A RESOLUTION DECLARING THAT, AFTER REVIEW, BARANGAY
SINGKAMAS ORDINANCE NO. 1 SERIES OF 2016 ENTITLED AS “AN
ORDINANCE APPROVING THE REVERSION OF FUND AMOUNTING TO
ONE MILLION PESOS (Php 1,000,000) FROM THE UNUSED CAPITAL
OUTLAY FUND OF BARANGAY SINGKAMAS ANNUAL BUDGET 2015 TO
THE UNAPPROPRIATED SURPLUS OF THE GENERAL FUND”, IS IN
CONFORMITY WITH EXISTING LAWS, RULES AND REGULATIONS.

WHEREAS, Section 10(a)(1) of R.A. 7854, otherwise known as the Charter of the
City of Makati, provides that the Sangguniang Panlungsod shall: “Review all
ordinances approved by the sangguniang barangay and executive orders issued by
the punong barangay to determine whether these are within the scope of the
prescribed powers of the sanggunian and the punong barangay”;

WHEREAS, the Honorable Members of the Committees on Laws, Rules, and Ethics
and Barangay Affairs, headed by its respective Chairpersons, had undertaken an
extensive review of the reversion of fund amounting to One Million Pesos
(Php 1,000,000) from the Unused Capital Outlay Fund of Barangay Singkamas
Annual Budget 2015 to the Unappropriated Surplus of the General Fund;

WHEREAS, after review, Barangay Singkamas had been declared to be in conformity
with the mandated requirements pursuant to Section 322, otherwise known as the
Local Government Code of 1991, which states that:

SEC. 322. Reversion of Unexpended Balances of Appropriations,
Continuing Appropriation. – Unexpended balances of appropriations
authorized in the annual appropriations ordinance shall revert to the
unappropriated surplus of the general fund at the end of the fiscal year
and shall not thereafter be available for the expenditure except by
subsequent enactment. However, appropriations for capital outlays shall
continue and remain valid until fully spent, reverted or the project is
completed. Reversions of continuing appropriations shall not be allowed
unless obligations therefor have been fully paid or otherwise settled.

NOW, THEREFORE, BE IT RESOLVED, AS IT IS HEREBY RESOLVED BY THE
SANGGUNIANG PANLUNGSOD OF MAKATI, METRO MANILA, BY VIRTUE OF THE
POWERS VESTED IN IT BY LAW, IN SESSION ASSEMBLED, to declare that, after
review, Barangay Singkamas Ordinance No. 1 Series of 2016 entitled as “An
Ordinance Approving the Reversion of Fund amounting to One Million Pesos
(Php 1,000,000.00) from the Unused Capital Outlay Fund of Barangay Singkamas
Annual Budget 2015 to the Unappropriated Surplus of the General Fund”, is in
conformity with existing laws, rules and regulations.

Let copies of this Resolution be furnished the Sangguniang Barangay of Barangay
Singkamas and other concerned offices for their information, guidance and
reference.

This Resolution shall take effect immediately upon its approval.
