                    ORDER

As per the Government Order read as 1st  paper above administrative sanction was 
accorded to the KSEB for the implementation of the Thottiyar HEP (40MW). As per the 
Government   Order   read   as   2nd  paper   above  permission     was   given   to   the   Kerala   State 
Electricity   Board   to   pay   ex­gratia   inclusive   of   the   value   of   improvements   to   those 
unauthorized occupants of Revenue land who are in possession of land for more than 30 
years   and   unauthorized   occupants   before   1.1.77   of   forest   lands   taken   over   after 
Government of India's Ministry of Environment and Forest (MOEF) clearance, as project 
area   for   the   five   hydel   projects   (viz.   Thottiyar,   Mankulam,   Sengulam   Augmentation, 
Sengulam Tailrace SHEP, & Perumthenaruvi SHEP) on the conditions specified therein.
2) As per Government order read as 3rd paper above, Government have amended the 
condition   No.(ii)   in   the   G.O.(MS)   No.16/09/PD   dated   26.11.09   to   the   effect   that   the 
possession of other land by the occupants of forest land is not a bar for allowing ex­gratia 
payment.
3)  The  Member  (Generation),  KSEB,  vide  his  letter  read  as   4 rd  paper  above,  has 
sought   for   Government   approval   for   the   payment   of   ex­gratia   amount   of   Rs.2,34,610/­ 
(Rupees Two lakh Thirty four thousand six hundred and ten only) for 0.0766 Ha of forest 
land under private possession of one land holder, Smt. Saly Baby. 
4) Government have examined the matter in detail and are pleased to accord sanction 
to the KSEB for the payment of an exgratia amount of Rs.2,34,610/­ (Rupees Two lakh 
Thirty four thousand six hundred and ten only) for taking over of 0.0766 Ha (18.93 cents) 
of encroached forest land in sy No.161/1­4,161/1­17 for the implementation of Thottiyar 
Hydro Electric Project.
