ASSIGNMENT: ASSIGNMENT 6/CHAPTER 6 CRIMINAL LAW
PURPOSE OF THE ASSIGNMENT: to teach us about crimes committed to certain
groups and to teach us about our defenses of person etc.

A. People v. farell

Facts: white collar crime of theft of a trade secret loss of 2.5m. whether theft applies to property other
than money, trade secrets.

Courts Response: The judgment of the Court of Appeal is reversed

Legal concept: white-collar crime

How Is It Applied: if a white collar crime of theft applies to theft of property other than money.

Reason: it was reversed because theft applies to what is known as monetary property.

B. State v. Kelm

Facts: secured a 6k loan from ms. Williams. She was given her reimbursement check and it was
uncollectible. It showed her account wasn’t on file and had been negative balance from feb 10 – march
8.

Courts Response: The jury verdict is affirmed

Legal concept: bad checks

How Is It Applied: this person wrote a bad check to repay the loaner back and it showed they’ve had
negative money basically since it was created.

Reason: it basically says that post-dated checks are still required to have knowledge of your balance
when they are cashed.

C. State of South Dakota v. Morse

Facts: claimed he could do the work for 5k in 5 weeks. Claimed he was going to go above and beyond
and showed them his exceptional work. he ended up having a bunch of problems with the piping and
mysteriously quit working. He was over paid y roughly 1k. licensed plumber came and showed them all
the faulty work he did. Indicted for grand theft by deception.

Courts Response: Judgment reversed.

Legal concept: false pretenses

How Is It Applied: he made claims to be able to do professional work and made a set time and price
which he wasn’t able to accomplish.

Reason: due to there not being much evidence that he intended to defraud them he shouldn’t be
charged.

Question 5: in our country, we have strong regulations for protections of criminals. we have a lot of
steps in place to try and help people from getting convicted of crimes. We have amendments in place to
help prevent unjustly abuse against the people of our country. for example, not being able to search a
car without probable cause is a great amendment because otherwise, cops would be searching
everyone and a lot of people would get in trouble despite them having a real reason to get searched.

it's important to me because i would never do anything to wrong someone and i would be very hurt if
someone was trying to tell me i was.
