ORDER:

In the G.O. Ms. No. 1758, Public Works, dated 11.10.72, the Government
directed that the status of Senior Architectural Draftsmen (now known as Assistant
Architects) who possess B.Arch. Degree working in Government Architect Section in the
Public Works Department be raised to gazetted rank, without any increase in their
emoluments.

In G.O. Ms. No. 1379/Public Works, dated 10.9.73, the Government directed that
the posts in the Government Architect Section shown in column (2) below, be
redesignated, as shown in column (3).

The Government also ordered in G.O. Ms. No. 843/Personnel and Administrative
Reforms, dated 11.7.77 and in G.O. Ms. No. 577/Personnel and Administrative
Reforms, dated 11.5.1979, the reclassification of the several categories of staff as
Groups A, B, C and D. The Government in the Personnel and Administrative Reforms
Department have also since issued orders to the effect that the posts which have been
elevated to Gazetted Status be brought under the State Service rules.

2. Rules governing appointment to the posts in the Chief Architect Section are
contained as Class VII under the Tamil Nadu General Service. The Chief Engineer,
Public Works Department (General) has, submitted proposals for the constitution of a
separate service with nomenclature as “Tamil Nadu Architect Service”. The
Government with modification accept the proposal of the Chief Engineer, Public Works
Department (General), in this regard and accordingly issue the following Special Rules
for the Tamil Nadu Architect Service proposed by the Chief Engineer, Public Works
Department (General), in supersession of the Special Rules under Class VII in Section
16 of the Tamil Nadu Services Manual, Volume II, 1969.

3. The following notifications will be published in the Tamil Nadu Government


Gasette:-

NOTIFICATION – I

In exercise of the powers conferred by the proviso to article 309 of the


Constitution of India, the Governor of Tamil Nadu hereby makes the following
amendments to the Special Rules for the Tamil Nadu General Service (Section 16 in
Volume II of the Tamil Nadu Services Manual, 1969).

2. The amendments hereby made shall come into force on the 11th November
1986.
AMENDMENTS
In the said Special Rules:-

(1) art I, the expression “Class VII – Government Architect, Architect and
Senior Architectural Draughtsman” shall be omitted;

(2) in part II, the expression “Class VII – Government Architect, Architect
and Senior Architectural Draughtsman” and the rules thereunder shall be
omitted.

NOTIFICATION – II.

In exercise of the powers conferred by the proviso to Article 309 of the


Constitution of India, the Governor of Tamil Nadu hereby makes the following Special
Rules for the Tamil Nadu Architect Service (Section 41 in Volume II of the Tamil Nadu
Services Manual, 1969).

2. The rules hereby made shall come into force on the 11th November 1986.

SECTION – 41 – TAMIL NADU ARCHITECT SERVICE

1. CONSTITUTION: The Service shall consist of the following categories of officers


namely:-

CATEGORY-1 Chief Architect

$ CATEGORY Joint Chief Architect


(Distinct category) (Formerly known as Deputy Chief

CATEGORY-2 Senior Architect

CATEGORY-3 Architect

CATEGORY-4 Assistant Architect

2. APPOINTMENT: (a) Appointment to the category mentioned in column (1) of the


table below shall be made by the method specified in the
corresponding entries in column (2) thereof.

of the post of Junior Architect; or

(ii) by direct recruitment; or

(iii) for special reasons, recruitment by transfer from


the Tamil Nadu Engineering Subordinate Service,
** or the Tamil Nadu Town Planning Subordinate
Service.

(b) Promotions in the service shall be made on grounds of merit and ability, seniority
being considered only where merit and ability are approximately equal.

(c) Notwithstanding anything contained in clause (14) of rule 2 in Part 1 of the Tamil
Nadu State and Subordinate Services Rules a member of this service, who
has completed five years of service, shall be eligible for appointment to any
other category in this service by direct recruitment.

3. Qualification: (a) Age: No person shall be eligible for appointment by direct


recruitment to the category mention in column (1) of the
Table below, if he has completed or will complete the age
specified in the corresponding entry in column (2) thereof
on the 1st day of July of the year in which the selection for
appointment is made.

and the qualifications specified in the corresponding entries in column (3) thereof.

qualifications mentioned in the Appendix to
these rules.

4. Reservation of Appointment: The rule of reservation of appointment (General


Rule 22) shall apply for appointment to the post of Assistant Architect by direct
recruitment.

5. Preparation of annual list of approved candidates: The crucial date on which a


person should be qualified for selection for appointment to the posts by promotion or by
recruitment by transfer shall be the 1st September of every year.

6. Probation: (a) Every person appointed to a category in the Service by direct


recruitment shall from the date on which he joins duty, be on probation for a total period
of two years on duty within a continuous period of three years.

(b) Every person appointed to a category in the service by recruitment


by transfer shall, from the date on which he joins duty, be on probation for a total period
of one year on duty within a continuous period of two years.

Provided that nothing contained in the rule shall adversely affect


the interest of any person holding any post under this service from 11 th October, 1972
till the date of issue of these rules viz., 11th November, 1986.

7. Training: Every person appointed as Chief Architect shall undergo the Foundational
Course B conducted by the Civil Services Training Institute, Bhavanisagar, and shall
pass the said test conducted by the said Institute at the end of the training. A pass in
the said test is a precondition for declaration of probation. The penalty for failure to
pass the test is stoppage of increment but such stoppage will not operate to postpone
future increments after the test has been passed. The period of training shall be treated
as duty for all purposes.

8. Leave, postings and transfers: The Chief Architect shall be competent to sanction
leave and to order the posting and transfer of Assistant Architect.

1. Degree of Bachelor in Architecture of any University or Institution recognised by


the University Grants Commission for the purpose of its grants.
2. National Diploma in Architecture awarded by the All-India Council for Technical
Education.
3. Degree of Bachelor of Architecture awarded by the Indian Institute of
Technology, Karagpur.
4. Five-year full time diploma in Architecture of the Sir J.J. School of Art, Bombay,
awarded after 1941.
5. Diploma in Architecture awarded by the State Board of Technical Education and
Training of the Government of Andhra Pradesh with effect from 1960.
6. Diploma in Architecture awarded by the Government College of Arts and
Architecture, Hyderabad, till 1959, subject to the condition that the candidates
concerned have subsequently passed a special final examination in Architecture
held by the State Board of Technical Education, Andhra Pradesh and obtained a
Special certificate.
7. Diploma in Architecture awarded by the University of Nagpur with effect from
1965 to the students trained at the Government Polytechnic, Nagpur.
8. Government Diploma in Architecture awarded by Government of Maharashtra.
9. Diploma in Architecture of Kala Bhavan Technical Institute, Baroda.
10. Diploma in Architecture awarded by the School of Architecture, Ahemedabad.
11. Membership of the Indian Institute of Architects.
12. Diploma in Architecture awarded by the University of Nagpur during the period of
1962 to 1964.

ORDER:

In the G.O. read above, the post of Chief Architect in the grade of
Superintending Engineer in the office of the Chief Architect, Madras, was
upgraded into that of Chief Engineer and he is allowed to draw the pay scale of
Chief Engineer. The Chief Architect, Madras has been subsequently made as
Head of Department in the G.O. second read above.

2. The Tamil Nadu Official Architects Association has represented


that consequent on the upgradation of the post of Chief Architect in the
Superintending Engineer into that of Chief Engineer, there is a gap between Chief
Architect, Madras (Chief Engineer’s grade) and Senior Architect (Executive
Engineer Grade) and this may be removed by reviving the then post of Chief
Architect in the Superintending Engineer grade which is kept in abeyance.

3. The Government have examined the request of the Tamil Nadu


Official Architects Association. As the permanent post of Chief Architect, Madras
in the grade of Superintending Engineer was upgraded in G.O. (Ms) No. 296, PW,
dated 13.2.84 and Thiru S. Murugesan was appointed as Chief Architect, the
question of reviving that post does not arise. The Government consider that in
between Chief Architect and Senior Architect one Superintending Engineer level
post is necessary to assist the Chief Architect, Madras. They have accordingly
decided that one of the four posts of Senior Architects in the Office of the Chief
Architect be upgraded and the post may be designated as Deputy Chief Architect,
Madras.

4. The Government accordingly, upgrade one of the permanent


posts of Senior Architect in the office of Chief Architect in the scale of Rs. 1800-
110-2900 to that of Deputy Chief Architect, Madras in the scale of Rs. 2500-125-
3375 for a period of one year from the date of filling up of the post or till the
necessity ceases whichever is earlier.

5. The holder of the Deputy Chief Architect, Madras shall exercise


the powers as that of Senior Deputy Chief Engineer (General) in the Office of the
Chief Engineer (General), P.W.D., Madras.

6. The incumbent will besides their pay draw also Dearness


Allowance, House Rent Allowance, City Compensatory Allowance and other
allowances the rates admissible under the orders in force.

7. The expenditure is debitable to “259A. Public Works – AA.


Direction and Administration and I. Non-Plan – AB. Chief Architect – 01. Salaries
“DP Code 259A AAAB 0101”.

8. Orders regarding “Ad-hoc Rules” governing the post will be


issued separately.

9. This order issues with the concurrence of Finance Department


vide its U.O. No. 4345/Fs/P/85, dated 10.12.1985.

ADHOC RULES RELATING TO TEMPORARY POST OF DEPUTY CHIEF ARCHITECT


IN ARCHITECTURAL BRANCH OF PUBLIC WORKS DEPARTMENT.

No. SRO B.41 / 88. – in exercise of the powers conferred by the proviso to
Article 309 of the Constitution of India, the Governor of Tamil Nadu hereby makes
the following rules. –
The rules hereby made shall be deemed to have come into force on the
13th January 1986.
RULES.

The general and special rules applicable to the holders of the permanent
posts in the Tamil Nadu Architect Service shall apply to the holder of the
temporary post of Deputy Chief Architect sanctioned from time to time in the
Architectural Branch of the Public Works Department subject to the modifications
specified in the following rules:–

2. Constitution – The post shall constitute a distinct category in the said


service.

3. Appointment – Appointment to the post shall be made:–

(a) by promotion from among the holders of the post of Senior Architect; or

(b) for special reasons by transfer from any other category; or

(c) by recruitment by transfer from any other service; or

(d) by direct recruitment.

4. (a) Age – No person shall be eligible for appointment by direct


recruitment to the post if he has completed or will complete the age of 45 years on
the first day of July of the year in which the selection for appointment is made.

(b) Other qualifications – No person shall be eligible for appointment


to the post by the method specified in column (1) of the table below, unless he
possesses the qualifications specified in the corresponding entry in column (2)
thereof.

6. Pay – There shall be paid the holder of the post a monthly pay
calculated in the scale of Rs. 2,500-125-3,375.

Act of the Central or State Legislature.
2. National Diploma (formerly All India Diploma) in Architecture awarded by the All

ORDER:
In the G.O. read above, the posts of Senior Deputy Chief Engineers
in Public Works Department and Highways Department who are second line
officers borne in category IT of Tamil Nadu Engineering Services and Tamil Nadu
Highways Engineering Service respectively have been redesignated as Joint
Chief Engineers.

2. The Chief Architect (i/c) in his letter read above has requested the
Government to redesignate the post of Deputy Chief Architect as he is the second
line officer borne on Category II of the Tamil Nadu Architect Service. The Chief
Architect has further stated that the Deputy Chief Architect has been delegated
with the powers as those of the Senior Deputy Chief Engineers in Public Works
Department who attends the meetings convened by the Secretaries to
Government and other Heads of Department.
3. The Government have examined the proposal of the Chief
Architect (i/c) in detail and have decided to accept the proposal of the Chief
Architect subject to the condition that there is no additional commitment to
Government.
4. The Government accordingly direct that the post of Deputy Chief
Architect in the office of the Chief Architect, Public Works Department borne on
category II of Tamil Nadu Architect Service be redesignated as Joint Chief
Architect with effect from the date of issue of this order subject to the condition
that no additional financial commitment arises out of this redesignation.

5. This order issues with the concurrence of the Finance


Department vide its U.O. No. 14552/PW/90, dt. 11.1.91 and U.O. No. 16281 /
PC.II /91-1, dt. 26.3.81 and the Personnel Administration Reforms Dept., (vide its
U.O. No. 5501 / Per.E / 91-1, dt. 8.2.91).

ORDER:

The following Notification will be published in the Tamil Nadu Government


Gazette.

NOTIFICATION

In exercise of the powers conferred by the proviso to Article 309 of the


Constitution of India, the Governor of Tamil Nadu hereby makes the following
amendments to the Special Rules for the Tamil Nadu Architect Service (Section
41 in Volume II of the Tamil Nadu Services Manual, 1969).

2 (i) Amendments (1) and (2) hereby made shall be deemed to have
come into force on the 11-th November 1986., and (ii) Amendment (3) hereby
made shall be deemed to have come into force on the 7-th March 1989.

AMENDMENTS

In the said Special Rules:

(i) in rule 2, in sub-rule (a), in the Table, for item (iii) in column (2)
against the entry “ 4. Asst. Architect” in column (1) thereof the
following item shall be substituted, namely:-

(ii) For special reasons, recruitment by transfer from the Tamil Nadu
Engineering Subordinate Service or the Tamil Nadu Town
Planning Subordinate Service”.

(2) in rule 3, in Sub-rule (b), in the Table, for the entires in columns (2)
and (3) against the entry

“4 Assistant Architect” in column (1), the following entries shall


respectively be substituted, namely:-

“ By direct : Must have experience in the preparation


recruitment. of Archirtectural Designs and Drawings
for a period of not less than two years.
By recruitment by :
transfer from the holders Must have served for a period of not
of the post of Junior- less that two years as Junior Architect in
Architect in the Tamil the Tamil Nadu General Subordinate

By recruitment by trans- : Must have experience for a period of not


fer from the TamilNadu less than five years in the preparation of
Engineering Subordinate Architectural Drawings in the Category of
Service of Tamil Nadu Special Grade Draughting Officer, Senior
Town planning Subordinate Draughting Officer, Draughting Officer or
Service. Junior Draughting Officer, of the Tamil-
Nadu Engineering Subordinate Service or
Architectural Assistant, Planning Assist-
ant Supervisor, Draftsman Grade II or III
in the Tamil Nadu Town Planning Sub-
ordinate Service.

Provided that in the case of recruitment


by transfer, it shall not be necessary
for members in the Tamil Nadu
Engineering Subordinate Service or the
Tamil Nadu Town Planning Subordinate
Service to acquire the experience speci-
fied under column(3) after acquiring one
of the qualifications mentioned in the
Appendix to these rules”

(3) for rule 8, the following rule shall be substituted, namely:-

“8. Leave, transfers and postings: The Chief Architect shall be competent to
sanction leave and to order the transfer and posting of Assistant Architect”

NOTIFICATION

In exercise of the powers conferred by the proviso to Article 309 of the


constitution of India, the Governor of Tamil Nadu hereby makes the following
amendment to the adhoc rules published with the Public Works Department
Notification No. SRO – B41/ 88, at pages 39 – 40 of part III – Section 1 (b) of
the Tamil Nadu Government Gazette, Dated the 9-th March 1988.

2. The amendment hereby made shall be deemed to have come into


force on the 15-th April 1991.

AMENDMENT

In the said Special Rules, in rule 1, for the words “ Deputy Chief
Architect”, the words “Joint Chief Architect” shall be substituted.
