AFFIDAVIT OF ACQUISITION OF
OWNERSHIP BY PRESCRIPTION

I, ARISCHELLE ALCANTARA-ORACION, married to Mario Dennis U. Oracion,

Filipino, of legal age, and resident and with postal address at #246 Brgy. San Nicholas,
San Pablo City, Laguna, after having duly sworn to in accordance with law, do hereby
depose and state:

1. That sometimes on September 18, 1997, the late Teodora Puno as

represented by her heirs namely Virgilio Cuello, Maria Cristina Cuello-Angeles,
Engcarnita Cuello-Devino, Marissa Cuello and Michael Cuello executed a document
known as “Extrajudicial Settlement of Estate with Absolute Sale” pertaining to a parcel
of residential land located in Brgy. San Nicholas, San Pablo City, with an area of 250
square meters, described and covered by Transfer Certificate of Title No. T-18006 and by
Tax Declaration/ARP No. 94-069-320;

2. That the said property was sold to my mother Elena Corvera-Alcantara as

evidenced by the said document notarized by Atty. Alvin M. Exconde on September 18,
1997 and hereto identified as Doc. No. 131; Page No. 72; Book No. XVII; Series of
1997, attached hereto is the photo-copy of the said document;

3. That during the sale of the said land, the house erected thereon that was
partially damaged and depreciated were included in the agreement thereof. However,
during that time of sale, it was not yet ascertained whether or not any Tax Declaration
covers the said house;

4. That the said house is included in the sale as evidenced by a written

receipt executed in favor of my mother Elena Corvera-Alcantara and copy of the check
evidencing the payment thereof, attached hereto are the photo-copy of the receipt and the
check;

5. That sometime on January 11, 2000, my father Aristidy Alcantara died

leaving me, my sister Maria Teresa Arlyn Alcantara and my mother Elena Corvera-
Alcantara as the surviving heirs;

6. That after the death of my father Aristidy Alcantara, we executed a

document of known as “Extrajudicial Settlement of Estate” as evidenced by the said
document notarized by Atty. Candido Javaluyas Jr. on September 20, 2000 and hereto
identified as Doc. No. 423; Page No. 87; Book No. 107; Series of 2000, attached hereto
is the photo-copy of the said document;

7. That the land which was sold by the heirs of the late Teodora Puno to my
mother Elena Corvera-Alcantara were adjudicated to me and my sister Maria Teresa
Arlyn Alcantara;

8. That since I am the one living in the said house which was partially
damaged and depreciated, I caused the repairs of the said house erected on the land
adjudicated to me;

9. That my family and I are the one living and residing in the said house
since September 18, 1997 (the date of the sale to my mother);

10. That recently I discovered that Tax Declaration/ARP No. 94-069-00804

covered the said house that was included in the sale made by the heirs of the late Teodora
Puno to my mother Elena Corvera-Alcantara;

11. That since I and my family are the one residing and living in the land and
the house erected thereon, that is covered by the said Tax Declaration/ARP No. 94-069-
00804 for a period of more than ten (10) years, I acquired ownership thereof by
prescription and by virtue of the sale thereof;

12. That since I am a lawful possessor and occupant in good faith of the land
and the house erected thereon (which was previously owned by the late Teodora Puno),
my right to possession and ownership thereof should be respected;

13. That there in no claimant or any person claiming adverse interest over the
said land and the house erected thereon;

14. That I have possessed the said land and the house erected thereon in good
faith, with just title, in the concept of an owner, public, peaceful and uninterrupted for a
period of more than ten (10) years;

15. That I executed this Affidavit of Acquisition of Ownership by Prescription

and respectfully request the Office of the City Assessors of San Pablo City to cancel the
Tax Declaration/ARP No. 94-069-00804 (pertaining to the house) registered in the name
of Virgilio Cuello and Teodora Puno in my name and for whatever other legal purpose
this may serve;

appeared ARISCHELLE ALCANTARA-ORACION who is identified by her SSS ID Card
No. 04-0872001-8 and avows under penalty of law to the whole truth of the contents
thereof.
