Facts: Bartolome Paja woke up to Augusto and Fausta
Gonzales surrendering themselves after killing Lloyd
Penacerrada at their residence. After 8 months, Huntoria
volunteered to testify against Gonzales. She claimed seeing 6
family members of Gonzales stabbing Penacerrada near a
linasan, however, she was not able to see who did exactly the
stabbing as they were all simultaneously stabbing. She assured
that she saw all six of them because of the moon light.
Augusto filed for parole and Fausta invoked defense of honor.
Custodio being one of the six was convicted.
Issue: w/n custodio should be criminally liable.
Held: No, one of the elements of felony in genral is: there
must be an act or omission. Act must be understood as any
bodily movement tending to produce some effect in the
external world -- it must have been shown that the act
produced his death. Huntoria does not know what specific act
was performed by the appellant.

People vs Guillen
Gr no. l-1477 january 18 1950
Per curiam:
Facts: The candidate Guillen voted for was defeated by Roxas,
to whom he was holding a grudge. He planned on
assassinating the President using two grenades, in Plaza
Miranda after Roxas delivers his speech. Upon hurdling the
grenade, a General Castaneda saw the smoking grenade and
kicked it away from Roxas, causing its explosion in the middle
of group of persons standing near the stage. The counsel for
the accused argued that his main intention was to kill the
president and not the persons surrounding the President
Issue: Whether or not he should be guilty of homicide through
reckless imprudence.
Held: No, the court ruled in order to be qualified as
imprudence, it is necessary that neither malice nor intention
to cause injury should intervene. Throwing hand grenade at
the president with the intention of killing him shows that
Guillen acted with malice.

facts: faderick maramba was cleaning and washing his owner gr no
type jeep in front of his house when a motorized tricycle
stopped near him. Rodolfo velasco approached Maramba and
fired at him several times with a .45 caliber pistol. Velasco
missed his first shot but the second one hit Maramba’s upper
arm, causing him to stumble on the ground. He was able to
stand up and run while Velasco continued firing but missed.
Velasco interposes defenses of denial and alibi

held: no, the court held that denial must be buttressed by

strong evidence of non-culpability. Otherwise, it is purely self-
