MEMORANDUM OF UNDERSTANDING

KNOW ALL MEN BY THESE PRESENTS:

This Memorandum of Understanding (MOU) is made and entered into, on this


24th day of ]uly 2015 in Quezon Clty,by and between:

The DEPARTMENT OF SCIENCE AND TECHNOLOGY, an executive


deparhment of the Philippine Government, existing by virfue of Executive
Order No. 128 series of 1987, with principal office address at Gen. Santos
Avenue, Bicutaru Taguig City, represented by its Secretary, MARIO G.
MONTEIO, herein referred to as the'DOST;'

and

The DEPARTMENT OF THE INTERIOR AND LOCAL


GOVERNMENT, an executive department of the Philippine Government,
existing by virtue of Republic Act No. 6975, with principal office address
at DILG-NAPOLCOM Center, EDSA corner Quezon Avenue, Quezon
City, represented herein by its Secretary, MANUEL A. ROXAS II, herein
referred to asthe "DILG/'

and

duly registered with the Securities and Exchange CommissiorL with

-WITNESSETH -

WHEREAS,under Executive Order No. 47 series of


2011, theDOST exercises
poliry, technical and administrative supervision over the Information and
Communications Technology Office (ICTOffice) the office mandated by law to ensure
the establishment of an efficient and effective information and communications
technology infrastructure that will support transparent and a e

governanceparticularlyin the speedy and efficient enforcement of rules, as well asthe
delivery of accessible public services to the people;

WHEREAS, DILG is the government department mandated to strengthen the


capabilities of local government units ("LGUs" for brevity), to improve their
performance in governance, administratiory social and economic development as well
as enable them to effectively and efficiently deliver services to their constituents;

WHEREAS, theDOST, through theICT Office, DILGand tMP (collectively


referred to as "Parties")intend to pave the way for the setting up of Intemet connectivity
at the LGUlevel;

WHEREAS, the Parties agreed to collaborate and effect a positive impact on the
use of the Intemet;

WHEREAS, the Free Wi-Fi Internet Access in Public Places project targets to
provide Internet connectivity in municipalities covering Class 3, 4, 5, and 6 and in
public places such as Public Schools, Libraries, Hospitals, Rural Health Units, Police
Stations, State Universities and Colleges, Public Transport Terminals, Seaports and
Airports;

WHEREAS, the Parties have agreed in principle to cooperate and jointly commit
in promoting community development though the use of information and
communications technology for effective and efficient governance in the country,
particularly through Internet connectivity;

NOW THEREFORE, for and in consideration of the above premises, the Parties
have mutually reached the following understanding:

L I. PURPOSE OF THE MOU

1.1The purpose of this MOU is to establish a framework of cooperation between the


Parties to provide lnternet connectivity down to the Local Government Level.

II. UNDERSTANDING OF THE PARTIES

{ 2.1 The Parties understand that they share the common goal of implementing the Free
Wi-Fi Internet Access in Public Places project;

2.2 The Parties acknovfledge that proper coordination between the parties shall be made
to ensure the success of the projec!

III. RESPONSIBILITIES OF THE PARTTQ.T

3.1 The responsibilities of DOST, through the ICT Office, under this MOU shall be as
follows:

3.1.1 Conduct the appropriate training and orientation to the LGUs;

3.1,.2 Support and assist the LGU in the initial implementation of the project;

3.1.3 Evaluate and conduct periodic monitoring of the Internet connectivity

3.2 The responsibilities of DILG under this MOU shall be as follows:

3.2.1,. Hamessing the support of the LGUs in the project of DOST-ICTOffice which
shall be undertakery but not necessarily limited, to the following:

a) Encourage the LGUs to extend their full cooperation and support to the
project, such as by incorporating infrastructure capacity building in their
development plans;

b) Allow DOST-ICT Office to have access in public and such other pertinent
places for the purpose of carrying out the project;

c) Provide the appropriate securitlz to DOST-ICT Office personnel and other


DOST-ICT Office authorized persons and entities involved in the project;

d) Extend such assistance as may be necessary in the course of project


establishment, operations and implementation. This include the need to
facilitate the deployment, installation and/or temporary storage of equipment
and other property needed for the project;

e) Provide necessary and free administrative support, permits andlor licenses;

0 Such other responsibilities as may be agreed upon from time to time by the
Parties.

3.2.2 Advocate with the LGUs the importance of Internet connectivity in their respective
areas, and in the performance of their functions and responsibilities.

3.3 The responsibilities of LMP under this MOU shall be as follows:

3.3.1 To support and assist the DILG and the DOST-ICT Office in the successful
implementation of the projec! and
3-3.2 To assist ih the coordination and monitoring of the project to ensure its
effective and efficient implementation particularly on issues of connectivity.

IV. AMENDMENTS

At any time while this MOU is in effect, the Parties may modify, revise or amend in
writing the existing terms and conditions or requirements of this MOU as circumstances
may warrant. Any modificatiory revision or amendment hereto shall become valid and
binding only when the same is in writing and signed by all Parties.

The Parties may formulate and promulgate such implementing rules and regulations as
may be appropriate and allowed under existing laws and policies.

IN WITNESS WHEREOF, the Parties have signed this MOU in the place and on
the date first above written.
