CONSTRUCTION CONTRACT

This contract is made between the Builder and the Client.

That, MR. GUILLIERMO AṄES , henceforth known as "Builder," and BULAK ELEMENTARY
SCHOOL, represented by QUEENIE E. BUTALID, the School Principal, henceforth known as
"Client," are entering into this contract this 19th day of February, 2019, for the purposes of
establishing the provisions of the construction of Feeding Center located at Bulak Elementary
School, Bulak, Dauin Negros Oriental.

Whereas, the client agrees to the estimate provided by the Builder on, with the following
specifications as provided in the Individual Project Program of Work:

Total amount of construction materials: Php 59,063.00

Labor Cost 30% of the total amount of construction materials: 17,718.90

Whereas, pursuant to the estimate, and the specification listed above, the Builder, Mr.
GUILLIERMO AṄES, agrees that he will be constructing a FEEDING CENTER according
to the specification in the perspective and program of work for BULAK ELEMENTARY
SCHOOL DAUIN DISTRICT.

Whereas, the client agrees to pay Builder according to the following plan:

a. No. of days to construct: 20 days

b. Wage for labor will be given every 5 working days amounting to 4,429.73 prorated in four
tranches.

Whereas, the client agrees that if payment is not made according to the above plan,
Builder has the right to stop all work until such time as payments have been brought
current.

Whereas, the client understands that if changes are necessary during the course of
construction, the Builder will provide the Client with a change order, and the Client using
other sources of funds outside the donated amount from the donor will be responsible
for the additional incurred costs of the agreed upon changes. As mutually agreed in
advance by written order by all parties.

Whereas, the builder will be responsible for all materials and equipment necessary for
the completion of the job, which the Builder agrees were included in the estimate, or
were added with the changes listed above.

Whereas, the builder agrees that construction will begin on March 4, 2019 and that the
builder will work eight hours a day, or some other schedule with a completion on
completion date on March 25, 2019.
Whereas, the builder agrees that any delays and/or changes not agreed to in this
document must be discussed with Client before work is to continue.
Whereas, the builder may use subcontractors should he choose, with the understanding
that payment to the subcontractors is the sole responsibility of the Builder.

Whereas, the builder agrees that he will remove all debris, equipment, materials, etc.
from the location upon completion of the construction.

Invalidity or unenforceability of one or more provisions of this agreement shall not affect
any other provision of this agreement.

This contract is subject to the laws and regulations of Bulak Elementary School, Dauin
District.
