1. Unlocking of Difficulties
a. Veto- official power or right to refuse, to accept or allow something even if most of
the other people or organizations involved approve of it
- a power vested in a chief executive to prevent permanently or temporarily the
enactment of measures passed by a legislature
b. Bicameral- (of a legislative body) having two branches or chambers.
c. Term of office- the time when a person holds a job or position of authority
especially in the government
d. Legislature- a body of persons having the power to legislate, specifically, an
organized body having the authority to make laws
e. Oversee- supervise a person or their work especially in an official capacity
f. Jurisdiction- official power to make legal decisions and judgments
g. Discretion- the quality of behaving or speaking in such a way as to avoid causing
offence or revealing confidential information
-the freedom to decide what should be done in a particular situation
h. Certiorari- issues for the correction of errors of jurisdiction only or grave abuse of
discretion amounting to lack or excess of jurisdiction
i. Mandamus- plain, speedy, and adequate legal remedy in the ordinary courts of law
j. Quo Warranto- is a writ or order, a legal proceeding during which an individual’s
right to hold an office or governmental privilege is challenged
k. Habeas Corpus- a Latin word, a legal action or writ by means of which detainees
can seek relief from unlawful imprisonment

2. Lecture and Discussion


The Philippines is a republic with a
presidential form of government wherein
power is equally divided among its three
branches. First, let’s talk about the
Legislative Branch. Do you have an idea on
what is legislative branch? Yes, _______?

Ma’am, legislative branch is authorized to


make laws.
That’s right! Legislative branch was
provided to make laws, alter and repeal
them through the power vested in the
Philippine Congress. What exactly are laws?
Yes, ______?
Ma’am, laws are rules that are created
and enforced through social or
governmental institutions to regulate
behavior.

Very Good! Laws are rules or written


enactments of the legislature governing
relations of the people among themselves
or between them and the government and
its agencies through them, the legislature
defines it as the rights and duties of the
citizens.

Here in the Philippines, we follow Bicameral


form of Legislature. Under a Bicameral
System, the Congress is composed of two
houses. And what are those two houses?

Ma’am, Senate and House of


Representatives.
Alright, thank you! The Senate and House
of Representatives. These two bodies are
responsible for writing and passing bills.
The Senate is the upper chamber of the
congress and it is composed of 24 senators.
What is the term office of senators?
Yes, ________?
Ma’am, the term of office of senators is
six years.

Very Good! Their term of office is six years


and shall commence unless otherwise
provided by law. They can be re-elected but
may not run for more than two consecutive
terms. Will you read the qualifications to
become a Senator? Yes, _________?

The qualifications to become a Senator


are: Natural-born citizen of the
Philippines, at least 35 years old, able to
read and write, Philippine resident of not
less than two years from the day of
election and a registered voter.

senator unless he is a natural-born citizen
of the Philippines, at least 35 years of age,
able to read and write, a registered voter
and a resident of the Philippines for not less
than two years immediately preceding the
day of the election.

Let’s proceed to another chamber of the


Congress which is the House of
Representatives. Will you read ________. House of Representatives is the lower
chamber of the Congress and shall be
composed of not more than 250
members. The term of office is 3 years
with a maximum of 3 consecutive terms.

Alright! The House of Representative is


composed of not more than 250 members
unless otherwise fixed by law, who are
elected from districts apportioned among
the provinces, cities, and the Metropolitan
Manila area and those who are elected
through a party-list system of registered
national, regional, and sectoral parties or
organizations. Member of the House of
Representatives shall be elected for a term
of 3 years. No members of the House of

committee for review. The committee meets
to discuss, amend and vote on the bill. If
approved, the bill procedes to the full
senate for further discussions, amendments
and voting. Bills must be passed through

president. A conference committee made of
both chambers meets to resolve any
difference between the House and Senate
versions of the Bill. Both Chambers vote on
final bill. President vetoes the bill and sends
it back to congress. The Veto can be
overridden by the Congress with a 2/3 vote.
The President signs the bill and becomes a
law. Once a bill has been enacted into law, None Ma’am
it is called an Act or a statute.

cases and decides if laws violate the
constitution. It holds the power to settle
controversies involving rights that are
legally demandable and enforceable and to
determine whether or not there has been a
grave abuse of discretion amounting to lack
or excess of jurisdiction on the part of any
branch or instrumentality of the
government.

and legal assistance to the underprivileged.
Sixth, power to appoint court personnel;
they can appoint all officials and employees
of the Judiciary in accordance with the Civil
Service Law.

Now, these are the qualifications as


Justice of Supreme Court. He or She must
be a natural-born Filipino, at least 40 years
old, served at least 15 years as Judge of
Lower Court or engaged in the practice of
law in the Philippines. He must also be a
person of proven competence, integrity,
probity, and independence. Mandatory
retirement is imposed upon reaching the
age of 70 as provided in Section 11 of the
Constitution.
And these are the qualifications for the
Lower Courts Judges. He must be a Filipino
Citizen (except judges of collegiate courts),
at least 35 years old for Regional Trial Court of Appeals is composed of one
Court; 30 years old for Lower Courts, and a Presiding Justice and 68 Associate
member of IBP for 10 years in RTC and 5 Justices, all of which are appointed by
