Check List for Reconstitution In Line With Revised Policy Guidelines for Reconstituiton Dated 21.05.2018
Brief History of the case : 1. M/s India Petroleum is our "B" site Retail Outlet at Jamnagar City in Jamnagar
district. The RO was last reconstituted in 1985.At present, Mr. Krishnakumarsinhji and Mr. Yogesh Ghelani
are the partners. Mr. Krishnakumarsinhji has expired and Mr. Yogesh Ghelani is looking after the firm. The
monthly avg sale of the RO is 100 KL MS and 42 KL HSD.
2. Now, lone partner Yogesh Ghelani has decided to retire from this dealership firm. In view of this, Mr.
Amardeepsinh Raysinhji Gohil and Mr. Mahipal Pruthvisinh Jadeja will join this dealership firm on
partnership basis with equal share in firm.

9 General conditions of reconstitution
Whether all incoming proprietor / partner(s) are fulfilling all the basic requirement of becoming a dealer on

9.2 However, relaxation on age and education can be considred in the following cases:
Relaxation on age can be considered in favour of legal heirs/ family member (as per prevalent dealer
selection guidelines) in case of request for reconstituion arising out of death/ incapacitation of the dealer.
(i)
DRSM can approve such relaxation. In the event of legal heir being minor (below 18 years of age), the local
guardian shall operate the dealership till legal heir becomes a major. NA
Relaxation on educational qualification can be considered in favour of legal heirs/ family member (as per
prevalent dealer selection guidelines) in case of request for reconstituion arising out of death/
(ii)
incapacitation of the dealer. DRSM can approve such relaxation. However, the candidate should be able to
read, write and count. NA
In other cases, depending upon merit, relaxation on educational qualificational qualification can be

considered and approved by State Head. NA

Multiple dealership norm (Dealership commissioned before the multiple dealership norms came into

10.1 Processing Fees (DD NO. and Date) Non Refundable application processing fees of Rs 25000/ - for
reconstituion will be payable along with the application in all cases except (a) In cases where reconstituion 513983
is arising out of death/ incapacitation of a proprietor, parner/s and incoming partner/s proposes to hold the DATED
same share in partnership as was with the deceased. (b) Delaership belonging to SC/ST and other Corpus 22.01.2019
Fund category. However, in cases involving induction of outsdie category partner in SC/ST dealership, no For Rs.
exemption will be given. 25000/-
