The Beneficial Exemplifications of some of that which attests to the Hizbiyyah of Ubaid Al-Jaabiree

In the name of Allah, the most Merciful, ever merciful to his believing slaves.

All praise be to Allah, the Lord of the worlds. May peace and blessings be upon the most noble of the
prophets and messengers Muhammad ibn Abdullah, the trustworthy and truthful. And I bear
witness that none has the right to be worshiped except Allah alone with no partners and I bear
witness that Muhammad is His slave and messenger.

To Proceed:
Verily the requests from the brothers in the west and other than them, have greatly increased
regarding the proofs upon which our shaikh Yahya declared Ubaid al-Jaabiree (may Allah guide him)
to be hizbi. So when these requests increased I consulted shaikh Yahya regarding (compiling) this
work, so he directed me to clarify the truth that I believe in this issue. Consequently, I prayed
istikharah and actualized my determination for this treatise, seeking it to be an advice to the ummah
because of what Imam Muslim extracted in his Saheeh on the authority of Tamim Ad-Daari that the
Messenger of Allah (may peace and blessings of Allah be upon him and his family) said, “The
religion is sincerity.” We said, “To whom?” He said, “To Allah, His Book, His Messenger, the leaders
of the Muslims and their common folk”.

Introduction to the fitnah of Ubaid Al Jaabiree


Verily, the tail of this fitnah (i.e. the fitnah of Abdur-Rahman ibn Maree Al-Adanee and his followers)
has grown so much that it has raised many arguments and split the ranks of ahlus-sunnah inside and
outside of Yemen. So when this occurred, the lions of ahlus-sunnah from amongst the scholars and
students of knowledge, stood up to uncover its guises with a sufficient explanation; at the head of
them our honorable Shaikh, the allaamah Yahya ibn Ali Al Hajoori (may Allah protect him and reward
him with good). And from the peculiarities, when our Shaikh exposed the plotting of this lying
plotter and his treachery upon the dawah salafiyyah and dar-ul-hadeeth, Dammaaj with proofs and
evidences, a people stood up to strongly defend Al-Adani with falsehood inside and outside of
Yemen. As for inside, the head of this fitnah Muhammad ibn Abdul-Wahhab Al Wasaabi (may Allah
rectify him) stood up (to defend Abdur-Rahman). As for outside, then Shaikh Ubaid (may Allah
guide him) sufficed Abdur-Rahman Al-Adani. So he (i.e. Abdur-Rahman) elected Ubaid Al Jaabiree
for this important (mission) and thereby he (Ubaid) stood and uplifted the flag of the fitnah by way
of argument and thereby ignited its fire. In reality, Shaikh Ubaid's opposition to the dawah salafiyyah
became worse than Abdur-Rahman and his followers!

Shaikh Yahya was patient upon Shaikh Ubaid Al-Jaabiree for a long time and advised him many a
time but to no avail. Shaikh Ubaid refused except to persist in his opposition, enmity and turning
away from the haqq. So when Shaikh Yahya saw that Ubaid had transgressed the Usool (principles) of
ahlus-sunnah and started causing commotion and sowing disorder (as we shall mention), our Shaikh
Yahya disparaged Ubaid with (the label of) hizbiyyah. And it is a fatwa that is built upon clear proofs
from the Book and the sunnah upon the understanding of the pious predecessors, as we shall
elucidate in this treatise by the will of Allah.

Chapter: Defining 'hizbiyyah' (bigoted partisanship) and


the obligation of exposing its dangers
• Shaikh Muqbil (may Allah have mercy on him) was asked: “O honorable shaikh, some of the
hizbees accuse us saying that we do not know what hizbiyyah is nor what it means. And (they
say) that we consider hizbiyyah to be one who opposes us even in one matter. And they
accuse us of not dealing with the one who has opposed in the best manner. And they are
asking us for a definition of hizbiyyah. So can you please tell us, o noble shaikh, how is one
declared to be hizbi? And what is the definition of hizbiyyah? And what is the criteria for the
blameworthy hizbiyyah? May Allah reward you with good.

The answer: O my brothers, these people want from us to picture the hizbi as being a
MONSTER! Or that we picture the hizbi as being a bull with horns! No, my brothers! The
issue is and issue of ideology. Allegiance and disassociation. Allegiance towards whoever is
with them and disassociation from whoever is not with them. People who don't fear Allah
and they possibly warn from ahlus-sunnah and insult them...”[till end of his speech]

And from what the Shaikh also mentioned: “Hizbiyyah is allegiance and disassociation.
Hizbiyyah is plotting and deceit!”1

• Our Shaikh Yahya Al-Hajoori (may Allah preserve him) was asked: “O Shaikh, may Allah
reward you) some people say: 'I consider to be a proof for Abdur-Rahman's salafiyyah, the
fact that he did not join any of the current hizbi groups'. So is this speech correct? What is
your advice? May Allah grant you success.

The answer: This speech is incorrect. If we looked into the sects of the Shee'ah, how many
sects are they? More than twenty sects. And similarly the sects of the Soofiyyah, the sects of
the Murj'iah, the sects of the Jahmiyyah, the sects of the Mutazilah and sects of the hizbiyyeen.
So the statement that 'a person is not hizbi unless he falls under one of the parties' – this is a
false foundation! How many a person does not want to be under a particular sect, rather he
wants to have a sect for himself and to be a head of misguidance. And from this came the
(various) sects. In the time of Al-Hassan Al-Basri (may Allah have mercy on him), he had
students and pupils amongst them: Wasl Al-Gazaal and others from amongst the people.
Shaytaan deceived them into believing that they had eloquence and that they had... and that
they had... So Wasl ibn 'Athaa ramified and declared (innovated) principles, left Al-Hassan
and became after that from amongst the leaders of misguidance. And similarly 'Amr ibn
Ubaid. And similarly others. So this principle is a false principle 'that a person is not called
hizbi unless he calls to elections; and is not called a hizbi unless he has a secret

organization or has a charity organization' – all of this is not necessary. Hizbiyyah is


restricted allegiance and opposition. And this is aplenty in Abdur-Rahman and this new hizb
that ramified from here (i.e. Dammaaj). So hizbiyyah is applicable to their actions in the most
complete way. And from it: their competing in the acquisition of masaajid. And from it: their
buttering up and keeping quiet against the people of falsehood...” till the end of the Shaikh's
speech.2

• Shaikh Saleh Al-Fawzaan(may Allah protect him) was asked: “Is it obligatory upon the
scholars to explain the dangers of bigoted partisanship? And also the dangers of splitting into
sects and groups?

The Shaikh replied: Yes, it is obligatory to explain the danger of bigoted partisanship, and
the dangers of splitting up into sects and groups so that people can be upon clarity. Because
even the common folk get deceived. How many of the common folk get deceived these days
by some of the groups and sects whom they think to be upon the truth? So it is necessary for
us to explain to the people (the educated and the common folk) the dangers of parties and
sects. Because if they keep quiet, the people will say: “The scholars knew about this and they
kept quiet” - so misguidance enters from this door. So clarification is necessary when these
matters occur; and the danger upon the common folk is more than the danger upon the
educated ones because with the silence of the scholars they (the common folk) will think that
these (i.e. the parties and sects) are correct and they are upon the haqq.3

Chapter: The evidences that prove the hizbiyyah of Ubaid


Al-Jaabiree
Imaam Muslim narrated in his Saheeh on the authority of Ali ibn Abi Taalib that the Prophet (may
peace and blessings of Allah be upon him and his family) said: “Allah's curse be upon the one who
curses his father, Allah's curse be upon the one who sacrifices for other than the sake of Allah,
Allah's curse be upon the one who gives refuge to an innovator, Allah's curse be upon the one
who alters the signs (borders) of the earth.”

Imaam Muqbil Al-Wadiee said4: “These partisanships are built upon lying, treachery, deceit and
changing the reality (of affairs)”

Our Shaikh Yahya (may Allah grant him success) mentioned, “The proofs for the hizbiyyah of Ubaid
Al Jaabiree are in reality the same proofs for the hizbiyyah of Abdur-Rahman. In fact Ubaid is more
severe in his hizbiyyah.”

And we present to you some of the evidences that prove the hizbiyyah of Jaabiree so that you know
that the fatwa of Shaikh Yahya was built upon proofs.

1. Defending the hizbees in the Islamic University of Madeenah

After our Shaikh Yahya warned against Abdur-Rahman and his hizbiyyah, some of the callers to
fitnah from Abdur-Rahman Al-Adani's companions went to Ubaid complaining about the
“oppression of Hajoori” (as they falsely claimed, being liars themselves). Consequently Ubaid, not
knowing how to start his defense of Abdur-Rahman, took the weakest of paths – and this is from not
being granted success – so he entered from a narrow door and tried to delude the people into
believing that Shaikh Yahya declares all those who study in the Islamic University to be hizbi and
warned against studying there without exception. So Ubaid started his lifeless defense of the
University with what is known to be in it from a mixture (of sunnis and hizbis). This is a fact that is
witnessed by ahlus-sunnah who know it well5.

greatly to see a university that was founded upon piety from its first day under the patronage of the two
honorable shaikhs, Muhammad ibn Ibrahim and Abdul-Azeez ibn Baaz (may Allah have mercy on

Ubaid obligated upon our Shaikh matters regarding the Islamic University in his treatise “The correct
criticism regarding what the Clear Notification contained in opposition to the clear answer” and he
said in it:
First: Praise of the Islamic University of Madeenah as being a Salafi University and founded upon the
Sunnah since the time it was established until today.

Second: Your admittance of this mistake (O Yahya) about your description of the Islamic University
of Madeenah being upon hizbiyyah and the tahreem (prohibition) of studying there.

Third: Freeing the Islamic University of Madeenah from hizbiyyah (partisanship), bidah (innovation)
and khuraafah (superstitious beliefs).
End of Quote.

So our Shaikh Yahya refuted him with a comprehensive refutation and brought witnesses proving
the existence of hizbees in the Islamic University. With all of that, Ubaid did not accept a single
statement of Shaikh Yahya, rather he ratified his earlier request as occurred in a telephone
conversation between Ubaid and some hizbees from Shihr in which he said:
“I obligated him with certain matters which he did not adhere to at all! The ruling is for the
intelligent and it is not from me. What I did in the second treatise was to obligate him to some
matters (in 'The correct criticism'). I obligated him to three matters so that the retraction (from Yahyaa
al-Hajoori) would be correct. The man (Yahyaa Hajoori) warned against the Islamic University (of
Madeenah) and some of his followers have taken this from him and they also warn from the Islamic
University (of Madeenah)”

The Rebuttal: After this we say, either Ubaid does not know that the Islamic University has hizbees
in it and this is extremely far fetched. Especially when Ubaid has written an introduction to Shaikh
Abdul-Aziz Ar-Rayyis's refutation on one of the Ashaa'irah who teach in the Islamic University!
However, the affair as our shaikh said “(Ubaid's) reviving of the issue of Al-Jamiyyah Al-Islaamiyyah
now was only a means of viciously defending these hizbiyyeen who revolted against us from the
midst of our markaz, Dar-ul-Hadeeth Dammaaj slowly but steadily over the last three years.”
And what is necessitated by Ubaid's obstinance, is that the hizbees in the Islamic University are not
so and they are (in his view) Ahlus-sunnah – and this matter is far worse because it involves cheating
the people and deceiving those who do not know the university regarding that which is in it! In
reality, his statement is a changing of reality, a lie (and this is from the foundations of hizbiyyah as
Imaam Al-Wadiee mentioned).

them), that its affairs after half a century of its foundation, have come to be blown by the wind.
Hurricanes have stormed it (so to speak) and it has become a place of amusement and wonder for
onlookers, westerners, newsmen and even newswomen who were never found there some years back.” -
So does Ubaid have any refutation of this? On the contrary, this increases certainty that Ubaid's uprising
against our Shaikh was only as a result of following his desires and defending the people of falsehood
with falsehood!

2. Ubaid's defence of the hizbiyyeen and maftooneen (those put to trial) in Yemen and his co-
operation with them against Ahlus-Sunnah

• Ubaid's defense of Abdur-Rahman Al-Adani and his crew:


So when Shaikh Yahya warned Ubaid not to sit with Abdur-Rahman Al-Adani and his companions
from the new hizb, he met it with a violent defense of them in which he said: “I do not sit with evil
people or people of fitna, but I sit with those who I and others have given tazkiyah to from Ahl us-
Sunnah in Madeenah and in other than Madeenah. From these who al-Hajoori described as being
"Maftooneen" (fitna-makers) are: Abdur-Rahman al-Mar'ee (al-Adanee), Abdullaah bin Mar'ee al-
Adanee, Haanee bin Burayk and Arafaat bin Hasan. These brothers are other than what Yahya al-
Hajoree described them as being, we regard them as that. But it is well known that Shaykh Yahyaa,
may Allaah guide him, abuses those who have a different ijtihaad to him and makes evil statements
about them and this is a way which is haraam and opposes the way of hilm (softness), hikmah
(wisdom) and the caller to the truth upon insight.”6

And in Ubaid's response to the questions from the West he said, “That which has been spread about
our brother Shaikh Abdullah ibn Umar Mar'ee and our brother Shaikh Abdur-Rahman ibn Umar
Mar'ee and others from (them being) hizbees – this is from the lies7 of Al-Hajoori and his
followers...”8

The Rebuttal: Perhaps Ubaid has forgotten how to apply the principles of Ahlul-hadeeth like ((The
one who knows the evidence is given precedence over the one who does not)) and ((The criticism of
the people of the land is given precedence over statements of others)) and ((The detailed
disparagement takes precedence over the general praise)). And this would be indeed a strange affair
because Ubaid used to implement these principles with force in the fitnah of Abil-Hassan as our

Shaikh has quoted him doing so.9 ﴾‫{﴿فـمذا بعد الق إل الضلل فأنى تصفون‬So after the truth, what else can
there be, save misguidance? How then are you turned away?} (Yunus:32)
Ubaid did not stop at merely defending them and turning a blind eye to their despicable actions,
rather he joined their ranks against Shaikh Yahya and Dammaaj as occurred when he visited Yemen.
This visit was for the purpose of aiding Abdur-Rahman Al-Adani and his hizb as our shaikh Yahya
said, “In reality, that journey and this one are connected and is not for the purpose of dawah. Rather
it is for the purpose of founding hizbiyyah; not for the sake of dawah nor knowledge, rather verily
for the purpose of establishing hizbiyyah and behind it are worldly desires for the sons of Mar'ee (i.e.
Abdullah and Abdur-Rahman)...”
So Ubaid visited many masaajid of the new hizb in the entourage of his 'special people' and did not
visit neither markaz Dammaaj nor any masjid that agreed with Shaikh Yahya in his declaration of
Abdur-Rahman to be hizbi.
• Ubaid's defense of Muhammad ibn Abdul Wahhab Al-Wasaabi
From Ubaid's severe enmity towards Shaikh Yahya, he started to insult him as occurred in the
telephone conversation with the hizbees in Shihr.
Said Ubaid, “Shaikh Muhammad ibn Abdul-Wahhaab Al-Wasaabi is an intelligent, noble man, a
person of the sunnah, dignified. And the brother Yahya has a sharp and vicious tongue and is one of
vile statements so he does not observe the sanctity of anyone, and even if the person has
accompanied him for ten years he can destroy all of that in an hour! He does not have rifq
(gentleness), even if may have knowledge but he is deprived of hilm (gentleness) and hikma
(wisdom).” End of Quote.

Insights into the praise of Ubaid for Muhammad ibn Abdul Wahhaab Al-Wasaabi:
In contrast to the disparagement, insults and traducement against al-allaamah Shaikh Yahya Al-
Hajoori, Ubaid heaped praise upon the head of this fitnah and disorder, Muhammad ibn Abdul-
Wahhaab Al-Wasaabi (may Allah NOT reward him with good). As preceded, Wasaabi has a long
hand in igniting and lengthening the tail of this fitnah inside of Yemen, rather he is from the biggest
'thrusters' who helped Abdur-Rahman cause fitnah against Dammaaj and Shaikh Yahya. Shaikh
Yahya had explained some of what Wasaabi had in terms of restricted allegiance and opposition, and
his causing disorder between the ahlus-sunnah and their scholars in a treatise entitled “The restricted
allegiance and opposition that Shaikh Muhammad ibn Abdul Wahhaab and the new hizb have”. So

Rebutting the praise of Ubaid for Muhammad ibn Abdul-Wahhab Al Wasaabi:


In the same telephone conversation [that Ubaid insulted Imaam Shubah10 (may Allah have mercy on
him) and our Shaikh Yahya Al-Hajoori (may Allah preserve him)], Ubaid mentioned these words in
praise of Wasaabi: “Shaikh Muhammad ibn Abdul-Wahhaab Al-Wasaabi is an intelligent, noble man,
a person of the sunnah, dignified.”

His statement: “intelligent, noble man”- Does Ubaid consider opposing the dawah salafiyyah in
Dammaaj and spreading enmity towards it, its shaikh and its students to be from intelligence? And is
aiding the hizbees and endeavoring to sow discord between scholars and callers of ahlus-sunnah
considered to be from intelligence and nobility? And is insulting and lying upon our Shaikh Yahya
from nobility and intelligence? And is it from nobility to brush aside the clear and abundant
goodness that is there in dar-ul-hadeeth which Wasaabi himself used to acknowledge to Shaikh
Yahya? And is it from nobility to endeavor to establish fitnah there? Listen to these matters in two
tapes entitled “Rebutting the untruths in the statement of Shaikh Muhammad ibn Abdul-Wahhaab”
by our Shaikh Yahya ibn Ali Al-Hajoori for a clarification of all the aforementioned points with proofs
and evidences.

His statement: “a person of the sunnah, dignified” - Is it from the sunnah with Ubaid to revive the
principles of the innovators like Aroor, Maghraawi and Abul-Hassan Al-Ma'ribi? Have a look at the
mendacious principles of Wasaabi in an treatise written by our brother Yasir Shareef Al-Hudaidi
entitled “Wasaabi's revival of the principles and foundations of Al-Masri, Al-Maghraawi and
Aroor”. And from these principles:
1. The first principle: Indirectly insulting some of the companions of the Prophet (may the peace
and blessings of Allah be upon him) that they are horn blowers [a term in arabic meaning that
they don't know what is coming out of their mouths] and that they immerse themselves in
false speech and narrate it without verifying it first, and because of this we require proper
upbringing and teaching11.

Allah scolded them (the Sahaaba) when that wicked, hypocrite made that statement. It was upon you (i.e.
the Sahaaba) not to spread it. It was not for you to be horn-blowers, repeating his (the hypocrite's) statement
amongst that pure, clear, pristine Muslim community.” End of Quote.
He also mentions on the same tape in which he is explaining the hadeeth in which Umar and his

2. The sixth principle: The destroying of the “principle of appraising and criticism” from many
angles12.

Ansaari companion used to take turns and in which occurred the rumor of the Prophet's (may peace and
blessings of Allah be upon him and his family) divorcing his wives. Said Wasaabi: “The Ansaari came after Isha
to Umar and said to him : Do you know what happened today? Umar said, “No.” The Ansaari said, “The
Prophet (may peace and blessings of Allah be upon him and his family) has divorced his wives. He is
distressed because of that. All of them and amongst them is Hafsa bint Umar (may Allah be pleased with all of
them).
So Umar went to verify this speech and started firstly with his daughter Hafsa (may Allah be pleased
with all her); he entered upon her and found her crying. So he said to her, “Did the Prophet (may peace and
blessings of Allah be upon him and his family) divorce all of you? She replied, “I do not know.”
So they (the Sahaaba) thought that the Messenger (may peace and blessings of Allah be upon him and
his family) divorced his wives and went about transmitting this speech. Subhan Allah! How much are we in
need of proper upbringing and teaching!!! … “ End of Quote.
And he said in the same tape: “So when he did not reply to him he entered the masjid and found
people immersing themselves in speech amongst themselves...” End of Quote.

The Rebuttal: Yasir Al-Hudaidi said, “May Allah guide you (O Wasaabi), from where did you gather that they
were immersing themselves in speech? All the narrations mention: They were crying around the podium
(mimbar) and there is not a single narration in the two Saheehs (Bukhari and Muslim) mentioning that which
you said. Don't you know that 'immersing in speech' is: what is there from lies and falsehood as is mentioned in
“Lisaan Al-Arab” (The tongue of the Arabs). And also from where did you get that they were transmitting this
speech? And on top of that you built this speech of yours that implicates an insult to the Sahaaba “How much
are we in need of proper upbringing and teaching”!!!

ijtihaad, so if the mashaikh differ upon a particular person or in some matter, You O student of knowledge
follow that which you see to be correct. Every shaikh has his excuse in matters of ijtihaad. Do you want to
become biased towards an individual and enforce your ruling upon the da'wah or upon the mashaikh? Each
one knows his own limits.” End of Quote.

The Rebuttal: It was asked to Shaikh Rabee (may Allah protect him): What is your statement regarding the one
who says: 'The speech of the scholar who criticizes is not accepted except with proof. And accepting his

3. The tenth principle: Wasaabi traverses upon the methodology of Abil Hassan, Adnan 'Aroor
and other than them from amongst the people of falsehood in returning the truth under the
guise “that they take from the origin of verification.” Said Wasaabi, “Allah orders you not to
accept any speech that you have not heard yourself from the one who has said it, instead it
was transmitted to you. He has not permitted you to transmit any action that you have not
witnessed yourself from the doer, instead it was transmitted to you.”13
4. The Eighteenth Principle: Whomever his original state is the sunnah and he fell into some of
the matters of Ahlul-Bidah (the people of innovation) and refuses to return to the truth after
being advised and reprimanded, then he remains upon his original state of the sunnah and he
is from the Awliyaa of Allah, the pious. And he is not removed from this state unless his
original state is innovation.14

So he answered: By Allah, the scholars of criticism and appraising, the scholars of the Islamic religion have
detail in this matter. From them, Al-Hafidh ibn Katheer in 'Al-Baith Al-Hatheeth' or in 'Mukhtasar
muqaddimah ibn Salaah'. If a dependable scholar who knows the reasons for criticizing and appraising and
the differences that occur in these matters, and he is not opposed by anyone in this criticism, then his
criticism is accepted – may Allah bless you – however, if he is opposed by another dependable scholar
similar to him (in rank) with a praise, in this case the criticizer is asked to bring his proofs. And the proofs
are given precedence as long they are established and with reasons. So if the evidences are submitted,
even if a HUNDRED from amongst the SENIORMOST and MOST KNOWLEDGEABLE scholars were to
oppose him, no weight is given to their opposition! Because they are opposing proofs and evidences
without (presenting) any proofs or evidences. And Allah says, {Bring forth your proofs if you are indeed
truthful}. So the proofs silence thousands of those whose hands are empty of proofs even if they were from
amongst the scholars of these principles. This is obligatory for you to know and it is necessary to return to
the books of the hadeeth sciences, especially the comprehensive ones like 'Tadreeb Ar-raawi', 'Fath Al-
Mugeeth' of Sakhaawi and 'Sharh Al-Alfiyah' of Al-Iraaqi. These are affairs well known amongst the people
of knowledge. Arguing and speaking about it with falsehood is not permissible because we spoil the Islamic
sciences, destroy the principles and... so on and so forth with these mannerisms. So it is not permissible for a
Muslim to present to the people except the the truth! And (he must) stay away from deception and trickery
-may Allah bless you –

Wasaabi also was asked (in the tape: General Fataawa): What is the criteria for boycotting the innovator and
when should he be boycotted?
He answered: If the individual's methodology is innovation, then he is boycotted; if his methodology is

5. The Twentieth principle: His making tawheed al-haakimiyyah the fourth category of tawheed.15
6. The Twenty third and Twenty fourth principle: Causing commotion, sowing discord, lying
and having restricted allegiance and opposition.16

So is the speech of Ubaid after what you have seen of this man truthful speech or is it “the bruised
defending the bruised”? And as the Prophet (may the peace and blessings of Allah be upon him)
said, “Souls are like recruited troops. Those that know one another come together. Those that don't
differ” - extracted by Bukhari and Muslim

innovation then he is boycotted in this condition without civility. However if his manhaj is the sunnah, but
he made a mistake in an issue in which he concurs with the statements of the people of innovation, then he
is to be advised and not boycotted. And if he does NOT return (to the truth) then in this case as well he is
NOT to be boycotted. Rather his statement of innovation is to be boycotted, and this statement of innovation
is not to accepted from him. As for his foundation then he is upon the sunnah.” End of Quote.

The Rebuttal: Yasir Al-Hudaidi said, “Subhan Allah!! (In this case) you have oppressed Abul Hassan. Listen to
the speech of Shaikh Rabee Al-Madkhali:
The Second type: The one from Ahlus-sunnah and falls into a clear innovation like the saying of the creation of
the Qur'an or Qadr or the view of the khawaarij or other than them. So this one is declared to be an
innovator and the actions of the pious predecessors confirm this.
The Third Type: Whosoever is from Ahlus-sunnah and is known for trying to reach the haqq and fell into an
ambiguous innovation, then if has died then it is not permissible to declare him to be an innovator. Rather
he is to be mentioned with goodness. And if he is alive, then he is to be advised and the truth clarified to
him and not to be hasty in declaring him an innovator. (However), if he is obstinate, then he is to be
declared and innovator.” End of Quote from Shaikh Rabee.

• Ubaid's revival of Saalih Al-Bakri

Just so that the reader increases in certainty regarding our statement “Shaikh Ubaid came to Yemen
as an aid to the hizbees”, look at what he went about doing in terms of praising Salih Al Bakri, the
maftoon [one put to trial in his religion] and declared him to be from the “scholars of Yemen”!! And
here we would like to present to you the speech of Wasaabi, “the sane, noble person of the sunnah”
when the fitnah of Bakri first happened:

A question was asked to Wasaabi:”Should we purchase land that is with Salih Al-Bakri?”
He replied: “I advise Salih Al-Bakri to fear Allah regarding the money that he takes from the people.
It is not permissible for him to agree with the people that so and so metres for such and such price
and then reduce from every plot so and so metres and also raise the price. Allah says:
(‫يا الذين آمنوا أوفوا بالعقود‬- ‫)يا أ‬
{O you who believe! Fulfill (your) obligations.} And Allah also says:
(‫ئول‬
/ ‫)وأوفوا بالعهد إن العهد كان مس‬
{And fulfil (every) covenant. Verily! the covenant, will be questioned about}. And the Muslims are
upon their conditions. So let him fear Allah and give the people what he has promised them. Also
how does he sell that which he does not own? It is not permissible for a person to sell that which he
does not own. Therefore, since he buys these lands with the money of people, he is not the owner in
reality. He is only an agent so the sale has to be with the name of the original seller in whose name
the land is and Salih al-Bakri should be nothing but an agent on behalf of the buyer. However, if he is
the one selling whilst he does not own, then this is not permissible. Due to this we said, “If a person
has little knowledge he gets mixed up, if a person has little knowledge he gets mixed up”. Look at
how he changed himself from being a caller to Allah to being a real estate office manager. (This is
like) the Fishing company of Az-Zindani; this resembles the fishing company of Az-Zindani. The
dawah to Allah has to be far from worldly greed, because if worldly greed enters the dawah to Allah
it spoils/destroys its. This is the reward for the one who speaks against the people of knowledge from
Ahlus-sunnah. His reward is that Allah turns him (on his head) in this life before the next. Our Lord
mentions as in the hadeeth qudsi, “Whoever harms my wali18, then I have declared war on him.” as
narrated by Imaam Al-Bukhari (may Allah have mercy on him) in his Saheeh on the authority on Abi
Huraira (may Allah bepleased with him). This, if he harms one of the awliyaa of Allah so how will it
be if he harms a large number of them??
That which Az-Zindani fell into you have fallen into it. He took the wealth of men and women and
they gave him a long period and towards the end they did not get back from it except a little bit. Salih
Al-Bakri has chosen another path by using the path of real estate19. All praise be to Allah who has
saved us from that which he put them to trial and favored us over many of the creation. I advise

NOT to study under Salih Al-Bakri and Jalal Al-Kameeti because they are weak students of
knowledge who teach sometimes and leave off teaching sometimes.” End of Wasaabi's speech.

Now compare this speech with the speech of Ubaid in this fitnah when he last visited Yemen:

“Our brother, Shaikh Saalih Al-Bakri, I know him and many of the mashaikh of Yemen. When the
fitnah of Abil-Hassan Al-Masri, Al-Ma'ribi (by descent) appeared, and his name is Musthapha ibn
Isma'eel As-Sulaimani. So at that time it appeared to me the strength of the man (Saalih al-Bakri) and
strength of his evidences against Abil-Hassan...”
And then he said, “So verily, the brother, Shaikh Saalih Al-Bakri he is considered by us to be from
the scholars of Yemen and from its mashaikh. And I see that knowledge should be sought from
him as it should be sought from the mashaikh of the sunnah in Yemen.” End of Quote.

The Rebuttal: Does this praise not make clear to the reader that Ubaid's revival of Saalih Al-Bakri is
nothing but the following of his desires20? Especially when it is known that Al-Bakri has not, till date,
neither repented nor clarified (his errors). Rather, (what has actualized is that) Wasaabi, Ubaid and
Salih Al-Bakri have joined hands in attacking Dammaaj and Al-Hajoori!!! And the best detailed
debate regarding this praise is in the treatise entitled “The trustworthy clarification that Ubaid Al-
Jaabiree's revival of Salih Al-Bakri is a treachery to Islam and the Muslims” by Shaikh Muhammad
Al-Amoodi. He mentions in it, the scholars who have warned against Al-Bakri and his fitnah; at the
head of them Shaikh Ahmad An-Najmi (may Allah have mercy upon him) and Shaikh Yahya (may
Allah grant him success). So let the reader refer this treatise.

3. Ubaid's lies, deceptions and treacheries – and these are from the hallmarks of hizbiyyah

Shaikh Rabee said21, “And many of these disguised liars say to you: 'I am a salafi' – and he is a liar. He
did not say this except as a plot. Similar to the hypocrite who says: 'I am a believer. I am a Muslim'.
He says that he is a Muslim. The hypocrite does not say:'I am a disbeliever; I am a hypocrite and I
hate Islam!' Rather he says:'I am a Muslim' and he prays, gives charity and does good deeds, whilst
he wages war against Islam and hates its people... but he says this as a prevarication and an untruth.
And this is from the lies of the people of innovation. And you will not find an innovator except that
he is a liar! He cannot take on Ahlus-Sunnah except with lies and prevarications!” End of Quote.

The following is a small portion of the lies, treacheries and deceptions of Ubaid:

1. Ubaid said22, “ That which has been spread about our brother Shaikh Abdullah ibn Umar
Mar'ee and our brother Shaikh Abdur-Rahman ibn Umar Mar'ee and others from (them
being) hizbees – this is from the lies of Al-Hajoori and his followers for verily they have been
brought up under his hands upon having allegiance and enmity for his sake (i.e. not for the
sake of Allah)...”

The Rebuttal: “She threw me her disease and crept away”23 O Ubaid what is your proof regarding
this allegation? We say as our Lord, glory be to Him says:
(‫{ )هاتوا برهانكم إن كنتم صادقي‬Produce your proof if you are truthful} (Al-Baqarah:111). And in reality he
cannot come with anything because empty vessels only make more noise! And what has prompted
Ubaid to this violent defense of a people whose affair has been clarified and whose fitnah has been
explained in many articles and refutations24, except his allegiance towards them and his enmity
towards those who speak against them with truth? (And praise be to Allah who has enlightened most
of Ahlus-sunnah regarding the hizbiyyah of Abdur-Rahman.) So it is known from this that Ubaid's
proclamation is a false proclamation, a lie and the very essence of deception!

2. Ubaid mentioned in his telephone conversation to Shihr: “And the brother Yahya has a sharp
and vicious tongue and is one of vile statements so he does not observe the sanctity of
anyone, and even if the person has accompanied him for ten years he can destroy all of that in
an hour! He does not have rifq (gentleness), even if may have knowledge but he is deprived of
hilm (gentleness) and hikma (wisdom).” End of Quote.
3. And he also said25, “As for Hajoori, then we have explained more than once26, the summary of
which is that he is an idiot... yes the man was a marketplace vagabond. He was not brought
up in (places of) knowledge... and due to this his manner of address is not the manner of
address of the verifying, devout people of knowledge, rather he speaks with the language of
idiots. He speaks with evil speech and has a vicious tongue.” End of Quote.

The Rebuttal: Our brother Muhammad Ba Jammaal said27, “Has Ubaid forgotten his statement about
the Algerians and Libyans that they are 'Donkeys except those upon whom Allah has mercy'! Has he
forgotten his statement to the caller who kindled him and lost respect with him: 'You are a cow or a
donkey!' And once he said to a caller: 'You are cows, cows!' Is this the mannerism of a scholar who
acts upon his knowledge?! Just by a single phone call, (he labels the people) 'donkeys and cows'! And

then he ends his speech with 'ma salaamah'! Do you see this as (being) a knowledge based
foundation or confused brashness??!” End of Quote.
I say: O Ubaid, who then, speaks evil speech and has a vile/vicious tongue?28 And as Shaikh Rabee
said: “And you will not find an innovator except that he is a liar! He cannot take on Ahlus-Sunnah
except with lies and prevarications!” End of Quote.
And did Shaikh Muqbil bring up his students in the marketplace? (Unfortunately) as has become his
routine now, Ubaid does not back up his statements with proofs, he just lies shamelessly instead!

4. Ubaid mentions in the same phone call (to Shihr): “It is apparent that Shaykh Yahya and
many others do not know the principles of hizbiyyah and what they are. They do not know
what the principles of hizbiyyah are.”

The Rebuttal: Our Shaikh Yahya responded to this 29 by asking Ubaid: “We hope from you to gift us
the principles of hizbiyyah so that we can apply them if Allah wills, in the light of the correct
principles of hizbiyyah, upon these special people of yours.” End of Quote.
And Ubaid till date has not replied to this request and has preceded (in the previous chapter), Shaikh
Muqbil and Shaikh Yahya are from the most knowledgeable people regarding hizbiyyah, its
definition and how to apply it to individuals. So from this it becomes apparent the deception of this
liar and what he intended by trying to make the people lose trust in Al-Allaamah Al-Hajoori!

5. Ubaid said30, “But Hajoori with his idiocy and lack of manners changes many a time, (his
lessons) into what resembles (nightly) chat sessions. So he does not speak with the address of
the people of knowledge, rather he speaks in the manner of impudent, idiotic people.” End of
Quote.

The Rebuttal: And the Shaikh said towards the end of his life as has been narrated by Abdullah ibn
Mathir: The Shaikh was on his sick bed when the brother Abdullah asked him, "O Shaikh, to whom
should the brothers in Yemen return their affairs to? And who is the most knowledgeable person in
Yemen?" The Shaikh kept silent for a few moments and then said, "Shaikh Yahya".31
Shaikh Muqbil said in the introduction to Shaikh Yahya's book “The Rulings of Jum'uah and
Innovations (associated with it)": I have looked through the book on Jum'uah that Shaikh Yahya ibn
Ali Al Hajoori has written and I found it to be a great book; in it are benefits which are worthy of a
journey. And Shaikh Yahya (may Allah protect him) is extremely investigative (in his research) and is
known for his piety, asceticism, devoutness, fear of Allah and is a speaker of the truth who does not

fear, in the path of Allah, the blame of the blamers.”


And the Shaikh also said in the introduction to Shaikh Yahya's book "The Traverser's light in the
Rulings and Etiquette of travelers": To Proceed: A portion of the study on travel was read to me
(written by) our brother, the honorable Shaikh, the pious, ascetic Muhaddith and scholar of
Jurisprudence Abi Abd-Rahman Yahya ibn Ali Al Hajoori. I found it to be a beneficial study with
benefits which are worthy of a journey (to attain them). It contains hadith benefits in the science of
'Appraising and Disparaging' (Jarh wa Tadeel) and the authentication and weakening of hadith. It
also comprises fiqh benefits in terms of extraction of rulings, (comparison of) contrary
explanations and general clarifications which are aplenty likewise in his other writings. I hope
that Allah benefits Islam and the Muslims by this book and his other books. And the brother, Shaikh
Yahya is that beloved person to me and to his brothers from what they see of him in terms of sound
aqeedah, love for the sunnah and his hatred of (that) despicable hizbiyyah. He also benefits his
brothers with fatwaawa that are based upon evidence.” End of Quote.

The author of 'An-Nihaayah'32 defines an idiot to be 'an ignoramus'. So then Ubaid's statement has
one of the following three purports:
• Al-Jaabiree is truthful and Shaikh Muqbil is a liar! - And this is the furthest of the purports
without an iota of doubt!
• Both of them are truthful and Shaikh Yahya has changed, after being a scholar in the time of
Shaikh Muqbil – in this case we ask Ubaid to bring forth one single proof for this 'presumed'
change as Allah has said:
(‫{ )هاتوا برهانكم إن كنتم صادقي‬Produce your proof if you are truthful}. And in actuality this is not
there (i.e. the change) because the reality witnesses the opposite of that. Shaikh Yahya's books,
students, lessons and da'wah are the greatest testament to his knowledge. And we don't
sanctify any one over Allah, but the plain and simple fact is that Shaikh Yahya is from the
soundest scholars of our time and more than one from the people of knowledge have
witnessed his knowledge, piety and abstinence. The enemies of the sunnah have till date, not
brought one single proof indicating that Shaikh Yahya has changed from this origin. Rather,
the opposite has occurred, for verily Shaikh Yahya has increased in knowledge and status in
the eyes of ahlus-sunnah due to his perseverance in seeking knowledge and his out forth
speaking of the truth.
• Al-Jaabiree has lied in his claim – and this is what is correct. Shaikh Yahya is from the most
assiduous people in taking care of his time (so as not to waste it) and his lessons are aplenty
with knowledge based benefits33. So with this we confidently say that these claims are from
the outright LIES of Ubaid Al-Jaabiree!!

Also Ubaid's statement: “But Hajoori with his idiocy and lack of manners changes many a time, (his
lessons) into what resembles (nightly) chat sessions.”

The Rebuttal: And perhaps Jaabiree is ignorant of what has come in terms of nightly chatting in
seeking knowledge. Imaam Bukhari mentions a chapter in his Saheeh (Book of knowledge: Chapter
41) “Chapter: Chatting at night34 for the sake of knowledge”.
And likewise is the condition of the students of knowledge who stay up late seeking knowledge and
from the knowledge that they chat about is speech regarding the condition of hizbees like YOU O
Ubaid. And they warn the Muslims from the evil of their fitnah, so think O Jaabiree before you
speak!!!

6. Ubaid mentions35, “So my advice to my sons and brothers in the West and other than them in
Allah's land is to fear Allah, glory be to Him, and to (return the) ruling (in affairs) to the 'aql36
and stick to what they know from the sunnah and leave off that which is other than it”.
End of Quote.

The Rebuttal: O Ubaid, is not from treachery and deceit to direct the Muslims to return their rulings
to their intellect? What would have harmed you if you had directed them to return their rulings to
the Book and the sunnah upon the understanding of the pious predecessors? Do you fear that they
would understand your deceptions? So where has YOUR intellect gone then?
Rather, the returning of rulings to the intellect is from resemblance to the people of speech
(philosophers) and the people of innovation as Shaikh Rabee mentions in his speech about ahlul-
bidah (the people of innovations)37:
“Because the foundation of knowledge and criterion with them is the intellect. The intellect is the
criterion; So if the religion conforms to the intellect, they accept it not because it is religion, but
because it conforms to their distorted intellect. And if it was to oppose their intellect, they give
precedence to the intellect over the book and the sunnah. So what evil is worse than this?!” End of
the Shaikh's speech.

Chapter: Al-Jaabiree's demolition of the foundations of


salafiyyah and his violation of its principles
Ubaid's relentless efforts to sow dissension and corruption have brought to light his opposition, both
in word and deed, to the tenets and principles of the salaf, to the extent that he has gotten himself
into a deplorable predicament and committed blundering errors. The final outcome of which, was
that he was finally declared hizbi. Anyone doubting the validity of this ruling need look no further
afield than the principles desecrated by Ubaid.

The First Principle: Allegiance and opposition


Allegiance and opposition for the sake of Allah is one of the most fundamental principles of this
religion. Thus, Allah says,
﴾‫دون من حاد ال ورسوله‬- ‫ما يؤمنون بال واليوم الخر يوا‬/ ‫﴿ل تد قو‬
((You will not find any people who believe in Allâh and the Last Day, making friendship with those
who oppose Allâh and His Messenger)) and He says:
﴾‫يا الذين آمنوا ل تتخذوا عدوي وعدوكم أولياء تلقون إليهم بالودة وقد كفروا بـم جاءكم من الق‬- ‫﴿يا أ‬
((O you who believe! Take not My enemies and your enemies (i.e. disbelievers and polytheists, etc.)
as friends, showing affection towards them, while they have disbelieved in what has come to you of
the truth)). This comprises the disbelievers and the people of desires and innovations. It is implicitly
understood from the ayah that this affection should be for the righteous. And the Prophet (may peace
and blessings of Allah be upon him and his family) said, “Verily the family of so and so is not my
Awliyaa; rather my wali is Allah and the pious of the believers”. Nawawi commented on this hadeeth
in his explanation of Saheeh Muslim saying that the meaning of the hadeeth is that “My walees are
only those who are righteous even if they are not kin; and those who are unrighteous are not my
walees even if they are kin.”38 And on the authority of Anas, The Prophet (may peace and blessings of
Allah be upon him and his family)said, "Whoever possesses the following three qualities will have
the sweetness (delight) of faith:
1. The one to whom Allah and His Apostle becomes dearer than anything else.
2. Who loves a person and he loves him only for Allah's sake.
3. Who hates to revert to Atheism (disbelief) as he hates to be thrown into the fire." Extracted by
Bukhari and Muslim.
Nawawi said, “This hadeeth is of great (importance). It is a foundation from the foundations of
Islam.”

The second principle: (Maintaining) unity and not causing division


Al-Imaam Muhammad ibn Al-Husain Al-Aajurree said in his book 'Ash-Sharee'ah' under the chapter
entitled “The command to stick with the jama'ah and the prohibition of dividing; rather (the order) to

follow the sunnah and not innovate”:


“Allah, the exalted has, out of his grace and favors, informed us in his book about those who
preceded us (i.e. the Jews and the Christians) and that the reason for their destruction was none other
than their splitting up. And our Most Noble Mawla39 has informed us that the impetus behind this
division of their jama'ah and their propensity towards falsehood which they had been warned
against was none other than jealousy and oppression after having gained knowledge not bestowed
upon others. Their extreme envy and oppression drove them to become factions and thus came their
demise. And so our most noble Mawlaa has warned us against being like them, lest we meet a similar
demise. Rather he ordered us to cling to the jama'ah and he forbade us from dividing. And likewise,
the Prophet (may peace and blessings of Allah be upon him and his family) warned us against
division and ordered us to be one. We were also warned by the imaams of the salaf and the Muslim
scholars against division and ordered to be united.”

And Muhammad ibn Al-Hussain said, “Allah our most Noble Mawla informed us that they were
given knowledge but they became mutually oppressive and jealous which eventually led them to
become factions and meet their demise. If someone asks, 'Where in the Qur'aan our Noble Mawla
warns us against division and orders us to be united, that we may comply with his orders?' It should
be said to him Allah ta'aala says in Surah Aal-Imraan:
‫اء فـ ألف بيـ‬/ ‫عا ول تفرقوا واذكروا نعمة ال عليكم إذ كنتــم أعـ د‬/ ‫يا الذين آمنوا اتقوا ال حق تقاته ول توتن إل وأنتم مسلمون واعتصموا بحبل ال جي‬- ‫﴿ يا أ‬

‫ة من النار فأنقذكم منها كذلك يبي ال لكم آيـ اته لعلكـم تتـدون ولتكـن منكــم أمـ _ة يـ دعون إ ـ‬b ‫ا وكنتم عل شفا حفر‬/‫قلوبكم فأصبحتم بنعمته إخوان‬
‫ل اليـ‬
﴾‫يم‬_ ‫اب عظ‬_ ‫ويأمرون بالعروف وينهون عن النكر وأولئك هم الفلحون ول تكونوا كالذين تفرقوا واختلفوا من بعد ما جاءهم البينات وأولئك لم عذ‬
((O you who believe! Fear Allâh (by doing all that He has ordered and by abstaining from all that He
has forbidden) as He should be feared. [Obey Him, be thankful to Him, and remember Him always],
and die not except in a state of Islâm (as Muslims) with complete submission to Allâh. And hold fast,
all of you together, to the Rope of Allâh (i.e. this Qur'ân), and be not divided among yourselves, and
remember Allâh's Favour on you, for you were enemies one to another but He joined your hearts
together, so that, by His Grace, you became brethren (in Islâmic Faith), and you were on the brink of
a pit of Fire, and He saved you from it. Thus Allâh makes His Ayât (proofs, evidences, verses, lessons,
signs, revelations, etc.,) clear to you, that you may be guided. Let there arise out of you a group of
people inviting to all that is good (Islâm), enjoining Al-Ma'rûf (i.e. Islâmic Monotheism and all that
Islâm orders one to do) and forbidding Al-Munkar (polytheism and disbelief and all that Islâm has
forbidden). And it is they who are the successful. And be not as those who divided and differed
among themselves after the clear proofs had come to them. It is they for whom there is an awful
torment.))

Therefore, striving for disunity is the most distinguishing characteristic of the innovators and the
principal reason for their disunity is their abandonment of the whole truth or some of it. Ibn

Taymiyyah says in Majmoo Al-Fataawa (16/245): “And it is therefore indeed manifest that the
differing factions of the ummah have only become so by abandoning some of the truth that Allah
sent His Messenger with or by adopting falsehood that opposes it and by participating in falsehood
that was in opposition to that which the Messenger brought. This is like the disbelievers opposition
of the believers. Allah says:
‫ات وآتينا عيسى ابن مريم البينات وأيدناه بروح القـ دس ولـو شـ اء الـ مـ ا اقتتــل‬
b ‫ض منهم من كلم ال ورفع بعضهم درج‬
- ‫﴿تلك‬
b ‫الرسل فضلنا بعضهم عل بع‬
﴾‫الذين من بعدهم من بعد ما جاءتم البينات ولكن اختلفوا فمنهم من آمن ومنهم من كفر ولو شاء ال ما اقتتلوا ولكن ال يفعل ما يريد‬
((Those Messengers! We preferred some to others; to some of them Allâh spoke (directly); others He
raised to degrees (of honour); and to 'Iesa (Jesus), the son of Maryam (Mary), We gave clear proofs
and evidences, and supported him with Rûh-ul-Qudus [Jibrael (Gabriel)]. If Allâh had willed,
succeeding generations would not have fought against each other, after clear Verses of Allâh had
come to them, but they differed - some of them believed and others disbelieved. If Allâh had willed,
they would not have fought against one another, but Allâh does what He likes.))

So if they were to adopt falsehood contrary to the believers who follow the messengers, they would
have abandoned a good part of that which was sent to them and thereby enmity and hatred would be
sown amongst them. And if they differ amongst themselves regarding truth brought by the
messenger; one faction believing is some of it and disbelieving in the rest, the other faction believing
in that which the first faction disbelieved in and disbelieving in that which they believed. In this case,
both the differing factions are wrong. This is the case regarding most of the differing in this and other
nations.

The third principle: Aiding the truth and its people, not waging war against them and not impeding
adherence to them and not forsaking them.
Among the proofs for this principle are the statement of Allah:
﴾‫يا الذين آمنوا إن تنصـروا ال ينصـركم ويثبت أقدامكم‬- ‫﴿يا أ‬
((O you who believe! If you help (in the cause of) Allâh, He will help you, and make your foothold
firm.))
And Allah says:
﴾‫يا الذين آمنوا استجيبوا ل وللرسول إذا دعاكم لا يييكم واعلموا أن ال يول بيـن الرء وقلبه وأنه إليه تشون‬- ‫﴿يا أ‬
((O you who believe! Answer Allâh (by obeying Him) and (His) Messenger when he calls you to that
which will give you life, and know that Allâh comes in between a person and his heart (i.e. He
prevents an evil person to decide anything). And verily to Him you shall (all) be gathered.))

Imaam Bukhari extracted in his Saheeh on the authority of Anas, that the Messenger of Allah (may
peace and blessings of Allah be upon him and his family) said, "Help your brother, whether he is an
oppressor or he is an oppressed one. People asked, "O Allah's Messenger! It is all right to help him if
he is oppressed, but how should we help him if he is an oppressor?" The Prophet (may peace and

blessings of Allah be upon him and his family) said, "By preventing him from oppressing others."
And Allah dispraised the hypocrites because of their not aiding the truth in his statement:
‫ذ أقرب منهم لليمن يقول ـون ب ـأفواههم مـ ا‬b ‫تال لتبعناكم هم للكفر يومئ‬
/ ‫﴿وليعلم الذين نافقوا وقيل لم تعالوا قاتلوا فـي سبيل الـله أو ادفعوا قالوا لو نعلم ق‬
﴾‫ليس ف قلوبم وال أعلم بم يكتمون‬
((And that He might test the hypocrites, it was said to them: "Come, fight in the Way of Allâh or (at
least) defend yourselves." They said: "Had we known that fighting will take place, we would
certainly have followed you." They were that day, nearer to disbelief than to Faith, saying with their
mouths what was not in their hearts. And Allâh has full knowledge of what they conceal.))

Imaam As-Saaboonee says in his book “Aqeedah of the Salaf, the people of hadeeth”, “They love and
hate for the religion... they show enmity to the ignoramuses and the people of desires... and they
despise the people of innovation and do not love them.”
And says, “From the signs of Ahlus-sunnah is that they love the imaams, scholars, helpers and
awliyaa of the sunnah and despise the imaams of innovation.”
And he says, “The sign of the innovator is patently apparent. Their most manifest sign is their acute
enmity towards the bearers of hadeeth and their contempt and ridicule for them. Their nicknaming
them hashawiyyah, ignoramuses, dhaahiriyah, anthropomorphists etc.”

Shaikh Rabee ibn Haadee said in his explanation of this point, “If you see a person defaming Ahlus-
Sunnah this is proof that he is an innovator; maybe even a hypocrite. If you see a person defaming
Ahlus-sunnah and Ahlul-hadeeth, know, that he without doubt, does his out of contempt for them
(and what they have). Otherwise, what other motivation could he possibly have other than that he
is astray and harbors deviance and evil!! This is one of their hallmarks, the signs of the wicked
and the innovators. Even if he claims to be from Ahlus-sunnah don't believe him, he is a LIAR!”

Ubaid's violations of all the above three principles have conglomerated in the following fatwa:

Al-Jaabiree says40, “I conclude by warning against this man, whose principles and tenets have
conclusively and decisively been proved unsound. I likewise warn against traveling to
markaz Dammaaj until it be restored to the way it was founded by Shaikh Muqbil (may Allah
have Mercy upon him) from the making of rulings, calling to Allah upon the Book and
sunnah in accordance to the manhaj of the salaf. This is currently unachievable except with
the co-operation of four groups by the permission of Allah.

The first group: The virtuous students and those who have an earnest concern from the tribe
of Waadiah. Especially those close to the founder of the markaz (may Allah have Mercy upon
him). They must strive assiduously, making every possible effort to the draw the attention of
the concerned government bodies to banish Al-Hajoori from the markaz.

The second group: The guards appointed by Al-Hajoori himself must abandon guarding him.
As by doing this, they are aiding and abetting in sin and transgression.41

The third group: The students of the markaz – they are to leave immediately in order to save
themselves from being indoctrinated by his unsound principles and debunked tenets which
befool none but the weak-minded or sick-hearted. They can go to any of the other centers of
the sunnah in Yemen. For example, dar-ul-hadeeth in Hudaidah which is run by our brother,
Shaikh Muhammad Al-Wasaabi.42

The fourth group: Those planning to go to Dammaaj to study with Al-Hajoori and his mob.
My advice to this group is that they refrain doing so and seek knowledge from those known
for teaching people the pure sunnah with good words and manners. There exists, and all
praise is due to Allah, a multitude of them in Yemen, Saudi Arabia and other Muslim lands.

And Allah knows that I mean only to advise the Muslims in general and more specifically
those students who yearn for the sunnah, so that they may avoid being entangled in the snare
of innovation and deviance. Lest they graduate at the hands of Al-Hajoori and his mob,
calling to demolition whilst actually wanting to build and calling to ruin whilst wanting
improvement.

The Rebuttal: Our noble brother, Abu Ishaaq Ash-Shibaami said in refutation of this43:
“Al Jaabiree and his likes are totally incapable of corroborating their claims that Dammaaj has
changed since the time of Shaikh Muqbil (may Allah have Mercy upon him). We are waiting for an
explanation of these alleged changes in the salafi manhaj and educational methodology in dar-ul-
hadeeth, Dammaaj. Ask those who are fair and just. They will guide you to that which is correct.
Empty claims totally devoid of evidence do nothing more than expose their proponents for all to see
as has been the case with Ubaid.

The warning of these vulgar rabble against Dammaaj, both now and of old, remind me of the

statement of Shaikh Muqbil (may Allah have Mercy upon him): “These peoples with their actions
and statements are nothing more than publicity for our da'wah” He would then quote or sight, (the
verses of) Abu Tammaam:

Whenever Allah wants to propagate a hitherto hidden excellency


he appoints for it the tongue of the jealous
Were it not for the kindling of the fire
the fragrance of aloes would remain unknown

Al-Jaabiree deserves a doctorate in sowing discord but despite that hasn't been granted success. He
wants to incite as many people as possible in order to realize his sinister objective of effecting the
demise of dar-ul-hadeeth in Dammaaj. So he went about dividing this imaginary mob into four
groups. O (Abdullah) Sabt of the new hizb, the reality regarding your categorization is as follows:

As for the first group, they most effectively gagged you with a refutation by the name of “The tribe of
Waadia's clear refutation against the manifest fooleries uttered by Ubaid Al-Jaabiree and his
abomination.” This struck you utterly dumb and burnt you to a crisp. So you then took recourse to
the method used by the people of desires: Inciting the rulers against the Ahus-Sunnah. The main
thing being to bring harm to Ahlus-sunnah by all means necessary. So he (Ubaid) grabs wistfully at
these delusions that the accursed Iblees has aroused in him.
/ ‫﴿يعدهم ويمنيهم وما يعدهم الشيطان إل غر‬
﴾‫ورا‬
((He [Shaitan (Satan)] makes promises to them, and arouses in them false desires; and Shaitan's
(Satan) promises are nothing but deceptions.))

As for the second group, you neglected to mention them this time because you got their count wrong
the first time and were refuted by the first group. What is more, those whom you so futilely call were
not even appointed by Shaikh Yahya (may Allah protect him). All the students volunteer of their own
free will to protect this markaz, its denizens and its best interest. So contrary to your base imputation,
its not specific to (Shaikh) Yahya, but rather Ubaid calls to the deterioration of affairs (of Ahlus-
sunnah) as was revealed to him by the accursed Iblees.

As for the third group and Ubaid's inciting them to immediately leave Dammaaj, then this is nothing
short of him inciting another figment of his imagination. As for your myrmidones, they left well
before your call, so Allah relieved us of them. They of course, became wastrels leading others the
same way; some wasting their time in the marketplace and others consecrating themselves to the
acquisition of wealth after having devoted their lives to seeking knowledge. Yet others have become
awfully dissolute, keeping company with people of decidedly ill-repute. They have become enemies
of the sunnah after having been from those who called to it. It is you and your likes who have aided
and abetted the devil in bringing about the downfall of these youth. May you perish in your fury O
Ubaid! You have wasted your breath. People are flocking to Dammaaj from all corners of the world.

They vie and go to any lengths to get here. Many can't even find accommodation due to
overcrowding and yet the building of houses is ongoing. Does this goodness infuriate you O Ubaid??
Your delusions do indeed resemble those of the enemies of Islam who scheme against this markaz
that calls to the Sunnah and rectification of the methodology of the Muslims and sets them on the
path of the righteous salaf. So won't you come to your senses O Ubaid???!

Ubaid then commanded this figment of his imagination to join forces with another figment of his
imagination which he calls “dar-ul-hadeeth” in Hudaidah. Thus alleges he! The inhabitants of Yemen
have yet to hear of any dar-ul-hadeeth in Hudaidah. But we must excuse Ubaid for he does indeed
live in his own little dream world. I will even go so far as to say that the inhabitants of Hudaidah
themselves have yet to find out about it. In fact, if you were to ask Wasaabi himself, he would be
most perplexed for the simple reason that all he has is a masjid which he teaches in. He closed his
markaz several years ago and does not accept students (unless they have a secret plan to re-open to
which I am not privy of). Or maybe it is just that Ubaid uses special jargon exclusively understood
by himself. He then very conveniently neglected to mention any of the other maraakiz in Yemen for
the simple reason that, unlike Al-Wasaabi, they are not of the same strain as him. They are only
'acceptable'. This recommendation is a lie, and let us suppose for the sake of argument that this is not
the case, it is, at the very least treacherous. Thus are the incompetent fumblings of Ubaid – devoid of
success for no other reason than his intense odium towards the truth and its adherents. Shaikh-ul-
Islam ibn Taymiyyah says, “he who holds the truth in disdain, will be afflicted with compliance to
falsehood”. This is testified to by the statement of Allah in the Qur'aan:
‫يل وإن يروا سـ بيل الغــي يتخـ ذوه‬/ ‫الرشد ل يتخذوه سب‬
- ‫﴿سأصـرف عن آيات الذين يتكبون ف الرض بغي الق وإن يروا كل آية ل يؤمنوا با وإن يروا سبيل‬
b
﴾‫يل ذلك بأنم كذبوا بآياتنا وكانوا عنها غافلي‬/ ‫سب‬
((I shall turn away from My Ayât (verses of the Qur'ân) those who behave arrogantly on the earth,
without a right, and (even) if they see all the Ayât (proofs, evidences, verses, lessons, signs,
revelations, etc.), they will not believe in them. And if they see the way of righteousness
(monotheism, piety, and good deeds), they will not adopt it as the Way, but if they see the way of
error (polytheism, crimes and evil deeds), they will adopt that way, that is because they have rejected
Our Ayât (proofs, evidences, verses, lessons, signs, revelations, etc.) and were heedless (to learn a
lesson) from them.))

As for the fourth group, they are those planning to travel to Dammaaj. Ubaid (Abdullah Sabt),
lurking bandit that he is, most warmly advises to refrain from doing so. O (Ubaid) what a venomous
fiend you are!! The immense good and the fact that students are converging on Dammaaj have driven
Ubaid into a fuming frenzy. He has mutated into a (skeleton) key, instrumental in hindering the path
of good and opening the way to evil. So beware Ubaid, for indeed the Prophet (may peace and
blessings of Allah be upon him and his family) said, “Woe to the slave whom Allah has made him a
key to evil and closed upon him goodness.” Saheeh Al-Jaami 4108.

Ubaid then altered the wordings of his warning he made during the question and answer session

from Morocco. (The wording of which was): “Therefore I do not advise anybody to travel to
Dammaaj unless Yahya leaves and Shaikh Muqbil leaves another successor. Someone well versed in
establishing Islam and the Sunnah. A sensible, pious, god-fearing, muhaqqiq. Or someone not under
his (Yahya's) influence nor submissive to him. But this is currently non-existent”. End of Quote.
But when it became quite apparent that this statement had brought public ignominy upon him and
his gang, as it was nothing more than defamation of the salafi da'wah in Yemen and its scholars, he
conveniently modified it to “And there exists, and all praise is due to Allah, a multitude of them in
Yemen, Saudi Arabia...”. It is truly astonishing that he, on the one hand says that they are a
multitude, yet when it comes to giving an example, he does so with nothing but a figment of his
imagination that he recommends students to go to. Strange indeed are the amazing exploits and feats
of this demented lunatic!

Ubaid then claims that he only did this for fear of falling into innovation and deviance. But upon
scrutiny, we find no innovations that were the reason his warning; we find nothing (from him) except
fooleries and twisted logic that give tongue to his deviation and hostility towards Ahlus-sunnah. So
open your eyes O Ubaid, and see all the good that has come from Dammaaj; shaikhs, da'ees and
books, the benefit of which have pervaded the world.

End of Quote from Abu Ishaaq.

The erudite scholar Shaikh Saalih al Fawzaan (may Allah protect him) was asked44: “Is
opposition of the saved sect and the victorious group in issues of allegiance and opposition
and obedience to the leaders, be they pious or wicked, as long as they do not order sin – does
opposition of these principles cause one to leave the saved sect, even if this individual is in
agreement with them regarding the remaining issues of Aqeedah?

Answer: Yes (he leaves the saved sect), if he opposes them in one issue but agrees regarding
the rest, then he is not considered to be from them in that particular issue which he opposes
them and at the same time he is not considered to be with them in that which he agrees with
them. And in this is a perilous state that he is in; and he enters in the warning ((All of them
are in the fire of Hell)).

So here we have three principles in which Al-Jaabiree has violated the belief of the salaf. The scholars
have declared he who violates one, never mind about all three, to be an innovator. Such a person
would, a priori, be deserving of such a ruling.

Closing Advice:

Many of the quotes I have cited are likely to cause confusion amongst the blind followers and the
empty handed that are still waiting for the one that they follow blindly and for the consensus of the
people of criticism before they accept that which I have said. So I here present some of the text cited
by our virtuous brother Abu Haatim Yousuf Al Jazaairee in his treatise entitled: “Impeding the rabble
from the innovation of stipulation of unanimity or majority before accepting the criticism regarding
the people of fitnah and innovation”:
The Imaam, the reformer, Muqbil ibn Haadee al Wadiee (may Allah have Mercy upon him)
was asked: “Some people reject the criticism of sunni scholars regarding innovators claiming
that the one being criticized has yet to be criticized by the remaining sunni scholars using the
statement :(Why doesn't so and so speak? If this criticism was valid, the other scholars would
follow his example) So is it correct to stipulate that all or most of the sunni scholars should
unite upon his criticism especially if proof has come to the attention of the original critic by
way of lectures and writings.

So he answered: The truth of the matter O my brothers, is that some people have yet to study
the science of hadeeth or may have studied it but are (using) deception!! We will tell you
something that is bigger than this: suppose Ahmad ibn Hanbal was to declare someone as
being “trustworthy”. And then Yahya ibn Ma'een was to declare him a “liar”. Would the
statement of Yahya harm him keeping in mind that Ahmad ibn Hanbal declared him
trustworthy? Of course it would! The statement of Yahya is a detailed criticism. He knows (as
regarding this individual) that which Ahmad does not. So what if Yahya ibn Maeen were to be
the only one to speak about him?? So I say that, were a contemporary scholar to bring forth
proofs establishing the deviance of Muhammad Al-Ghazaali, Yusuf Al-Qaradaawi or the
manhaj of the 'bankrupt brotherhood' it would be obligatory to accept his criticism.
﴾‫ة فتصبحوا عل ما فعلتم نادمي‬b ‫ما بجهال‬/ ‫ فتبينوا أن تصيبوا قو‬b‫يا الذين آمنوا إن جاءكم فاس _ق بنبإ‬- ‫﴿يا أ‬
(( O you who believe! If an open sinner/evil person comes to you with a news, verify it, lest
you harm people in ignorance, and afterwards you become regretful to what you have done.))

If a trustworthy individual brings information it is to be accepted as it is implicitly


understood from the ayah. So where are you from the understanding of the ayah that
indicates that we must accept information afforded by the trustworthy (narrator) and verify it
if he who brings it is a faasiq (open sinner). O brothers, the truth of the matter is that some
people are in direct opposition to both the early and later scholars. Alhamdulillah, we praise
Allah. People don't trust you nor your speech45 you raving lunatic.46

In conclusion:

Whoever persists in claiming that the clash between Shaikh Yahya, Ubaid Al Jaabiree and Abdur-
Rahman Al-Adanee is mainly a personal difference, let him bring forth his proofs, especially after
Shaikh Yahya and his students have made clear as day, the fact that these people are hizbees. It is
saddening that some of the naive westerners have been duped by Ubaid but as has been said by
Allah:
_ ‫ل من يشاء ويدي من يشاء فل تذهب نفسك عليهم حسات إن ال عل‬- ‫ا فإن ال يض‬/‫أفمن زين له سوء عمله فرآه حسن‬
‫يم بم يصنعون‬ b
(( Is he, then, to whom the evil of his deeds made fair-seeming, so that he considers it as good (equal
to one who is rightly guided)? Verily, Allâh sends astray whom He wills, and guides whom He wills.
So destroy not yourself in sorrow for them. Truly, Allâh is the All-Knower of what they do!))

I hope in the space of these few pages to have sufficiently clarified that which will hopefully help
bring those deceived by this man to return to and understand the honest truth. And success is with
Allah.
