FINAL EXAMINATIONS

INSTRUCTIONS

A. This Questionnaire contains 2 pages. Check and make sure that your

Questionnaire as you answer the questions.
B. Read each question very carefully and write your answers in your
Examination Notebook in the same order of the questions. Answer the
essay questions legibly, clearly and concisely. Write your answers only on
the front of every page of your Notebook.
C. Start every number on a separate page, but an answer to a sub-question
under the same number may be written continuously on the same page
and on the immediately succeeding pages until the answer is complete.
D. A mere “Yes” or “No” answer without any corresponding explanation or
discussion will not be given full credit. Thus, always briefly but fully
explain your answers although the question does not expressly ask for an
explanation. Do not rewrite or repeat the question on your answer
notebook.

QUESTIONS

1. Define Law in its strict sense. (5 points)

2. Distinguish construction from interpretation in statutory construction.

3. Atty. Juan graduated from law school as class valedictorian in 1990. A year
after, he took the bar and passed. Thereafter, he was admitted to the Bar and
was hired by a multi-national company dealing with private funds and
investments. He was hired as an associate in the legal department and in a
short period of time raise his way up to the top becoming the manager in said
department. As a manager he negotiated contracts and advised the company
on legal and commercial matters. On June 2019 he resigned and accepted the
appointment from the President of the Republic to head the COMELEC. A
petition was filed against his appointment, claiming among others that he did
not practice law, being one of the requirements to be COMELEC chairman. Is
Atty. Juan engaged in the practice of law? (10 points)

4. State whether the following marital unions are valid, void, or voidable and give
a short justifications for your answer:

a. Michael and Marissa’s marriage wherein Michael was afflicted with

AIDS prior to the marriage. (3 points)

 b. Carlos who married Manuela immediately the day after obtaining a
judicial decree annulling his prior marriage to Judith. (3 points)
c. Marriage of Lloyd and Teresa who did not secure a marriage license
prior to their wedding, but lived together as husband and wife for 6
years without any legal impediment to marry. (3 points)
d. Marriage of Albert and Janet who are both 17 years of age at the time of
their marriage and who secured parental consent. (3 points)
e. Marriage of Bruno and Mars immediately a day after Mars obtained a
judicial decree of legal separation of her marriage with husband Anton.
(3 points)

5. Amancio sells his car to Bernabe and they executed a Deed of Absolute Sale to
evidence the same. On the day before the delivery, Bernabe died. Celso, the
son of Bernabe approached and asked you if he can compel Amancio to
deliver the car to him. What would be your advice? (10 points)

6. Garry is obliged to deliver to Rachel his 2014 Toyota Corolla car with plate
number G0082. Before Garry can deliver, a lightning struck the car causing it
to explode.

a. Is the obligation of Garry to deliver the said car extinguished? (5 points)

b. Distinguish suspensive and resolutory conditions. (5 points)

7. Lucas authorized Milagros through a Special Power of Attorney to sell his

parcel of land. On June 12, 2019, Milagros entered into a contract of sale with
MBA Enterprises. On the other hand, without his knowledge of the contract
Milagros entered, Lucas sold the same property to Isidro on June 15, 2019.
Which of the two sale should be preferred? If Isidro registered the property
first to his name would your answer be the same? (10 points)

8. A, through an oral agreement, authorized B to sell his parcel of land to secure

an obligation he incurred. B sold the property to C.

a. Is the contract of sale valid? (5 points)

b. If however, B mortgage the property. What is the status of the
mortgage? (5 points)

9. Mrs. Robinsons executed a notarial will. The execution was made in

accordance with all the formalities necessary for its validity. On the eve of her
birthday, she announced to her five children that she is revoking the will. The
five children in chorus disagreed saying that the will was executed in
accordance with law, therefore cannot be revoked without their consent. Is the
contention of Mrs. Robinson’s children valid? (10 points)

10. A group of young lawyers led by Atty. Magtanggol initiated a petition to

revise the Constitution by changing the current Presidential Bicameral to
Federal form of government. They were able to gather 15% of the total number
of registered voters as signatories. Of the 15%, all legislative districts were
represented by 3% signatories of the registered voters therein. Is the petition
to revise the Constitution valid? (10 points)
