Terms and Conditions

Following states the Terms and Conditions (“Terms”) under which you may use
FURUNO ECDIS CBT (Computer Based Training) services including, training
applications, certification and registration of your personal data, receive online
support. Please read these Terms carefully. By using the FURUNO ECDIS CBT,
you accept and agree to be bound, without limitation or qualification, by these
Terms. FURUNO may, at its sole discretion, modify or revise these Terms at any
time by updating this posting. You are bound by any such modification or
revision and should therefore visit this page periodically to review the Terms.

Registration
In order to gain access to the FURUNO ECDIS CBT, you will be required to
register on the FURUNO ECDIS CBT. You will be required to enter your
username, password and private information including your name, date of
birth, nationality ("Individual Information") before entering the FURUNO ECDIS
CBT. You may not share your Individual Information with any third party. The
entered data will be stored in the database of the FURUNO ECDIS CBT and you
will be able to view the information, but it is not possible to modify or delete
data. In case you request to delete data, you have to contact the system
administrator in FURUNO JAPAN (FURUNOCBT@furuno.co.jp). The stored data
is not made available to any third party by FURUNO.
It is possible for national maritime authorities, vetting societies and port state
control officials to access the database for verification of validity of any
certificate provided through the FURUNO ECDIS CBT. However, such
verification will only be available as confirmation, that a certificate has the
specific combination of a certificate number and the individual’s name.

Use of FURUNO ECDIS CBT and Confidentiality

Except as required by law, regulation, legal process, or similar process,
FURUNO and its officers, directors, employees, agents, and affiliated
companies shall keep strictly secret and confidential and shall not, without the
express prior written consent from you, disclose or divulge to any third party
or use Individual Information, at any time, for any purpose other than in
relation to this Terms of this Agreement.

FURUNO authorizes you to use the FURUNO ECDIS CBT under the purchase
contract with your employer and to receive the type specific training and the
relevant certificate upon completion of the training course and the assessment.
You acknowledge that the FURUNO ECDIS CBT application and it’s content are
the sole and exclusive property of FURUNO and are protected under
international intellectual property laws and treaties.
You agree not to decompile, disassemble, modify, reverse assemble or reverse
engineer the hardware and software provided as part of the FURUNO ECDIS
CBT.

Copyright
The copyright in all materials posted to FURUNO ECDIS CBT is held by FURUNO.
None of the materials or software may be copied, reproduced, distributed,
republished, downloaded, displayed, posted or transmitted in any form or by
any means, including but not limited to, electronic, mechanical, photocopying,
recording, or otherwise, without the prior written permission of FURUNO or the
copyright owner.

FURUNO’s Liability
Any use of the FURUNO ECDIS CBT is at your own risk. Changes are periodically
made to the FURUNO ECDIS CBT and may be made at any time.

FURUNO DOES NOT WARRANT THAT THE FURUNO ECDIS CBT WILL OPERATE
ERROR-FREE AT ALL TIMES.
FURUNO ECDIS CBT IS PROVIDED ON AN ‘AS IS’ BASIS WITHOUT ANY
WARRANTIES OF ANY KIND. FURUNO TO THE FULLEST EXTENT PERMITTED BY
LAW, DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE
WARRANTY OF MERCHANTABILITY, NON-INFRINGEMENT OF PROPRIETARY OR
THIRD PARTY RIGHTS, AND THE WARRANTY OF FITNESS FOR PARTICULAR
PURPOSE.

Disclaimer of Certain Damages

IN NO EVENT SHALL FURUNO OR ITS SUBSIDIARIES AFFILIATED COMPANIES,
OFFICERS, DIRECTORS OR EMPLOYEES BE LIABLE FOR ANY DAMAGES
WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, INCIDENTAL, EXEMPLARY, AND
CONSEQUENTIAL DAMAGES, LOST PROFITS, OR DAMAGES RESULTING FROM LOST
DATA OR BUSINESS INTERRUPTION) RESULTING FROM THE USE OR INABILITY TO
USE THE NAVSKILLS CAT, WHETHER BASED ON WARRANTY CONTRACT, TORT, OR
ANY OTHER LEGAL THEORY, AND WHETHER OR NOT FURUNO IS ADVISED OF THE
POSSIBILITY OF SUCH DAMAGES. SOME STATES DO NOT ALLOW THE EXCLUSION
OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE
LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU, IN WHICH CASE SUCH
EXCLUSION OR LIMITATION APPLIES TO THE FULLEST EXTENT ALLOWABLE
UNDER THE APPLICABLE LAW.

General
All legal issues arising from or related to the use of FURUNO ECDIS CBT shall be
construed in accordance with and determined by the laws of Japan. By using
this FURUNO ECDIS CBT, you agree that the exclusive forum for any claims or
causes of action arising out of your use of this FURUNO ECDIS CBT is Japan
District Court.
If any provision of this Agreement is found to be invalid by any court having
competent jurisdiction, the invalidity of such provision shall not affect the
validity of the remaining provisions of this Agreement, which shall remain in
full force and effect. No waiver of any term hereof shall be deemed a further
or continuing waiver of such term or any other term. Any changes to this
Agreement must be made in writing, signed by an authorized representative of
FURUNO.

If you violate any of these Terms, your permission to use the FURUNO ECDIS
CBT automatically terminates.
