AND DOMINADOR YORSUA
FROM CLOA NO. 0080218

MOTION FOR RECONSIDERATION

COMES NOW the petitioner by the undersigned counsel and within

the reglementary period prescribed by the Rules of Court hereby files this
motion for reconsideration from the judgment of rendered by the Regional
Director of Department of Agrarian Reform CARAGA Region XIII in
accordance with the field investigation report of the Provincial Agrarian
Reform Officer which was subsequently affirmed by the Honorable Regional
Director on the decision dated July 12, 2007, received by the Legal Division
to wit:

“This resolution treats of the 13 separate

recommendations/resolutions issued by the DARPO
Agusan del Sur, for—

The deletion of the names of Joel Penalosa

and Dominador Yorsua from CLOA No. 0080218,
covering parcel of land situated in Hubang,
Poblacion, Bunawan, Agusan del Sur, with an
area of 106, 540 square meters.”

While this Office will not pose objection to the subject
recommendations/resolutions of the DARPO Agusan del
Sur, particularly in matters involving findings of facts xxx”

That the recommendation of DARPO Agusan del Sur affirmed by the

Honorable Director states the deletion of the names of Joel Penalosa and
Dominador Yorsua from CLOA No. 0080218.
 That in the aforementioned CLOA, there is no Joel Penalosa but Joel
Peñaloga named as the agrarian reform beneficiary prior to the current order
of deletion therefrom.

That there is a clear commission of clerical error on the decision

affirming the recommendation of DARPO naming Joel Penalosa, instead of
Joel Peñaloga as the name to be deleted from the subject CLOA.

That there is a need to modify the Resolution rendered by the

Honorable Regional Director dated July 12, 2007 so that the present order
to delete the aformentioned person from the CLOA will be in accordance to
the present law, and to justice and equity.

WHEREFORE, premises considered, it is most respectfully prayed

before this Honorable Office that a Decision dated July 12, 2007 will be
modified and another decision be rendered ordering the deletion of the
names of Joel Peñaloga, instead of Joel Penalosa, and Dominador Yorsua
from CLOA No. 0080218, covering parcel of land situated in Hubang,
Poblacion, Bunawan, Agusan del Sur, with an area of 106, 540 square
meters.

Petitioner prays for such other just and equitable relief under the
premises.
