Adopt This Constitutional Gun Control Law

By Robert B. Sklaroff, M.D.

Senator Ted Cruz has defined “gun control” as “good aim.”

Within this context, it is desirable to direct political energy toward enacting a gun control law that
does not violate any fundamental constitutional rights.

I propose that a MANDATORY system be established whereby any private seller can CHOOSE to
acquire a background-check at either gun-shows or any/all local police-stations for FREE.

This would create a “voluntary/mandatory” structure addressing private sales, whether at a gun
show or elsewhere.

What is not sufficiently recognized is that the National Rifle Association has detailed multiple
federal restrictions on private gun purchases that sellers would recognize that it would be in their
self-interest to honor, to minimize potential co-liability.

Thus, facilitating the process of acquiring relevant information would appear to be an optimal
approach to this problem, absent any “registration” process—of gun and/or owner—while
maintaining anonymity.

This would not violate any policy promulgated by the NRA’s Institute for Legislative Action, for it
would not impinge upon fundamental rights embodied in the 2nd Amendment; it would also not
be inconsistent with initiatives born of the Brady Bill and enhanced by more recent efforts
spearheaded by Bloomberg/Giffords and Toomey/Manchin.

Secondary political gain will be realized when worriment that the GOP cares not about gun
violence is neutalized, so that the political focus can be trained on national/international policies,
rather than being diverted inappropriately to the “social issues.”
