITIES

2.1 Brief Description of the Local Unit

City Mayor - General supervision and control over all departments and activities of
government. Perform other powers and duties as provided for in the new local
government code and in Commonwealth Act 547 otherwise known as the Charter of the
City of Cavite.

City Vice-Mayor - Functions in the absence of the City Mayor. Other powers and duties
provided in the new local government code and Commonwealth Act 547 of the Charter
of the City of Cavite.

Sangguniang Panlungsod - Secure the general interest and welfare of the citizenry thru
enactment of relevant ordinances and resolutions; institute amendments to existing
ordinances whenever necessary, maintain an up-to-date compilation of all resolutions
and ordinances.

City Administrator- Coordinates work of all Government Offices in the City and analyzes
income and expenditure patterns. Supervises management practices and organizes
operational procedures. Review and recommends development policies and plans.
Seeks involvement of civic and community groups in governmental management

City Planning And Development Office- Assesses the needs and potential of the City
through the conduct of surveys of the physical characteristics, socio-economic condition
and resources of the city, compile and synthesize data or result obtained there from for
the purpose of preparing a comprehensive development plan.

Formulate goals and objectives, policies, strategies and program for city development
based on the above.

Provide staff support and assistance to the City development Council (CDC) in carrying
out their functions and maintain an up-to-date DATA BANK, of all monitored information,
past and present, concerning urban city development for future use.

Human Resource Management Office- Develops, installs, manages, and supervises an


effective and efficient system of human resources (including permanent, temporary,
casual personnel and external consultants) recruitment, selection,

placement (including appointments), performance evaluation, continuing professional


and values development (capacity enhancement), awards, benefits (including leaves,
retirement privileges) and other performance-based incentives.
Develops and maintains an efficient human resource management information system.
Develop, updates and issues human resource code of behavior and conduct.

Exercises such other powers and performs such other duties and functions as may
prescribe by law or ordinance.

City Budget Office- Advise the City Mayor on the orders and circulars to be issued on
all budgetary and appropriate matters. Consult and coordinate with the Office of the
Treasurer on the projection of the estimated income of the city of the ensuing calendar
year. Review and consolidate the budget proposals of the different offices of the city
govern ment and of the barangay under the jurisdiction of the city. Assist the City Mayor
in the preparation of the annual executive and special budgets. Evaluate allotment
requests and submit recommendation to the City Mayor. Study and evaluate budgetary
implications of proposed legislation and submit comments and recommendation
thereon. Submit quarterly reports to the Office of Budget and Management. Exercise
such other powers and performs such other duties and functions as may be prescribed
by law or ordinances

General Services Office-Take custody of and be accountable for all properties real or
personal, owned by the local government unit and those granted to it in the form of
donation, preparation, assistance and counterpart of joint projects. To recommend to
the City Mayor the reasonable rental rates for local government properties whether real
or personal which will be leased to public or private entities by the local government. To
maintain and supervise janitorial, security, landscaping and other related services in all
local government public buildings and other real property, whether owned or leased by
the local government unit. To collate and disseminate information regarding prices,
shipping and other costs of supplies and other items commonly used by the local
government units. Perform archival and record management with respect to records of
offices of all departments in the local government unit.

City Accountant's Office Install and maintain an internal audit system in the local
government unit concerned; Prepare and submit financial statements to the governor
and mayor, as the case may be, and to the Sanggunian concerned; Certify to the
availability of budgetary allotment to which expenditure and obligations may be properly
charged Review supporting documents before preparation of voucher to determine
completeness of requirements, prepare statements of cash advances, liquidation,
salaries, allowances reimbursements and remittance pertaining to the local government
unit; prepare statement of journal vouchers and liquidation of the same and other
adjustment related thereto; Post individual ledgers for officers and employees of the
local government unit pertaining to payrolls and deductions; Record and post in index
cards details of purchased furniture, fixtures and equipment including disposal thereof, if
any; Account for all issued request for obligation and maintain and keep all records and
reports related thereto; prepare journal and analysis of obligations and maintain and
keep all related thereto; exercise such other powers and perform such other duties and
functions as may be provided by law or ordinances.

Legal Office-Formulate legal measures for the consideration of the Sanggunian.


Provide legal assistance and support to the City Mayor in carrying out the delivery of
basic services, provisions of adequate facilities to the constituents. Investigate or cause
to be investigated any local officials or employees for administrative neglect or
misconduct in office and recommend appropriate action to the City Mayor or
Sanggunian. Investigate or cause to be investigated any person, firm or corporation
holding any franchise or existing any public privilege and recommending appropriate
action to the City Mayor or Sanggunian. Recommend measures to the Sanggunian and
advised the city on all other matters related to upholding the rule of law. Be in the front
line of protecting human rights violation.

City Treasurer's Office- Exercise supervision and control over all City Treasury
personnel, inspection, supervision and ad ministration of the City Market and
Slaughterhouse. Provides regular disbursement service; collect taxes, fees, receipts
and other revenues; Issues certificate of availa bility of funds for appropriation; submit
official reports required by existing regulations to other govern ment agencies and/or
institutions, remit national collections and other government financial institutions,
prepare and assist local officials in providing technical services in preparation Annual
Budget; handle the work assigned by the Commission on Elections and perform other
duties assigned by the Ministry of Finance and other component authorities.

City Assessor's Office Established a systematic method of assessment, tax mapping,


install and maintain real property identification and accounting system prescribed by the
Ministry of Finance. Perform such other acts as may be required by the City Assessor
under his code or other related laws.

Local Civil Registry - Maintenance of the Civil Registry records and correspondences.
Registration of Births, Deaths, Marriages and other registration documents with
prescribed fees. Submission of reports and collections. Attend court trials involving civil
registry documents. Administrative oaths free of charge for civil registration purposes.

City Health Office - General Supervision and monitoring of the health and welfare of the
city residents. Monitor the sanitary conditions of the city.Execute and enforce all laws,
ordinance and regulations relating to public health. Recommend to the Sangguniang
Panglunsod the passage of such ordinances for the preservation of public health.
City Veterinarian Office-The City Veterinary Office main objective is to improve the
welfare of the community by improving their co-existence with animals. Control and
eradicate zoonotic diseases such as rabies, foot and mouth disease, mad cow disease
etc.; Improved livestock production by providing technical assistance; Improve health of
the community by proper regulation of livestock and their byproducts (meat inspections);
Implements rules and regulations regarding stray animals; Educate the people about
the beauty of natu re thru wildlife exhibits; Information dissemination thru filed visits, zoo
to your programs, lectures and seminars about animal health diseases control and
eradication.City Social Welfare and Development Office- Formulate measures to ensure
delivery of basic services and provisions of adequate facilities relative to social welfare
and development services. Identify basic needs of the needy, the disadvantaged and
the impoverished and develop appropriate measures to alleviate their problems and
improve their living conditions. Provide relief and appropriate intervention for victims of
abuse and exploitation and recommend appropriate measures for deterrent purposes.
Facilitate the implementation of welfare programs for the disabled elderly, victims of
drug addiction, the prevention of juvenile delinquency and other effects of poverty.
Initiate and support youth welfare programs that will enhance the role of the youth in
nation building. Coordinate with local and national government agencies as well as
NGO's in the promotion and protection of all needy, disadvantaged and underprivileged
groups or individuals particularly those identified to be vulnerable and high risk to
exploitation, abuse and neglect. Provide front line support for service delivery in
providing relief particularly to victims of calamities either manmade or natural disasters.
Assist the City Mayor in the implementation of city and barangay wide programs for the
total development and protection of children.

City Engineer Office -Provide technical and engineering services to local officials
preparation of development projects, feasibility studies, authorization, implementation
and accountability; review and provide technical advice on proposed in infrastructure
and public works projects of various departments of the city and non- government
entities; provide a strict maintenance program determining priorities through survey
responses availability; recommend the City Mayor and department heads concerned on
needs of resources implementation of priority projects whether emergency, regular or
seasonal. Maintenance and supervision of motor pool for efficient safekeeping of
various equipment necessary in the implementation of the National Building Code,
created under PD 1096, maintain and develop the existing city park and monuments to
attain cleanliness and s and scenes beauty.

Agricultural Office - Formulate development plans on Agriculture and Fisheries to


increase production, raise income of clientele and uplift the well-being of the community
training/meetings and conferences on improved fishery practices, nutrition, home
management, and conservation of resources and enforcement of regulatory laws, rules
and regulations fishermen in decision-making, planning, implementation and monitoring
of programs and projects. Identifies and assists in the development of agri-business
projects and recommends strategies for clientele to secure loans and prepare schedule
of payments. information through field visits, demonstrations, Disseminate Promote
clientele organization and the participation of small Conducts research and
development studies on alternative sources of livelihood.

2.2 Personnel/Staff

3. NATIONAL GOVERNMENT OFFICES

3.1 Department of Interior and Local Government (DILG) - Assist the President in the
exercise of his power in the general supervision of local govern ment; Administer
Department programs and projects including the following:

a.) Undertake research development studies for policy making and legislation relative to
local governance and public order and safety.

b.) Formulate and implementa comprehensive human resource capability program for
Department personnel and clientele.

c.) Provide a comprehensive project assistance program to enhance local government


deve lopment.

Promote peace and order and ensure public safety; Monitor and evaluate the
implementation of the Local Government Code of 1991; Promote the participation of
citizens, NGOS, Pos and private sector in local governance including maintenance of
public order and safety; Initiate and maintain a system of consultation and coordination
among national government agencies in providing services and resources to local
government units; Provides technical assistance, consultancy and brokering services to
LGUS, local institutions and local government leagues; Perform other functions as may
be directed by competent authority or by law.
3.2 Office of the City Election Officer- (COMELEC) General Functions: .

1. Supervise the electoral process within his area of assignment.


2. Coordinate with local officials, including barangay officials as to election problems.
3. Supervise the appointed members of the Board of Election Inspectors in the
performance of their electoral function during Election Day.
4. Responsible for the covering of the Board of Canvassers during the canvassing of
election returns.
5. Maintain and safe keep the book of voters and other election records.
6. Maintain clean election records of the municipality/city.
7. Under continuing registration of voters, supervise the registration of new qualified
voters.
8. Responsible for the safekeeping of office equipment, materials and other records.

3.3 Land Registration Authority


1. Receives document presented for registration.
2. Enters document in primary entry book & indicates entry No. date, hour and minute,
etc on document.
3. Assigns document to land registration examiner on routing slip.
4. Receives document by affixing signature on logbook maintained by recording clerk.
5. Computes/itemizes registration fees/indicates same on routing slip.
6. Checks/recomputed registration fees.
7. Issues receipt of payment.
8. Receives document with official receipt.
9. Examines document in detail according to existing circular requirements and sees to
it that document is registrable.
10. Annotates on back of document that same is registrable, initials same, and
recommends approval thereof.
11. Reviews document examined.
12. Approve the registrability of document on routing slip and assigns document to
typist.
13. Issues blank judicial form upon request of typist.
14. Assigns title no. reflects same on enumeration sheet (judicial form no. 145).
15. Types new certificate of title (original & duplicate), and carry over uncancelled
encumbrances.
16. Proofreads title.
17. Initials typed certificate of title.

18. Prepares index card by registered owner including title no. & lot number.
19. Counter checks/reviews new certificate of title.
20. Initials cert ificate of title.
21. Signs certificate of title and corresponding document.
22. Records in logbook certificate of title to be released (optional)
23. Receives document & certificate of title/signs RD/DRD logbook.
24. Releases certificate of title to presentor.
25. Arranges document with cancelled title in envelope by title no. and entry no.
26. Files original certificate of title in corresponding registration book.
27. Keeps and secures document & certificate of title in registry vault.

3.4 Public Attorney's Office (PAO)

The Public Attorney's Office (PAO) is an agency under the Department of Justice (DOJ)
whose primary responsibility is to provide free legal assistance to indigents or poor
needing legal assistance.
The following are the free services that can be availed of from the Public Attorney's
Office (PAO): Legal Advise; Legal documents (except for commercial transactions);
Represent in civil cases, criminal, administrative and labor. Administer oath, and
legalize documents and papers required in court for people with misunderstanding. The
Free Service is limited to citizen who are poor and unemployed; citizens whose family
income (joint income of the litigant and wife/husband is not above the poverty line

P14,000 or lower for residents of Metro Manila;


P13,000 or lower for residents of other cities; and
P12,000 or lower for residents in towns and municipalities.
3.5 City Auditor's Office- Audits all accounts of the government in accordance with laws
and regulations and settles accounts, claims, and other payments in the Central Office
of the Government.

3.6 City Court Branch I and II - Court trial of civil and criminal cases coming from under
its competent jurisdiction and dispose justice in accordance thereto, issue appointment
of personnel with services paid out for national fund and exercises administrative
supervision and control over the entire court personnel.

3.7 City Prosecutor's Office - Investigate all charges or crimes, misdemeanors, violation
of laws, Presidential Decrees, City Ordinances, prepare the necessary complaint and
prosecute all persons against whom prima facie evidence of guilt exists. Investigate the
cause sudden deaths, which have not been satisfactorily explained and when there is
suspicion of foul play; Issue clearance to city residents after the payment of the required
fee. Submit monthly reports to the Department of Justice and Office of the Regional
State Prosecutor; Represent the Office of the Solicitor General, upon request in special
proceedings and land registration cases filed with the Regional Trial Courts of Cavite
City.
