APPLICATION FOR PROBATION

ACCUSED, through the undersigned counsel and unto this Honorable Court, most respectfully
applies for probation under the provisions of Republic Act No. 10707, and states that:

1. On August 6, 2019, the accused was convicted of the crime of Slight Physical Injuries under
Article 266 of the Revised Penal Code, as amended by Section 61 of the Republic Act 10951, and there
being one (1) mitigating circumstance of plea of guilty as provided for in Article 13, paragraph 7 of the
Revised Penal Code, he is hereby sentenced to suffer the penalty of five (5) days of arresto menor;

2. Moreover, with respect to the civil aspect of this case, the parties arrived at a settlement of
Two Thousand Pesos (P 2,000.00) to cover the full civil liability of the accused. Counsel for the accused
handed over the amount to private complainant who received the same in open court;

3. His Counsel, Atty. Noel Sinco manifested that the accused will be applying for Probation in this
case and submitted in court an Affidavit of Recognizance stated that he will guarantee the appearance of
the accused whenever required by the Court or other government agency for that matter. Thereby
releasing him on recognizance with no objection from Prosecutor Espinosa.

4. That the accused was not sentenced to serve a maximum term of imprisonment of more than
six (6) years;

5. That he was not convicted of any crime against the national security;

6. That he has not been previously convicted by final judgment of an offense punishable by
imprisonment of more than six (6) months and one (1) day and/or fine of more than one thousand pesos
(P 1,000.00);

7. That he was not previously placed on probation under the provisions of R.A. 10707; and

8. That he has not served his sentence at the time the substantive provisions of R.A. 10707
became applicable pursuant to Section 33, thereof;

9. That the Accused has all the qualifications and none of the disqualifications to avail of the
benefits of the Probation Law.
WHEREFORE, premises considered, it is most respectfully prayed of this Honorable Court that
the Application for Probation be referred to the Parole and Probation Officer of the Iloilo City, where he
is a resident, for the requisite post-sentence investigation and the application for probation be approved.

Other reliefs just and equitable in the premises are likewise sought.
