 CONDIZIONI DI GARANZIA CONVENZIONALE
In seguito saranno denominati semplicemente
“Produttore” la N.S.M. S.p.a. con sede legale in Via Rossana 7,
12026 Piasco (CN) ITALY; “Bene” l’arpa oggetto della presente;
“Consumatore” il soggetto finale che compra il bene oggetto
della presente allo scopo di utilizzarlo per la sua funzione propria;
“Venditore” il soggetto che effettua la vendita al Consumatore,
indicato sul presente certificato; “Centro di Assistenza” il soggetto
autorizzato dal Produttore ad effettuare interventi di riparazione sul
bene oggetto del presente certificato.
La presente Garanzia Convenzionale non sostituisce quella
spettante per legge al Consumatore sulla base della Convenzione di
Vienna del 1980, della Direttiva 1999/44/CE e della legislazione con
la quale la nazione del Consumatore ne ha effettuato il recepimento.
Art. 1 • Oggetto
Costituisce oggetto della Garanzia Convenzionale il Bene
regolarmente registrato, entro 30 giorni, sulla pagina web di
Registrazione Garanzia Salvi warranty.salviharps.com. Sono coperti
da garanzia i difetti di fabbricazione, compresi quelli estetici, la
cui origine è imputabile al Produttore, che compromettano l’uso
normale o professionale del bene. Sono completamente a carico
del Produttore tutti i costi relativi alla riparazione del bene, i materiali
e la manodopera.
Art. 2 •0Condizioni di applicabilità
La Garanzia Convenzionale verrà riconosciuta solo se l’acquisto
della vostra nuova arpa sarà stata registrata entro 30 giorni dalla
data di acquisto, sulla pagina web di Registrazione Garanzia Salvi
warranty.salviharps.com. La Garanzia Convenzionale è applicabile
solo alle vendite di nuovi prodotti, e solo al consumatore finale in
possesso di un documento comprovante l’acquisto, in cui siano
riportati chiaramente il nome del rivenditore, la data di acquisto,
e i dettagli del prodotto. La riparazione del bene verrà effettuata
dal Produttore o da un Centro di Assistenza, nei limiti di tempo
compatibili con le esigenze organizzative di questi. Gli interventi in
garanzia verranno effettuati esclusivamente da tecnici autorizzati,
su richiesta del Consumatore al Centro di Assistenza o al Produttore.
Art. 3 •0Esclusioni e limitazioni
Qualunque intervento di manutenzione o riparazione eseguito da
parte di soggetti non autorizzati dal Produttore farà decadere questa
garanzia.
Nell’ambito della Garanzia Convenzionale il Produttore non risponde
di eventuali danni causati a persone o cose o di eventuali mancati
guadagni imputabili al mancato funzionamento, ad avaria o forzata
sospensione d’uso del bene.
Non sono inoltre coperti da Garanzia Convenzionale:
• la manutenzione del bene, intendendo per tale le periodiche
operazioni di revisione e registrazione (in questo caso
verranno addebitati al Consumatore gli oneri relativi alla
manodopera, ai materiali quali ad esempio, corde e pezzi di
ricambio ed i costi di trasporto/trasferta sostenuti per poter
effettuare intervento);
• difetti causati da trascuratezza, negligenza, manomissione,
incapacità d’uso e la conservazione del bene in luoghi con
temperatura diversa da 20° C ± 10° C o umidità relativa diversa
da 50% ± 15%;
• difetti causati dall’esposizione a fonti di calore o alla luce diretta
del sole;
• gli interventi non autorizzati dal Produttore;
• eventuali alterazioni estetiche dovute al naturale invecchiamento
del legno.
Art. 4 •0Durata
La presente Garanzia Convenzionale ha durata di anni 3 per le arpe
celtiche e di anni 5 per le arpe a pedali a decorrere dalla data di
acquisto indicata sul certificato timbrato e sottoscritto dal Venditore.
Art. 5 •0Foro Competente
Per qualsiasi controversia derivante dalla presente Garanzia
Convenzionale, sarà competente in via esclusiva il Foro di Saluzzo
(Cn), Italia.
CONVENTIONAL WARRANTY
Hereinafter, N.S.M. S.p.a., makers of Salvi Harps with
registered offices at Via Rossana 7, 12026 Piasco (CN), Italy, will
be named simply as the “Maker”; the harp which is specified in
this certificate will be referred to as the “Instrument”; the private
consumer who purchases the Instrument to use it for its rightful
purpose will be referred to as the “Consumer”; the seller that carries
out the sale to the Consumer, who is named in this certificate, will be
referred to as the “Vendor”; and the place authorized by the Maker
to carry out interventions of reparation on the instrument will be
referred to as the “Service Centre”.
The present Conventional Warranty does not replace or undermine
the laws of the consumer rights created in the Vienna Convention
of 1980 section 1999/44/CE or any consumer rights upheld by the
country in which the purchase took place by the Consumer.
Art. 1 • The Instrument
This Warranty covers the Instrument properly registered online,
within 30 days of the purchase date, on the Salvi Warranty
Registration webpage warranty.salviharps.com. The Instrument
is covered by the Warranty for any faults in the manufacturing
process, including aesthetic faults whose origins are attributable to
the Maker, and that compromise the private or professional use of
the goods. The Maker will cover all costs incurred in the repairing of
the goods, including the materials and labour.
Art. 2 • Conditions of the Conventional Warranty
The Conventional Warranty will only be recognized if the purchase of
your new harp is registered online, within 30 days of the purchase
date, on the Salvi Warranty Registration webpage warranty.
salviharps.com. The Conventional Warranty is applicable to new
product sales only, and to the end-consumer only in possession of
a proof of purchase document, which clearly indicates the name of
the retailer, the date of purchase, and the product details. The repair
of the Instrument will be carried out by the Maker or an Authorized
Service Centre in the shortest period of time possible, allowing for
organizational issues.
Art. 3 • Exclusions and Limitations
Any repair or servicing done by an unauthorized person will render
this Warranty void.
The Conventional Warranty does not cover any eventual damages
caused to persons or goods. Neither does it cover any loss of
earnings caused by faulty functioning or the time required to carry
out the repairs.
The following will not be covered by the Conventional Warranty:
• Regular servicing required for the good maintenance of the
Instrument (in this case the Consumer will be charged for labor,
materials like strings or spare parts, and transport/travel expenses
sustained to carry out the service).
• Damage caused by negligence, carelessness, tampering,
unsuitable use or the preservation of the Instrument in places
with different temperature from 20° C ± 10°C or different relative
humidity from 50% ± 15%;
• Damage caused by exposure to heat sources or direct sunlight;
• Any repairs not authorized by the Maker;
• Eventual aesthetic alterations due to the natural ageing of
the wood.
Art. 4 • Duration
The Conventional Warranty of the Instrument is for a period of 3
years for lever harps and 5 years for pedal harps from the date of
purchase on the certificate stamped and signed from the Vendor.
Art. 5 • Jurisdiction
Should any discrepancies arise from this Conventional Warranty, the
competent court will be that of Saluzzo, (Cn), Italy.
