Deed Agreement to sale

THIS DEED OF AGREEMENT TO SALE EXECUTED ON THIS SECOND DAY OF MAY


TWO THOUSAND EIGHTEEN (02.05.2018) AT PATNA

Between

AB, S/o. CD, aged about 60, Hindu by religion, Indian by nationality, Business by profession
present and permanent resident of CNLU Campus, Nyaya Nagar, Mithapur, Patna-800001, Bihar
herein after called the vendor (First Party)

And

EF, S/o. QR aged about 55, Hindu by religion, Indian by nationality, Business by profession
present and permanent resident of ABC Street, near Mithapur Bus stand, Patna-800001, Bihar
herein after called the purchaser (second Party)

WHEREAS the first party(vendor) is the absolute owner of the property more fully set out in the
schedule hereunder and
WHEREAS it is agreed that the first party shall sell and the second party shall purchase the said
property for a sum of Rs. 1,00.000 (Rupees One Lakh) only free of all encumbrances.

NOW THIS AGREEMENT OF SALE WITNESSES AS UNDER:

1. The purchaser has paid to the vendor on this day a sum of Rs. 5000 (Rupees five
thousand) only by way of earnest money for the due performance of the agreement, the
receipt whereof the vendor do hereby admit and acknowledge.

2. The time for performance of the agreement shall be within 2 months from the date hereof
and it is agreed that the time agreed herein for performance shall be of the essence of this
agreement.

3. The purchaser shall pay to the vendor the sale price of Rs. 1,00,000 (Rupees One Lakh)
before the registration of the conveyance deed.

4. The vendor agrees that he will deliver the vacant possession of the property to the
purchaser on the day of registration of the conveyance deed.

5. The vendor hereby agreed to execute the conveyance deed in favour of the purchaser or
his nominee as purchaser may if directs in that regard.

6. The vendor agreed to hand over all the title deeds of the property to the purchaser within
ten day from the date of this agreement for verification of title. The purchaser hereby
agreed to intimate the vendor about the approval of title within 7 days after delivering the
title deed to him.
7. If the vendor’s title to the property is not approved by the purchaser, the vendor hereby
agreed to refund the earnest money received by him under the agreement and on failure
of the vendor to refund the same within 7 days, he shall be liable to repay the same with
interest thereon @ 10% per annum.

8. If the purchaser commits a breach of the agreement, he shall forfeit the earnest money of
Rs.5000 (Rupees Five Thousand) paid by him to the vendor.

9. If the vendor commits a breach of the agreement, the vendor shall not only refund to the
purchaser the sum of Rs.5000 (Rupees Five Thousand) received by him as earnest
money, but shall also pay to the purchaser an equal sum by way of liquidated damages.

10. Nothing contained in paras 8 and 9 above shall prejudice the rights of the parties hereto
for this specific performance of this agreement of sale/purchase.

THE VENDOR AND PURCHASER HAVE SET THEIR RESPECTIVE HANDS TO THE
AGREEMENT on this day written above and in the presence of following witnesses
