Abstract (Abstract)

Pluralism in Indonesian’s population describes that the country of Indonesia is a rich country, has diversity of tribes, races, religions and
customs. This becomes a national’s wealth potential. It is undeniable, that most people in Indonesia are still very strong in the customs that develop
in the community, it can also be contrary to the positive law that applies in Indonesia. But some of the laws in Indonesia also reflect on customary
law, for example in creating Undang-Undang No. 5 year 1960 concerning Basic Regulations on Agrarian Principles, this regulation still highly
upholds traditional values. In the Republic of Indonesia State Constitution Article 18B paragraph (2), it shows that customary law still has existence
in the rule of law in Indonesia. One of the indigenous peoples that still exists in Indonesia is the Dayak tribe in the Arut Utara District, Kotawaringin
Barat District. Kotawaringin regency is one of the regencies in Central Kalimantan Province. The district capital is located in Pangkalan Bun.
Regional elections in 2017 are increasingly encouraging the government to always do development and support the progress and prosperity of the
people of West Kotawaringin. The development is also inseparable from the investments made to support the source of income for West
Kotawaringin District. But still, with the development involving many of these sectors, still in question whether the local wisdom of the Dayak
tribe of North Arut subdistrict will still exist or eroded by the presence of elements outside of the customary culture of the Dayak tribe. The
development that will continue to be carried out by the government of West Kotawaringin Regency is expected to synergize with the local wisdom
of the Dayak tribe, so that the original values of this nation will not be eroded by civilization.
