The humble application of the

abovenamed applicant

MOST RESPECTFULLY SHOWETH AS UNDER:


1. That the present special leave petition has been preferred by the

State of Haryana, i.e. Petitioner, challenging the judgment and order

dated passed by the Hon’ble High Court of Punjab and aryana

in CA No. , wherein the Respondents filed a

case against the above named petitioner seeking to declare the land

acquisition proceedings initiated by the Petitioner for possession of

the property belonging to the Respondents ultra vires.

2. That the facts of the case are not being repeated for the sake of

brevity and the applicant wishes to refer and rely on the facts stated

by him in the counter affidavit filed by him for brevity.

3. That in the instant Petition, Respondent No. herein mentioned,

earlier enjoyed the ownership and possession of the plot no.

. It is submitted that the said Respondent after a period of

time vacated and sold the said land vide a sale deed executed in

favour of the Applicant, and the said

property was mutated in the name of the Applicant.

A copy of the sale deed dated has been marked and

annexed hereinafter as ANNEXURE A.

4. That the said plot is a part of the total land the Petitioner Government

has proposed to acquire under the Notification released under Section

4 of the Land Acquisition Act, 1894. It is submitted that the said


Applicant who has bought the plot enjoys its ownership and

possession in light of the said sale deed, therefore represents the

said property. It is submitted that in the instant petition, in light of

Order I Rule 10, Code of Civil Procedure, 1908, the said Applicant is

ipso facto a necessary party owing to his vested interests and seeks

relief from this Hon’ble Court during the outcome of the said

proceedings.

5. That the details of the respondent no. are as follows:

i) aged years, S/o , R/o.

6. That in view of the facts and circumstances narrated above it is

expedient in the interest of justice that this Hon’ble Court may be

pleased to allow the present substitution application and direct the

office to substitute the names of the applicant in place of the

Respondent no. as Respondent No.

PRAYER

It is therefore most respectfully prayed that this Hon’ble Court may

be pleased to;

a) Allow the present substitution application.

b) Direct the office to substitute the names of the applicant in place

of the Respondent no. as respondent no. .
