CASE REPORT

CASE : Violation of Section 11 of RA 9165

(Comprehensive Dangerous Act of 2002)

SUSPECT : Pedro Santos, 25 years old, single, a resident

of Baliwasan, Zamboanga City

COMPLAINANT : PO1 Juan Cruz, single, bonafide member of the

Philippine National Police and presently
assigned at ZCPS 11, Central, Zamboanga City

At about 5:00 in the afternoon of October 20, 2018, members of Station Drug
Enforcement Team (SDET) led by PCINSP CONCORDIO PROCOPIO, Station
Commander, ZCPS 11, Central, conducted buy bust operation particularly at Chico
Drive, Baliwasan, this city which resulted to the arrest of PEDRO SANTOS, 25 years
old, single and a resident of Baliwasan, this city. Confiscated from his possession and
control during the buy bust operation were the following: Ten (10) pieces heat sealed
transparent plastic sachets containing white crystalline substance believed to be
“Shabu” with initial markings JC-1, 10-20-18 TO JC-10, 10-20-18 and one (1) piece
One hundred peso bill marked money with initial markings JC-11, 10-20-18 and with
serial number FN222333. The said operation was coordinated with PDEA9 with
coordination numbers 30006-102018-005. This report was officially registered under
Incident Record Form (IRF) No. 2018-1020 and subsequently referred to the
undersigned investigator on case.

Investigation conducted and disclosed that an information received from a civilian

Informant (CI) that a certain PEDRO, a male person is rampantly selling illegal drugs
(Shabu) at Barangay Baliwasan particularly at Chico drive, this city. Acting on the said
report, PCINSP CONCORDIO PROCOPIO, Station Commander, ZCPS 11, Central
conducted a briefing with members of the Station Drug Enforcement Team (SDET) in
the conference room of the said station. During the said briefing PO3 Berto Masigasig
was designated to act as the Arresting Officer and PO1 Juan Cruz was designated to
act as the Poseur Buyer which subsequently the Station Commander handed him One
(1) piece One hundred peso bill marked money bearing the above-mentioned serial
number and a bundle of bond papers cut into money bill sizes that were enclosed in a
window envelope to make the bundle appear like real P10, 000.00 wherein the real
money is placed on top that is visible thru the window of the envelope and the agreed
pre-arranged signal was that, the poseur buyer will light up a piece of cigarette by
using a lighter after the transaction has been consummated and that the designated
arresting officer PO3 Berto Masigasig will rush towards the subject and effect the
arrest. After the briefing the Station Commander made a coordination with the
Barangay Official of Barangay Baliwasan and Media representatives.

On the same date, the operating team proceeded to the target area of operation,
while thereat, transaction ensued between PO1 Juan Cruz and Pedro, the latter asked
for the money so PO1 Juan Cruz gave him the window envelope, when Pedro saw the
real money thru the window envelope, he received the envelope and placed it inside
his right pocket then gave the sachet of Shabu worth P10,000.00 and immediately
after PO1 Juan Cruz light up a piece of cigarette using a lighter that signals that the
transaction was completed and for the arresting officer PO3 Berto Masigasig to rush
towards the subject and effect the arrest. Body searched follows and the recovered
and confiscated items from the possession and control of the subject were properly
marked, inventoried and photograph in compliance with the Implementing Rules and
regulation (IRR) of Para 1, Section 21 of RA 9165 of the Comprehensive Dangerous
Act of 2002 then later conducted to ZCPS 11, central for proper booking.

Moreover, the seized items (Shabu) were properly turned-over to the investigator
on case PO3 Abe B Cede and counter marked his initials as ABC-AA to ABC-JJ on the
buy bust item and ABC-1 to the marked money, then later the Poseur Buyer and the
Arresting Officer accompanied the undersigned investigator on case for the
submission of confiscated illegal drugs at the RCLO9 for qualitative and quantitative
laboratory examination. Likewise all items/documents were indicated in the forwarding
report to be submitted to the City Prosecutor’s Office to form part as exhibit.
