RE: Final vote tally, absentee and recanvass process in NY-25

With the recanvass process already underway and as counties across the 25th congressional
district begin to tally the thousands of absentee ballots that were cast, voters in New York should
expect to see two things materialize over the next few weeks. First, and just like we’ve seen since
Election Day, there will be swings in the vote totals reported on a day to day basis, and the
swings will go in every direction. Second, but most importantly, is any vote totals reported before
every absentee ballot is counted are grossly incomplete and premature, particularly before ballots
in Onondaga County are counted. We're confident that Congressman Maffei will be declared the
winner in this election once the full process is completed.

Any unbiased observer of New York elections understands that swings in vote totals take place
during the recanvassing process; these swings are both normal and expected because of errors
that occur during the initial reporting process on Election Day. However, in a race as close as
this one, the vote totals during the recanvass are deficient until absentees are counted. The final
vote count that will determine a winner will only be confirmed once every absentee ballot is
counted.

Officials will begin counting absentee ballots today (November 10) in Cayuga County, followed by
Monroe County on November 12th, Wayne County on November 15th, and finally, Onondaga
County on November 17th. During the early stages of this process, the Buerkle campaign
expects to see their vote margin increase. Cayuga, Monroe, and Wayne County broke strongly
for Buerkle’s campaign on Election Day and there’s no reason to expect otherwise from absentee
ballots in these historically Republican areas. However, the vote in Onondaga County makes up
both the largest percentage of the electorate in the 25th district and Maffei won Onondaga County
by eight percent on election night. Congressman Maffei’s strong support across Onondaga
County will erase whatever gains Buerkle made in other parts of the district once all the votes are
counted.

While the media has responsibility to report the daily developments during the recanvass and
tallying of absentee ballots, they also have a responsibility to characterize the early steps in this
process accordingly. Until Onondaga County absentee ballots are counted, the vote totals that
will be reported on a daily basis will be incomplete and premature. They are not accurate
indicators of what the final count will be once all qualified absentee ballots are counted. We’re
confident that Congressman Maffei will be declared the winner in this race once all legitimate
ballots are counted.
