COME NOW, Defendant/Intervenor, Wilmington Trust N.A. as Trustee for MFRA Trust
2014-l (ooTrustee", 'oDefendant", or "Intervenor") and Defendant Fay Servicing, LLC ("Fay" or
'oDefendant") (collectively "Defendants") and file the following Motion for Summary Judgment
against all claims of Plaintiff James Michael Gregston ("Plaintiff') and on Trustee's Petition in
Intervention for a Judgment Authorizing Foreclosure and would respectfully show as follows:
1. Plaintiff has filed this his most recent lawsuit to stall foreclosure despite the fact
that he does not deny being in default on his contractual payment obligations under a Texas
Home Equity Loan. Amazingly, Plaintiff is past due for the January l,2010loan payment and
(the "Note") in favor of original lender Option One Mortgage Corporation ("Option One"). See
Exhibit 1-4. On the same date, Plaintiff executed a deed of trust (the "Deed of Trust")
establishing a first lien on the Property. See Exhibit 1-8. The Deed of Trust memorialized that
real property was to serve as first lien collateral. That real property collateral located at 2703

in which he acknowledged under oath that the loan complied with all applicable provisions of the
Extension of Credit in which he acknowledged timely receiving the required Texas Home Equity

Specialty Mortgage, LLC FKA V/M Specialty Mortgage,LLC ("JPMC"). See Exhibit 1-8.

obligations under the Note, Notice of Default was sent to Plaintiff informing of him of his
payment defaults and the amount required to cure his contractual payment obligations. See
Exhibit 1-G. Plaintiff has remained in default on their payment obligations since that time. See
Exhibit 1.

9. Trustee is the curent mortgagee for the subject loan. Fay is the current Mortgage
Servicer and Attorney-in-Fact for Trustee. See Exhibits 1-E and 1-F . Plaintiff remains in default
on his payment obligations under the Note and is past due for the January 1, 2010 payment and
be 5445,235.82, and per diem interest continues to accrue in the amount of $49.33 per day. See
Exhibit 1-J.
10. Plaintiff has asserted a variety of claims seeking to avoid his contractual
obligations under the subject loan including a claim that the morlgage violates certain provisions
of the Texas Constitution and that enforcement of the loan is precluded by the statute of
limitations. As will be shown, these slaims fail under both no-evidence and traditional standards
for motion for summary judgment and Trustee is entitled to judgment authorizing it to foreclose
herein by reference.

STANDARD OF REYIEW
genuine issue as to any material fact and the moving party is entitled to a judgment as a matter of
law . . . ." TEX. R. Crv. P. i66a(c). The purpose of summary judgment is to provide a speedy
means for the disposition of controversies and/or issues that do not present fact issues. See New
Jersey Bank, N,A. v. Knuckley,637 S.V/.2 d g20, g2I-22 (Tex. 1982). A defendant moving
for summary judgment must either (1) disprove at least one essential element of the plaintiff s
causes o.f action as a matter of law or (2) plead and conclusively establish
each essential element of an afÍirmative defense. See Doe v. Boys Clt¿bs of Greater Dallas,
lnc.,907 S.W.2d 472, 476-77 (Tex. 1995). Once a movant establishes its right to summary
judgment, the burden shifts to the non-movant to respond to the motion for summary judgment
and present to the trial court any issues that would preclude summary judgment. City of Houston
12. Additionally, Rule l66a(i) of the Texas Rules of Civil Procedure permits a party
to move for summary judgment on the ground that there is no evidence to support one or mote
essential elements of a claim on which the adverse party would have the burden of proof at trial.
As to such a oono evidence" summary judgment motion, "lt]he court must grant the motion unless
the respondent produces summary judgment evidence raising a genuine issue of material fact,"
1998, no writ). Unlike a movant for traditional summary ìudgment, a movant for a no-evidence
summary judgment does not bear the burden of establishing a right to judgment by proving each
claim or defense. See McCombs v, Children's Med. Ctr,, 7 S.W.3d 256, 258 (Tex. App.-
Texarkana 1999, no writ); Greenv. Brantley, 11 S,W,3d259,262 (Tex. App.-Fort V/orth 1999,
which the same legal sufficiency standard of review is applied. See Fiesta Mart, Inc., 979
S.W.2d at 70. The present matter is set for trial on the one week docket beginning April 16,
2018, and this matter is therefore ripe for both a traditional and no-evidence summary judgment.
13. Plaintiff contends, without evidence, that the payment obligations under the
subject mortgage were accelerated on January 1,2010 and that foreclosure is precluded by the
acceleration date. Plaintiff fails to address the faot that even if the payment obligations were
accelerated in 2010, acceleration of the payment obligations were legally abandoned within the
four year period following the alleged acceleration date when Trustee sent a new notice of
default allowing borrower to reinstate the loan upon payment of the arrearages. See Exhibit 1-G.
As established by Defendants, any acceleration of the loan in 2010 was abandoned onMay 2I,
2013 when a Notice of Default was sent to Plaintiff by which he was afforded the opportunity to
pay the then reinstatement amount. See Exhibit 1-G; See NSZ Prop. Holdings, LLC v.
2017),review denied (Jan. 5,2018); see also Grahamv, LNV Corp., No. 03-16-00235-CV,2016
Bank Ass'n,807 F.3d 99, 106 (5th Cir. 2015) ("lender waives its earlier acceleration when it
'put[s] the debtor on notice of its abandonment ... by requesting payment on less than the full
amount of the loan."') (quoting Leonardv, Ocwen Loan Servicing, L.L.C.,616 F. App'x 677,680
14. It has been the law of Texas since 1901 that the parties can abandon acceleration
and restore the contract to its original terms by the parties' agreement or actions. San Antonio
Real-Estøte, Bldg. Ass'n v. Stewart, g4 Tex.44I,6I S.V/. 386, 388 (1901). Abandoning
acceleration before the limitations period expires restores the contract to its original condition,
including the note's original maturity date. Khanv. GBAK Props, Inc.,37l S.V/.3d 347,353
(Tex. App.-Houston [1't Dist.] 2012, no pet.); Holy Cross,44 S,V/.3d at 567; Clawson v. GMAC
Mortg., LLC, 2013 WL 1948128, at *3 (S.D.Tex. May 9,2013), Thus, if a noteholder abandons
acceleration, it no ionger must foreclose or sue to foreclose within four years from the date of
acceleration.
15. Hete, Plaintiff contends that the payment obligations under the Note were
accelerated on or about January 1,2010. The 2013 Notice of Default sent to Plaintiff constituted
abandonment of acceleration and restored the original maturity date under the Note. See Exhibit
1-C. Therefore even though there is no evidence to support Plaintiffls statute of limitations
claim or defense even if his allegations were accepted as evidence, such claim fails since any

relating to home equity lending despite executing a sworn affidavit acknowledging that the Loan
was in compliance with all such provisions and despite having executed other specific
documents that directly negate his claims. The violations alleged by Plaintiff are:

(iÐ The loan must not have closed before 12 days after the original loan
application was submitted to the lender or before 12 days after the
borrower received notice that the loan was governed by the Texas
Constitution (Tex. Const. art XVI, $ 50(aX6XMXi));
(iiÐ The loan must have provided that borrowers would receive a copy of the
final loan application and all executed documents at closing (Tex. Const.
art XVI, $ 50(aX6XÐ(v));
17. First, Plaintiff has not and cannot come forward with any evidence to support any
of the three alleged violations alleged above in (i) through (iii); therefore Defendants are entitled
