AFFIDAVIT-COMPLAINT

I, BEA ALONZO, of legal age, Filipino, single, and with address at

Lot 3, Block 4 Cordova Street, Las Terrazas, Ma-a, Davao City,
Philippines, upon my oath depose and state, THAT:

1. I am executing this affidavit-complaint to institute formal

charges for:

a. GRAVE THREATS penalized under Article 282 of the

Revised Penal Code (RPC);

b. GRAVE COERCION penalized under Article 286 of the

RPC; and

c. GRAVE ORAL DEFAMATION/ SLANDER penalized

under Article 358 of the RPC

against JULIA BARRETTO, of legal age, Filipino, single and with

address at Lot 1, Block 2 Insular Village Phase II, Lanang, Davao City,
Philippines for the criminal acts she committed against me as would be
narrated hereunder;

2. At around 12:45 o’clock or so in the morning of July 1, 2019,

I arrived at Fort and Tay wine bar situated at the Lanang, Davao City to
attend a private party hosted by Gretchen Barretto and Claudine Barretto.
I was accompanied by Gerald Anderson, and primarily invited by Dennis
Barretto, with whom I have a dating relationship since February 14, 2018.
Dennis Barretto is the brother of the above-named respondent;

3. Upon arriving there with Gerald Anderson and after having

been welcomed by Dennis Barretto, I sat on one of the long tables and
mingled with the people seated there. I know some of these people by
name and/or faces but they are not really my close friends;

4. A few minutes after we were settled on our seats, JULIA

BARRETTO came to me and with a loud voice uttered: "HEY BEA! IS

THIS YOU? THIS IS YOU RIGHT? IKAW ‘TO, DIBA?" (could be
interpreted as: “Hey Bea, is this you? This is you, right? It is you, right?”)
while at the same time showing me a photograph on her mobile phone.
She was trying to zoom in the photograph she was showing while
repeatedly shouting the same question whether it was me on the
photograph;

5. After I clearly saw that it was an old photograph of me many

years ago, I simply responded “Yes”;

6. JULIA BARRETTO then turned to everyone present and

shouted: “"SEE? RETOKADA!" (could be interpreted as: “See? She had
plastic surgery!”);

7. JULIA BARRETTO continued humiliating and embarrassing

me in front of the people present in that private event by showing that old
photograph of me on her mobile phone while pointing at me repeatedly
saying that I have had my face made over and that I had plastic surgery.
She was going around the event venue doing that;

8. I noticed that there were people present to whom JULIA

BARRETTO had shown my old photograph in shock or surprised either
because of what she was doing, or they did not know how to react to what
was happening;

9. While trying to endure the humiliating and embarrassing

moment, I sent a text message to her brother, Dennis Barretto, telling him
what his sister was doing to humiliate and embarrass me. Dennis
Barretto was outside in the smoking area when it happened;

10. After a moment, I saw Dennis Barretto confronting his sister

JULIA BARRETTO. While I could not hear what they were talking about,
I presumed he was telling his sister to stop humiliating and embarrassing
me in front of all the people attending the party. Thereafter, Dennis
Barretto got out of the event venue and went down to calm himself;

11. I thought everything would be fine thereafter. However, I was

totally wrong. After a few minutes, JULIA BARRETTO came to me again
and calling me repeatedly by name in a very loud tone. When I looked
at her, she shouted at me saying: “YOU FUCKING BITCH!" "YOU
CUNT!" "DONT EVER COME TO OUR HOUSE AGAIN OR I WILL KILL
YOU! WE DONT LIKE YOU, YOU SLUT!" "YOU BITCH, I WILL LOOK
FOR YOUR PARENTS AND FAMILY, I WILL HAVE THEM KILLED, YOU
FUCKING BITCH!" (or words to that effect);

 12. She repeatedly shouted those words to me for everyone in
that event to hear. She was not only continuing to humiliate and
embarrass me in front of all the people present, she was also trying to
harass me;

13. At one point, when I tried to respond, she stopped me from

saying something by shouting at me in an angry tone saying: “SHUT THE
FUCK UP BITCH! IF YOU TALK, I WILL STAB YOU WITH THIS TABLE
KNIFE!" (or words to that effect) while she was pointing a table knife
towards my face. She said all these things while pointing the table knife
to my face repeatedly;

14. At this point, her sister, Marjorie Barretto, who was with JULIA
BARRETTO that time, tagged her to bring her out of the event venue;

15. As JULIA BARRETTO was being ushered out of the event

venue, she was still pointing her finger at me and angrily said: "YOU
SLUT! YOU CUNT! I’M GONNA FIND YOUR PARENTS TONIGHT,
BITCH!" (or words to that effect). JULIA BARRETTO uttered the latter
with a very aggressive tone, insinuating that she will do harm to my
parents;

16. Until that incident, I never had any previous run in or

untoward incident with JULIA BARRETTO for the few times we have
personally met. I could not think of any reason why she had done those
unlawful acts to me. Perhaps, my only mistake is that I was in a dating
relationship with her brother;

17. My counsel explained to me that JULIA BARRETTO’s act of

threatening me of having myself and my parents killed, delivered with a
very angry tone, and at some points made with a table knife pointing at
my face, constitute GRAVE THREATS as she was essentially
threatening me that she will inflict harm upon my parents, which harm in
fact amounts to a crime. Such is also the understanding of Gerald
Anderson, as will be shown in his Affidavit, as he in fact feared for the
safety of my parents;

18. Further, the statements of JULIA BARRETTO basically telling

me not to talk, or go to their house again, coupled with the above-stated
intimidation that she “will kill” me if I do so, or she’s going to “find my
parents and have them killed”, and she having said the same repeatedly
and angrily, constitute GRAVE COERCION. JULIA BARRETTO

practically prevented me from doing something not prohibited by law, and
the prevention is effected by threats and/or intimidation;

19. To be candid, she has no lawful right to prevent me from

answering her, and in visiting their house as it is not hers alone. It is a
family home where I occasionally visit as I get invited in view of my dating
relationship with her brother Dennis. The threat and intimidation is
likewise clear as she has repeatedly said that she will look for my parents,
and knowing JULIA BARRETTO and their family’s influence, I can only
surmise what she can do or say to my parents;

20. Lastly, the words “retokada”, “cunt”, “bitch”, “fucking bitch”,

“slut”, uttered by JULIA BARRETTO publicly and repeatedly, certainly
cause or tend to cause dishonor, discredit or contempt of the person
defamed which has been clearly identified by JULIA BARRETTO as me,
having pointed her finger at me the entire time that she was shaming me.
The defamation is grave as those words are of a serious and insulting
nature, and the manner in which the same were uttered – degradingly, in
a private party attended by Davao City’s personalities of my generation
– clearly show malice and ill-will on the part of JULIA BARRETTO. These
clearly constitute GRAVE ORAL DEFAMATION/ SLANDER;

21. The actuations of JULIA BARRETTO towards me at that time

did not only create a commotion, but importantly, her malicious actions
caused me trauma, serious anxiety, sleepless nights, extreme
humiliation, embarrassment, and besmirched reputation. I am seriously
aggrieved and distressed with what JULIA BARRETTO did to me, and
she should be accountable to her actions this time so she will not do that
again to others. Her family’s wealth and influence is never a justification
for JULIA BARRETTO to unduly step on somebody’s rights at any time
at her own whim and liking;

22. To show a witness’ account of the incident, I am attaching

hereof as Annex “A” the affidavit of GERALD ANDERSON;

23. The foregoing sworn statement also corroborates the threats

and intimidation committed by JULIA BARRETTO, as well as the intense
humiliation and embarrassment caused upon me;

24. I have reported the said incident and caused it to be recorded

with Police Station 4, Davao City Police Office, Philippine National Police
at Sasa, Davao City. Attached as Annex “B” hereof is a copy of the
Incident Record; and

 25. I am executing this affidavit to attest to the truth of the
foregoing facts in order to file criminal charges against JULIA
BARRETTO with address at Lot 1, Block 2 Insular Village Phase II,
Lanang, Davao City, Philippines for a). GRAVE THREATS penalized
under Article 282 of the RPC; b). GRAVE COERCION penalized under
Article 286 of the RPC; and c). GRAVE ORAL DEFAMATION/
SLANDER penalized under Article 358 of the RPC, and for whatever
legal purpose this may serve.
