- This act shall be known” Anti Sexual Harassment Act of 1995” The state shall value the dignity of every individual enhance the development of its human resources guarantee full respect for human rights uphold the dignity of Workers Instruction or Employees education Applicants for employment students The sexual favor is made as a condition in the hiring or in the employment In returns of good compensations, terms, promotions or privileges The refusal to grant the sexual favor results in limiting, segregating, classifying the employee which in anyway would discriminate, deprive of diminish employment opportunities or otherwise affect the employee. Against who would impair employee's rights or privileges under existing labor laws against who would result in an intimidating hostile, or offensive, environment for the employees

or supervision of the offender * Against one whose education training, apprenticeship or tutorship entrusted to the offender * when the sexual favor is made a condition to the giving of a passing grade, granting honors and scholarship, payment of a stipend, allowance, benefits, privileges or considerations. * when the sexual advances result in an intimidating, hostile or offensive environment for the result, trainee or apprentice It shall be the duty of the employer or the head of the office in a work related, educational or training environment or institution to prevent or deter the commission of acts of sexual harassment to provide procedures of acts of sexual harassment to provide procedures for the resolutions, settlement or prosecution of acts of harassment Promulgate appropriate rules and regulations in consultation with jointly approve by the: Employees, students or trainees designated representative Create a committee on decorum and investigation of cases of sexual harassment. The committee shall conduct a meeting with Officers, employees Teachers, instructors etc… The employer or head office, educational or training institution shall be solitarily liable for the damages arising from act of sexual harassment committed in the employment, education or training environment if the employer or head of office, educational or training institution is informed of such acts by the offended party and no immediate action is taken there on. Nothing in this act shall preclude the victim of work, education or training-related sexual harassment from instituting a separate and independent action for damages and other affirmative relief. Any persons who violates the provision of this act shall, upon conviction, be penalized by imprisonment of not less than one (1) month nor more than six (6) months, or a fine not less than Ten thousand pesos (10, 000) nor more than twenty thousand (20, 000) or both such fine and imprisonment at the discretion of the court If any portion of this act is declared void or unconstitutional, the remaining portion or provision here of shall not be affected by such declaration. All laws, decrees, orders, rules and regulations other issuances or part there of inconsistent with the provision of this act hereby repealed or modified accordingly. This act shall take effect fifteen (15) days after its complete publication in at least two (2) national newspaper of general circulation.
