MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This MEMORANDUM OF AGREEMENT is made and entered into by and between.

WEST VISAYAS STATE UNIVERSITY, a state-owned higher education institution existing under
Philippine laws and govern by its own charter with principal office address at Luna Street, La Paz, Iloilo City,
represented herein by its President, LUIS M. SOROLLA JR., hereinafter referred to as the ”UNIVERSITY”

AND

DEPARTMENT OF SCIENCE AND TECHNOLOGY (DOST) a government agency recognized under


Philippine laws with principal business address at Magsaysay Village, La Paz, Iloilo City, represented herein by
its Regional , MECHELLE ACERO PALMA, M.D., AMD hereinafter referred to as the “PARTNER
INSTITUTION”

WITNESSETH

WHEREAS, the UNIVERSITY is offering Senior High School Program that requires Work Immersion
Program in order to adequately expose its students to actual work situations and enable them to enhance their
knowledge, skills, work attitudes and values;

WHEREAS, the PARTNER INSTITUTION has the facilities and/or expertise to provide occupational
experience to Senior High School students to enhance their competence in their chosen field of endeavor;

WHEREAS, the duration of the Work Immersion Program shall be Eighty (80) hours unless otherwise
extended for causes and upon mutual agreement of both parties;

WHEREAS, the PARTIES understand that the Work Immersion Program shall not create any employer-
employee relationship between the partner institution and the Senior High School students;

NOW, THEREFORE, for and in consideration of the foregoing premises, the PARTIES have mutually
agreed to enter into this Memorandum of Agreement for Work Immersion Program, based on the following
terms and conditions:

A. The UNIVERSITY shall:

1. Identify, recommend and endorse the names of student who will undergo work immersion in the
PARTNER INSTITUTION;

2. In coordination with the partner institution, prepare and monitor the schedule of activities/experiences
during Work Immersion by conducting supervisory and instructional visits/follow-up on site;

3. Evaluate the progress of Senior High School students and discuss problems with the partner institution;

4. Provide basic orientation of Senior High School students concerning the purpose of the Work
Immersion Program, observance of work values and attitudes while undergoing work immersion and
the observance of confidentiality of trade secrets of the partner institution;

5. Hear complaints, recommend and/or cause the transfer and/or withdrawal of Senior High School
student who is found to misbehave and/or act in defiance to existing standards, rules and regulations
of the PARTNER INSTITUTION and to impose appropriate sanctions to the Senior High School
student(s) concerned; and

6. Orient Senior High School student(s) that any and all liabilities for damage to property and/or injury to
third persons caused by their intentional or negligent acts while in the course of Work Immersion
Program shall be their personal liability, to the exclusion of the UNIVERSITY and the PARTNER
INSTITUTION.

B. The PARTNER INSTITUTION shall:

1. Allow Senior High School students recommended by the UNIVERSITY to enter into its premises and
ensure them of a safe and conducive working environment;

2. In coordination with the UNIVERSITY, provide and/or expose them to varied work experiences and/or
activities;

3. Orient Senior High School students on the policies, rules and regulations to be observed in the entire
duration of the Work Immersion Program and report any infraction and/or violation thereof to the Senior
High School Coordinator of the UNIVERSITY;

4. Submit to the UNIVERSITY evaluation/assessment report concerning the work performance of Senior
High School students at the end of the Work Immersion Program; and

5. May grant allowance and/or adequate accident insurance to Senior High School students in accordance
with their existing policies.

C. MISCELLANEOUS PROVISIONS

1. The list of Senior High School students that will undergo work immersion in the partner institution as
determined by the duly-designated representative of the University, personal data sheet as well as
other papers and/or documents that may be signed by the Senior High School students including but
not limited to the policies, rules and regulations to be observed in the duration of the training shall
automatically become integral parts of this agreement;

2. This MOA is deemed in force and in effect wherever the list of Senior High School students is endorsed
by the FIRST PARTY and accepted by the SECOND PARTY as evidenced by the signature of BOTH
PARTIES or their duly authorized representative;

3. It is understood that this Memorandum of Agreement shall continuously remain valid and effective until
mutually revoked and/or terminated by the parties. In the unlikely event that no Senior High School
students may undergo Work Immersion Program in the partner institution for a particular period and
upon written advice by the representative of the University, this agreement is deemed suspended and
will be automatically resumed upon written advice of the University together with the submission of the
Names of the Senior High School students and other attached documents and duly approved and
signed by the Partner Institution;

4. Any and all liabilities for damage to property and/or injury to third persons caused by the intentional or
negligent acts of the Senior High School students while in the course of work immersion shall be their
personal liability, to the exclusion of the UNIVERSITY and the PARTNER INSTITUTION;

5. The termination and/or revocation of this Memorandum of Agreement shall be upon written notice by
either of the parties at least thirty (30) days prior to actual termination and/or revocation. Provided,
however, that Senior High School students who are undergoing their work immersion shall be allowed
to complete the required number of hours as stipulated in this agreement.
