The Construction & Demolition (C&D) Waste Management Rules, 2016,


issued by the Ministry of Environment and Forest, Government of India, vide
notification dated 29th march, 2016 stipulates guidelines for the urban local bodies
and the generators of construction and demolition waste. Among other
stipulations, the Rules mandate that the urban local bodies shall arrange for
collecting the waste, transport it to appropriate sites for processing and disposal
either through own resources or by appointing private operators.

2. The Rules (sub Rule 4 (1) specify that every waste generator shall prima-
facie be responsible for collection, segregation of concrete, soil and others and
storage of construction and demolition waste generated, as directed or notified by
the concerned local authority in consonance with these rules. The waste
generator is defined as any person or association of persons or institution,
residential and commercial establishments including Indian Railways, Airport,
Port, Harbor and Defence establishments who undertakes construction of or
demolition of any civil structure which generate construction and demolition
waste. The rules shall apply to every waste resulting from construction, re-
modeling, repair and demolition of any civil structure of individual or organization
or authority who generates construction and demolition waste such as building
materials, debris, rubble etc.,

3. The Rules (sub Rule 4 (1) require waste generators who generate more
than 20 tons or more in one day or 300 tons per project in a month shall
segregate the waste into four streams such as concrete, soil, steel, wood and
plastics, bricks and mortar and shall submit waste management plan and get
appropriate approvals from the local authority before starting construction or
demolition or remodeling work and keep the concerned authorities informed
regarding the relevant activities from the planning stage to the implementation
stage and this should be on project to project basis.

4. The Rules (sub Rule 4 (4) stipulate that every waste generator shall keep
the construction and demolition waste within the premise or get the waste
deposited at collection centre so made by the local body or handover it to the
authorized processing facilities of construction and demolition waste; and ensure
that there is no littering or deposition of construction and demolition waste so as
to prevent obstruction to the traffic or the public or drains.

5. The Rules (sub Rule 4 (5) further stipulate that every waste generator shall
pay relevant charges for collection, transportation, processing and disposal as
notified by the concerned authorities; Waste generators who generate more than
20 tons or more in one day or 300 tons per project in a month shall have to pay
for the processing and disposal of construction and demolition waste generated by
them, apart from the payment for storage, collection and transportation. The rate
shall be fixed by the concerned local authority or any other authority designated
by the State Government.

6. Schedule -I of the C&D Rules specify the criteria for storage, and processing
of recycling facilities. Schedule II prescribes application of materials made from
C&D waste.

7. In the service agreements with the waste management service providers for
residential cum commercial work packages as entered into as per GO Ms. NO 279
dated 31.12.2015, the Service Providers are required to ‘collect Construction &
Demolition (C&D) debris, silt, inert, loose stones, and such other material from
the residential and commercial areas at their source points as and when the
Authority directs to do so with prior intimation. This waste shall be transported
and deposited at the designated places as intimated by the Authority from time-
to-time

8. In this context, ULBs are required to carry out the following activities.
a) Set up C&D waste collection center(s) within the ULB jurisdiction with
facility to temporarily store C&D waste in five segregated categories. viz: 1)
concrete; 2) soil; 3) steel; 4)wood & plastics; 5) bricks and mortar. This
facility shall have adequate capacity to hold the C&D waste generated in
the city till such time, the waste is transported to a full-fledged C&D waste
processing or recycling facility. The processing or recycling facility may be
set up in the ULB or on a cluster basis based on technical and financial
viability.
b) Set up a call center facility in the ULB / grievance cell with an identified
phone number to help waste generators register their requests in person
for lifting the C&D waste from their premises. Upon the registration the
waste generators shall be given a time slot at which the waste will be
collected at their premises. They will be charged user fee, using the challan
system, at the rate of Rs. 250/- per ton of C&D waste on prorate basis.
c) Put in place a system to communicate to the Waste Management
Service Providers, to collect the waste at the communicated times and
deposit the waste at the C&D waste collection center(s).
d) The Waste Management Service Providers who transport the waste
shall be paid tipping fee at a negotiated price on per ton basis.

9. A Model Notification is annexed to this order for notification by the ULBs,


after following due procedure.

10. The Director of Municipal Administration, AP, Guntur is requested to take


further necessary action in the matter.

Construction and Demolition Waste Management Rules 2016, as notified


on 29th March, 2016, by the Ministry of Environment, Forest and Climate
Change, New Delhi, Government of India

Notification on handling of Construction and Demolition waste in the


jurisdiction of _________________________ Municipal Area

As per the Construction and Demolition Waste Management Rules


2016 as notified on 29th March,2016, by the Ministry of Environment, Forest and
Climate Change, New Delhi, Government of India, the following procedures and
practices will be adopted in the ________________________ municipal
jurisdiction area.

1. Any person or association of persons or institution, residential and commercial


establishments including Indian Railways, Airport, Port and Harbour and Defence
establishments who undertakes construction of or demolition of any civil structure
which generate construction and demolition waste is considered the waste
generator and shall abide by the rules as given below.

2. Every waste generator shall keep the construction and demolition waste within
the premise and handover the waste to the ULB authorised waste collector and
strictly desist from indiscriminately throwing the debris on the roads, street,
public places and drains. So doing is a punishable offence and the defaulters will
be charged with fines ranging from Rs.___ to Rs._____ based on the quantities
and types of waste indiscriminately thrown.

3. __________________ (ULB name) provides the service of collecting the C&D


waste at the premises of the waste generator. The waste generator is required to
approach the call center set up for this purpose in the ULB office (Tel
No._________ ) and register a request for collecting and transporting the waste
to designated processing facilities and pay up the indicated user fee through a
challan in the ULB office. There upon, the ULB nominated transporter will visit
your premises and collect the debris on the given date and time. Till such time
the waste generator is required to store the waste within one’s premises. After
the lifting is done, it is the responsibility of the waste generator to clean up the
place.

4. However, the waste generators who generate more than 20 tons or more in
one day or 300 tons per project in a month shall:

a) Submit a waste management plan to the ULB PH section on project to


project basis and obtain their approval in writing.

b) The plan should be submitted indicating the relevant activities of


segregation of the C&D waste into concrete, soil, steel, wood and
plastics, bricks and mortar, storage of the materials inside the premises
and final disposal plan of processing them.
c) Ensure to deposit the waste deposited by own means, at the C&D waste
collection center, notified by the ULB and make the notified payment to
the ULB for the storage, processing and disposal purposes.

d) Alternatively, hand over the waste at the processing facility as notified


by the ULB and make the notified payment for processing and disposal
purposes.

e) Waste generator shall ensure that the C&D waste does not get mixed up
with other wet or recyclable dry waste and does not get indiscriminately
littered on roads, streets, waterbodies, parks, empty lands, low lying
areas, and such other public places.
