MEMORANDUM OF DEPOSIT OF TITLE DEEDS

This Memorandum made on this the 21st day of June 2019 at Chilakaluripet by
and between:

SHAIK ABDUL RAZAK, S/O. Shaik Kalam, aged about 32 Years residing of Door
No.9-7, Pasumarru Village, Chilakaluripet(m), Guntur District. Aadhar card No: 6554
9018 4411

(HEREINAFTER jointly and/severally referred to as “BORROWERS” which


expression shall, unless it be repugnant to the context or meaning thereof,deem to
include their legal heirs, successors and assigns) of the one part

AND
HDB Financial Services Limited, a company incorporated under the Companies
Act, 1956 and having its registered office at Ground Floor, Madhusudhan Estate,
Pandurang Budhakar Marg, Lower Parel- Mumbai 400013, hereinafter referred to as
“HDBFSL”. Represented by Mr. Pasupuleti Srinivasarao S/o. Hariprasadarao,
aged 42 Years, Aadhar No: 289108902469 & Pan No:APE995007R, currently
working as Branch Manager, HDBFSL, D.No.5-87-89, 3rd Floor, Anusri Plaza
Lakshmipuram main road, Guntur – 522007.

(HEREINAFTER referred to as “BARROWEE”, which expression shall unless it be


repugnant to the context or meaning thereof be deemed to include its executors,
legal representatives, assigns) of the other part.

WHEREAS the Borrowers/s have requested the Borrowee for a loan of Rs.
2,50,000/-(Rupees Two Lakhs Fifty Thousand Only) and at the request of the
Borrower the Borrowee has sanctioned/ granted loan to the Borrowers under a loan
agreement dated 20-06-2019. As a security for the said loan, the Borrowers have
offered Equitable Mortgage by deposit of Title Deeds and documents which are
more particularly described in the Second Schedule hereunder written in respect of
the property bearing at R.S.No.390/D1, D.No.6-106, Pasumarru Village,
Chilakaluripet Mandal, Guntur District.

(Hereinafter referred to as “The said property” the detailed description of , which is


given in the First Schedule written hereunder.)

1. AND WHEREAS with intent to create a security by way of equitable


mortgage by deposit of title deeds of the said property, the Borrowers have
agreed to secure the repayment of the said loan with interest thereon in the
manner agreed to by and between the parties hereto and also on several
terms and conditions mentioned in the loan agreement dated 20-06-2019.
executed by and between the Borrower and Borrowee.
2. AND WHEREAS the Borrowers have already deposited with the Borrowee,
HDB Financial Services Limited office at D.No.5-87-89, 3rd Floor, Anusri
Plaza Lakshmipuram main road, Guntur – 522007.The title deeds and the
documents, more particularly described in the Second Schedule hereunder
written relating to the said property, more particularly described in the First
Schedule hereunder written and belonging to the Borrowers with intent that
the same will be equitably charged as security to the Borrowee for the loan
(More particularly described in the Third Schedule) granted / sanctioned to
the Borrowers.

3. AND WHEREAS the Borrowers have agreed to record the oral completed
transaction of the equitable Mortgage by deposit of the title deeds and
documents, more particularly described in the Second Schedule hereunder
written and belonging to / pertaining to the Borrowers. The Borrower Cum
Mortgagor keep this property with his respected possession.

NOW THIS MEMORANDUM WITNESSETH AND RECORDS AS FOLLOWS

1. The Borrowers declare and record that the title deeds and documents and
writings comprised in the Second Schedule hereunder written relating to the
said property, more particularly described in the First Schedule hereunder
written, had been deposited by the Borrowers with the Borrowee HDB
Financial Services Limited office at D.No.5-87-89, 3rd Floor, Anusri Plaza
Lakshmipuram main road, Guntur – 522007.On 20-06-2019. as and by way of
equitable mortgage by deposit of title deeds and documents for securing the
loan granted/sanctioned by the Borrowee to the Borrowers, repayable with
interest and for all costs, charges and expenses incurred / charged by the
Borrowee in connection therewith.

2. The Borrowers further declare and record that the title deeds and documents
and writings comprising in the Second Schedule hereunder written relating to
the said property, more particularly described in the First Schedule accepted
by the Borrowee HDB Financial Services Limited at their office at Guntur are
the only documents of the title to the said property and that the same are not
previously deposited with any person whatsoever. The Borrowers also declare
that, the said property is not mortgaged to any other Bank, party, company or
any person/s. The Borrowers further declare and confirm that they are the sole
and absolute owners of the said property.

THE ABOVE TWO SCHEDULES REFERRED TO

LOAN SANCTIONED to Mr. Shaik Abdul Razak and shaik kaishma of


Rs.2,50,000/- (Rupees Two Lakhs Fifty thousand Only) subject to the terms and
conditions clearly mentioned in the Loan Agreement dated 20-06-2019.

In WITNESS WHEREOF the Borrower and the Borrowee have here unto set and
subscribed their hands on the Day, Month and Year herein above written.
