Every year,
we fund over
50,000 funerals,
serve over
2,800 funeral homes,
and pay out over
$350 million for
funerals.
We must be doing it right.
Admittedly, the stats are pretty impressive. No other insurance assignment
company can boast the number of funeral homes served or the amount of
money paid out yearly to make sure every funeral goes off without a hitch.
But what’s truly impressive is the way in which we work with our clients, as if
each one is our only one. And serving them quickly and painlessly is our only
job, which, in fact, is so. While bigger isn’t always better, sometimes it is. As in

I would be remiss if I didn’t add a
comment on the topic of when you use a
settlement release agreement. The easy
answer is “always.” However, we all know
that it is not always practical or advisable
to get a release signed, so I’ll list some
items to consider which can help in your
decision-making.
First, are you really giving them
anything in consideration? Many times,
families are upset, and the business is
just giving them a refund. Arguably you
aren’t giving them anything in this case
and, as stated above, a release with no
consideration is not enforceable. However,
anytime you do give more than they
originally had/paid for, a release agreement
is probably warranted.
Second, consider if you actually did
anything wrong. As stated above, we
always deny any wrongdoing, but what
about a situation where you truly made
no mistake. If the family just didn’t like
the services, for example, and wants their
money back, I am not sure a release is
warranted.
Third, consider the parties involved. If
there is an attorney involved, it’s always
easier to get a settlement agreement. If
insurance is involved, it is also equally
easier to get a settlement agreement. It is
more difficult when it is just a family and
your business. If you are looking for ways
to get a settlement agreement in these
cases, consider telling the family that you
had to talk to your attorney, and he asked
for a settlement release to be executed. It’s
always easier to blame the attorney.

It remains to be seen whether the bill will be

Conclusion:

This is a budding area of the law which
differs greatly between jurisdictions. But,
three things appear to be certain, at least
for now:
(1) cannabis continues to be illegal in
all circumstances under federal law;
(2) employers are not required to
tolerate cannabis use at work, regardless
of the reason, nor are they required to
permit employees to work while under its
influence; and
(3) much as with alcohol and tobacco,
most employers—there are exceptions—
are not required to involve themselves
with employees’ offsite cannabis use,
medicinal or not, though they may be
permitted to do so.
Therefore, the best way to avoid liability
in this rapidly changing area of the law is for
employers who are not in highly regulated
industries to treat the issue like alcohol or
tobacco use and simply leave employees to
their own (de)vices unless doing so results in
a concrete detriment to the business.
To be blunt, employers who mind
their own business tend to be sued less
frequently than those who do not.
In any event, employers must realize
that the legalization of recreational and
medicinal marijuana presents uncertainty
in terms of hiring, drug testing, discipline
and providing reasonable accommodations.
Navigating these laws is a high-stakes
affair, and doing so should be a joint effort
between employers and their counsel. r

In the world of the cemetery and the
funeral home, sometimes it seems to us
that things have piled up so high there
is just no way of getting out from under.
Add to this stress the stark reality that
people never have and never will die
by appointment, and the weight of our
profession can easily become a grand
burden, causing procrastination to sneak
in. And when procrastination sneaks in, the
consequences are rarely good.

Tackling procrastination
The best approach I have found in dealing
with my temptation to procrastinate is
to first honestly admit that I am human,
I have good days and bad days, and
recognize the temptation to procrastinate is
within my power to influence. I remember
the negative consequences when I did
procrastinate, and decide I don’t want a
repeat of that, so I grit my teeth and do
this: I pick the thing that’s most important
to do, no matter how boring or unpleasant,
and simply begin doing it.
In time, I am finished, and I am so relieved
and happy that when I can turn to doing
something I really love, the experience is all
the more enjoyable and positive. This is not
utopian thinking, it truly works.
I have found that by just digging in,
I feel better, and I then discover that the
horrible, boring and hideous job I have to
do turns out to be not nearly as bad as I
thought it would be.
Here is an example. Without question,
right now my most tedious, boring,
wearisome, repetitive, unvarying, mind-
numbing, soul-destroying and dreary
responsibility is filling out continuing
education forms for the state.
There, I’ve said it. The interesting part
of this confession is that I am the director of
continuing education at the college. It is my
job. Filing continuing education verification
attendance forms is part of my job, and it is
one of the most brain-numbing things I do.
But I well understand that if I procrastinate
in completing these forms, the consequences
are not good. In fact, the consequences for
