not in accordance with the Contract:

Notice of Rejection of Plant / Materials / Workmanship


When to use

If the Engineer upon inspection, measurement or testing finds any plant, materials or
workmanship that are defective or do not comply, with the contract, he can reject them. A
notice must be issued to the Contractor stating the reasons for the rejection.

The Engineer can require the retesting of the plant, materials or workmanship under the same
terms and conditions as when they were first tested.

Failure of the Contractor to comply with the notice issued by the Engineer to make good the
defective or non-compliant plant, materials or workmanship within 28 days from the receipt of
such notice entitles the Employer to terminate the contract under sub-clause 15.2(c)(ii) upon
14 days’ notice to the Contractor.

How to Complete

Insert the name of the Contractor and description of the Works which should match the
entries in the Contract Agreement (and also the Appendix to Tender, in the case of the name
of the Contractor), Notice number and issue date.

Delete the alternative in the Notice title, depending on whether the notice relates to rejection
of plant, materials or workmanship or a permutation of all.

Describe the items found to be defective and are rejected and state the defects or reasons for
rejection.

Make the appropriate deletion if the plant, materials or workmanship are not to be retested.

The name of the Engineer should match the person named in the Appendix to Tender (or
such other person whom the Employer may appoint from time to time and has notified to the
Contractor) and the signature should be that of, or on behalf of, such named Engineer.

Who to Issue

Issue the original to the Contractor and copies to the Employer and any other relevant parties.
