2019 Terms and Conditions of Participation
1. General
a) I understand that Greenheart Exchange is my J-
1 Intern/J-1 Trainee sponsor and that I accept
decisions made by Greenheart Exchange in
regards to all aspects of my program
sponsorship.
b) As a J-1 exchange visitor sponsored by
Greenheart Exchange, I understand that it is my
responsibility to be aware of all rules and
regulations (22 C.F.R part 62) in association
with this visa: http://j1visa.state.gov/programs/
c) I understand that the primary purpose of my J-1
Intern/J-1 Trainee program is cultural exchange.
I have been given the opportunity to learn about
American culture and it is my intention to
maximize my exposure to it throughout my entire
program.
d) I intend to regularly participate in activities that
will culturally enhance my experience in the
United States. I will report these activities to
Greenheart Exchange monthly, via my online
account. I know that Greenheart Exchange is
available to help me identify enhancement
opportunities.
e) I understand that I am responsible for all
information provided in the mandatory
Participant Virtual Orientation, which I agree to
complete in my Greenheart Exchange Online
account prior to U.S. arrival.
f) I will be respectful of all people regardless of
their race, religion, nationality, culture, and
sexual orientation.
2. My Greenheart Exchange Online Account
a) I know my username and password for my
account on Greenheart Exchange Online
(online.cci-exchange.com) and am committed to
keeping it confidential.
b) I understand that my Greenheart Exchange Online
account is where I can validate my program, check my
SEVIS status, complete my monthly check-ins, access
important resource documents and, amongst other
things, keep track of the next deadline I have until I
check in with Greenheart Exchange.

c) I agree to meet all deadlines posted for me in my
Greenheart Exchange Online account.
d) I understand that if I am applying through a sending
agency, said agency may act on my behalf within
my Greenheart Exchange Online account including
providing Greenheart Exchange with my personal
identifiable information for purposes of my
application and participation on the J-1 Intern/J-1
Trainee program. I agree to accept any actions my
sending agency takes as though they were my own.
3. Commitment to Contact Greenheart
Exchange
a) I understand that Greenheart Exchange must
know how to contact me at any time, throughout
the program duration as indicated on my DS-2019
form. This includes my responsibility to maintain
an individual and valid email address and phone
number registered with Greenheart Exchange.
b) I agree to respond to all communication requests
from Greenheart Exchange in a timely manner. I
agree to contact Greenheart Exchange:
 Within 7 days of my program start date to
validate my program.
 If I need any assistance or my safety is in
jeopardy.
 If I experience any major medical,
psychological, or criminal incident.
 If my housing address or the location of my
training changes.
 If the conditions of my DS-7002 Training Plan
are not being met and/or any changes are
made to my DS-7002 Training Plan.
 If I am fired from, or asked to resign by, my
Host Organization.
 If I intend to transfer to a new Host
Organization.
 If I intend to quit my Intern/Trainee program
(prior to taking action).
 If I plan to travel outside of the U.S. at any
time during my program.
c) I will contact Greenheart Exchange if I have any
questions or concerns about my Intern/Trainee
program while in the U.S.

d) I understand Greenheart Exchange requires monthly f)
check-ins via Greenheart Exchange Online. If I fail to
complete the required monthly check-in, my visa
sponsorship may be terminated.
e) If I have applied for the J-1 Intern/J-1 Trainee program g)
with a sending agency, I understand that Greenheart
Exchange and my sending agency may communicate
together regarding my J-1 Intern/Trainee program.
4. Application Requirements
a) I am at least 18 years old.
b) INTERNS: I am foreign national currently enrolled in a
foreign ministerially-recognized degree or certificate
granting post-secondary academic institution outside
of the U.S., OR, I have graduated from such an
institution no more than 12 months prior to the
exchange visitor program start date. I understand that
internship programs have a maximum duration of 12
months. Interns may participate in additional
internship programs as long as they maintain student
status or begin a new internship program within 12
months of graduation. Participants who have
successfully completed internship programs and no
longer meet the selection criteria for internship
programs may participate in a training program after a
two-year period of residency outside the United States
following their intern/trainee program.
c) TRAINEES: I am a foreign national who has a degree
or professional certificate from a foreign ministerially-
recognized post-secondary academic institution
outside of the U.S. and at least one year of prior
related work experience in my occupational field
acquired outside of the U.S., OR, I have five years of
related work experience in my occupational field
acquired outside of the U.S.
d) I possess verifiable English language skills sufficient to
function on a day-to-day basis in the program
environment, both socially and professionally.
e) I have a strong desire to increase my skills and
expertise in my educational or occupational field and
to better understand American culture and society
through participation in an on-the-job cultural
exchange program.

I understand that I must apply for my visa at a U.S.
Embassy or Consulate outside of the U.S. I am
aware that in-country changes of visa status, of any
kind, are not condoned by Greenheart Exchange.
Greenheart Exchange reserves the right to potentially
terminate visa sponsorship if I am found to have
misrepresented myself or provided false information in
the program application or otherwise.
4. I understand and agree to the following
terms regarding the application process:
a) I understand I must submit the following before I
receive the DS-2019 form:
 Online application
 Copy of passport (biographical pages)
 Copies of prior visas to the United States
 Passport photo
 Copy of degree OR university letter proving
student status. The university letter must be
signed and stamped by appropriate school
official and include the date the letter was
issued, chosen field of study, and dates of
matriculation and graduation. If the degree or
university letter is not in English a translation is
required.

 Signed DS-7002 Training Plan
 Signed Greenheart Exchange Host
Organization Agreement (including worker’s
compensation policy information)
 Active website of Host Organization

my J-1 Intern/J-1 Trainee application.
b) Greenheart Exchange will not accept any
applications that are incomplete. By submitting my
application to Greenheart Exchange, I confirm that
it is complete and correct.
c) I understand that Greenheart Exchange will issue
the full invoice for my program fees as outlined on
the Pricing Acknowledgement once my
Greenheart Exchange Career Advancement Program

GREENHEART EXCHANGE Online application and f)
requisite documents are received and accepted.
5. Placement
a) I understand that Greenheart Exchange is the
sponsor of my J-1 Intern or J-1 Trainee visa.
b) I am expected to remain at the Host Organization
indicated on the DS-7002 Training Plan that
Greenheart Exchange has confirmed and vetted prior
to my arrival to the U.S. for the entire duration of my
program.
c) I understand that working with 3rd party placement
agencies, or any other companies that are not
approved by Greenheart Exchange, is not
acceptable. To train with such a company while on
Greenheart Exchange sponsorship is grounds for
program sponsorship termination.
d) If I am fired by my Host Organization or elect to quit
my program without prior written consent from
Greenheart Exchange, I understand I will be placed
on program probation. If I fail to follow the instructions
of Greenheart Exchange during my probationary
period, my visa sponsorship may be terminated. I
understand that termination of program sponsorship
may have a negative effect on me and/or my family
members when seeking future U.S. visas. Once
terminated, I must depart the U.S. immediately and
will not receive any reimbursement of program fees
from Greenheart Exchange.
e) I understand that I must not seek additional paid
training or normal employment during my program, or
train with any Host Organizations that are not
specifically listed on my DS-7002 Training Plan. I
understand that the conditions of my intern or trainee
program are vetted by Greenheart Exchange as
being materially compliant with Department of State
regulations; however, the agreement is ultimately
between me and my Host Organization. Should I
have a conflict at my Host Organization, I agree to
seek resolution directly with my supervisor and to
inform Greenheart Exchange of any issues I am not
able to resolve on my own. Greenheart Exchange
may advise me to contact the Department of Labor to
seek resolution.

I understand that as a self-placed Intern/Trainee,
Greenheart Exchange is not able to find a new
intern/Trainee position for me in my field should I be
fired, elect to quit, or otherwise want to change host
companies while in the United States. I understand
that changing host companies must be approved by
Greenheart Exchange prior to changing positions and
is subject to applicable fees as outlined in my
Participant Handbook.
g) I am responsible for checking my Greenheart
Exchange online account at least once a week,
throughout my program duration, and to
understand and remain compliant with deadlines
that Greenheart Exchange assigns to me.
h) I agree to contact my Host Organization at least 2
weeks before my DS-2019 start date to provide my
arrival information.
i) I understand that Greenheart Exchange may
terminate my visa sponsorship for: failing to report
my arrival in a timely manner (within 7 days of
arrival to the US); failing to complete my monthly
check-in obligation; for training or working in
unauthorized job or for an unauthorized company;
for failing to report to my approved and vetted Host
Organization; for other violations of Exchange
Visitor Program regulations or Greenheart
Exchange’s rules.
j) Prior to submitting my DS-7002 Training Plan to
Greenheart Exchange, I agree to research and
ensure validity of my prospective Host
Organization and suitability of my training offer.
k) I understand that the J-1 Intern and Trainee visas
are not intended to be a substitute for ordinary
work purposes, nor are they intended to displace
American workers or to act as a conduit to
permanent work and residency in the U.S. under
any circumstances.
l) I understand that my Host Organization and I must
complete and submit all required evaluations to
Greenheart Exchange by deadlines outlined during
my program. I acknowledge that Greenheart
Exchange will review my evaluation to ensure I am
meeting the benchmark outline in my training plan.

6. Housing
a) I am responsible for my own housing fees, meals,
spending money, airfare, airport transfers, and
transportation to and from my internship/training.
b) Any contract or agreement regarding housing is
the responsibility of those named on the contract,
and not the responsibility of Greenheart
Exchange.
c) I understand that it is my responsibility to verify
suitable housing before occupancy. Any housing
contracts are made between me and the entity
renting the housing space. Greenheart Exchange
provides me with ‘Questions to Ask Your
Landlord’ before signing any contract, available in
my resources section.
d) Should I have a housing conflict, I agree to seek
resolution directly with my landlord and to inform
Greenheart Exchange within 24 hours of any issues
I am not able to resolve on my own. Greenheart
Exchange may advise me to contact the local
housing authority to seek resolution.
e) I am responsible for reporting my current housing
location to Greenheart Exchange at all times within
24 hours of any move. Failure to do so may result
in program sponsorship termination.
f) I will confirm that my housing is suitable, affordable,
and safe; that it, at a minimum, meets all local laws
and regulations, including with respect to
ventilation, utilities, and occupancy rates. I will
further confirm that I have reliable and affordable
transportation between my housing and Host
Organization. If I find that these housing and
transportation needs are not met, I will report it to
Greenheart Exchange immediately.
7. Money
a) I agree to enter the U.S. with access to at least
USD $1,500 for start-up costs, in addition to the
cost of passage for return trip home.
b) I am responsible for any fees incurred by the U.S.
Department of State or the SEVIS system in
regards to my program.
c) I agree to comply with Federal, State and local
income tax filing requirements.

d) I agree that I will use my Host Organization’s
telephone only with a phone card. I must ask
permission to use the phone, even when using a
phone card.
e) I agree to reimburse all outstanding debts incurred
while on the program. I will pay any medical bills and
submit them to the insurance company with my claim
for reimbursement before I depart the United States
8. Acclimating
a) I understand that there will be major differences
between the lifestyle of my native country and the
U.S.
b) I understand that I must obey all national, state, and
local laws at all times, as well as the rules of
Greenheart Exchange, the Host Organization and
the host community. The breaking of any law or rule
can result in dismissal from the program.
c) I understand that I may smoke tobacco, but only in
accordance with the rules of my workplace, housing
facility and applicable state, federal or local laws.
d) I understand that the legal age to consume alcohol
in the U.S. is 21 years old.
9. Cultural Commitment
a) I understand that a central purpose of the J-1
Exchange Visitor program is to get to know the
diverse people, culture, and customs of the U.S.
b) I will put forth my best effort to seek out and
participate in activities that will enhance my cultural
experience in the U.S. Examples include visiting
historical sites, joining a local club, or enrolling in a
language class.
c) I know Greenheart Exchange offers the Greenheart
Club to provide meaningful service opportunities
during my program.
d) I understand that Greenheart Exchange has identified
cultural opportunities that I can explore while on my
program. Information about these opportunities can be

10. Health and Safety

a) I am aware I am aware of the details of my health
insurance policy, including all coverage, limitations,
and exclusions.
b) I am responsible for all costs not covered by the health
insurance provider, during and after my coverage
dates.
c) I understand that I am required by U.S. Department of
State regulations to be covered under health insurance l)
throughout the duration of my program.
d) I understand that I will need to arrange my own health
insurance if I plan to remain in the U.S. during my 30-
day travel period. I understand that Greenheart
Exchange can help me arrange additional insurance if I
contact them at least 2 weeks before my program end
date.
e) I know that if I drive, I must contact The Department of
Motor Vehicles (https://www.usa.gov/motor-vehicle-
services) in the state where I am living/training in order
to find out what their requirements are for obtaining a
driver’s license.
f) I understand that I must secure motor vehicle
insurance coverage prior to driving a car. I understand
that the law of each state in the U.S. is different in
regard to requirements for motor vehicle insurance
coverage. I agree that I cannot and will not operate a
motor vehicle of any sort in the U.S. unless I obtain
proof of the legally required insurance sufficient to
satisfy all local legal requirements for said operation.
g) I will not operate any motor vehicle after the use of any
legal or illegal drugs which may impair the ability to
operate a motor vehicle. I will not get in a motor vehicle
with a driver under the influence of alcohol or drugs.
h) I understand the importance of bicycle safety while in
the United States and that it is my responsibility to
abide by local bicycle laws and laws of reason (i.e., it is
not safe to ride my bike along a rural highway at 2:00
in the morning).
i) If I am found to be unable to actively participate in my
program and therefore unable to fulfill the purpose of the
program, yet medically cleared to travel, I will return to
my home country at my own expense immediately.
j) Greenheart Exchange reserves the right to dismiss me if
my mental or physical health, as documented by a
trained professional (e.g., eating disorders, depression,
or chronic illness or condition), requires this action.

k) Greenheart Exchange also reserves the right to shorten
my program in SEVIS without a probationary period in
the event that I undergo a major lifestyle change that
impacts my ability to continue my program (e.g.,
marriage, pregnancy, etc.). A participant whose
program is shortened under these circumstances will not
receive a refund.
I understand that I may smoke only in accordance with
the rules of my Host Organization and housing.
m) I understand that the legal age to consume alcohol
in the U.S. is 21 years old.
11. Medical Agreement
a) I authorize Greenheart Exchange and its
representatives to consent to any medical or
dental treatment, rendered under the general
supervision of medical staff, licensed under the
provision of the Medicine and Dental Practice
Acts. This authorization is given to provide
authority and consent on my behalf.
b) I authorize Greenheart Exchange to access
any funds that I may have to be applied
towards payment of any uninsured medical
attention that I may have incurred.
c) I authorize Greenheart Exchange to access my
medical information, should I be hospitalized
for any reason.
d) I authorize Greenheart Exchange to provide
my insurance and contact details with any
medical provider I received treatment from,
should I fail to provide accurate or complete
information myself.
12. Consequences of Rule Violation
a) I under stand that the reasons Greenheart
Exchange may terminate my J-1 visa sponsorship
include but are not limited to:
 Failure to arrive to my pre-approved Host
Organization with intention to remain on my
program throughout the entire duration
 Failure to validate my program within 7
days of my arrival to the United States or
failure to notify Greenheart Exchange if I

will arrive in the U.S. after my DS-2019 13.
start date
 Failure to contact Greenheart Exchange by
any deadline visible on my GREENHEART
EXCHANGE Online account homepage;
 Failure to complete my participant portion
of my program evaluations, which are
required by the Department of State;
 If I intern, train, or work for a company that
was not explicitly screened, vetted and pre-
approved by Greenheart Exchange as an
acceptable Host Organization. This
includes taking on a second internship or
job;
 Failure to report change of housing address
within 24 hours of any move, via my
Greenheart Exchange account
 Leaving my approved host organization
prior to the end of my J-1 Intern/J-1 Trainee
program without notifying Greenheart
Exchange prior to my departure;
 Remaining in the U.S. after my 30-day
grace period;
 If I violate any local, state or federal law
 If I violate any Greenheart Exchange
program regulation
b) I understand that if Greenheart Exchange terminates
my visa sponsorship, I must depart the U.S., at my
own expense, immediately.
c) I understand that if my visa sponsorship is
terminated, it may negatively impact my chances
(and the chances of my family members) of receiving
another visa to return to the United States.
d) It is the obligation of Greenheart Exchange to report
any activities that are interpreted as being in defiance
of visa or program regulations to the U.S. Department
of State.
 SEVIS and update any housing or site of activity
e) Under certain circumstances, Greenheart Exchange
will place me on Additional Monitoring, rather than
terminate my visa sponsorship. When this happens, it
means that I am required to be in more frequent
communication with Greenheart Exchange, and my
deadlines for checking in are always visible on my
Greenheart Exchange account homepage.

13. Miscellaneous
a) I must arrive to the U.S. with a passport valid at
least 3 months past my program end date, my J-
1 visa, and DS-2019 form in my carry-on bag.
b) Greenheart Exchange does not condone and
will not take responsibility in aiding a change in
visa, and will not take responsibility for
participants who remain in the U.S. after the end
date indicated on the DS-2019.
c) I understand that Greenheart Exchange must
know how to contact me at any time, throughout
the program duration as indicated on my DS-2019
form.
d) I am authorized to enter/depart the United States
up to 30 days prior to/following my program
sponsorship dates, as authorized by U.S.
Citizenship and Immigration Services (USCIS).
e) I understand that Greenheart Exchange has
separate Terms and Conditions of participation for
J-2 dependents and, should I bring J-2
dependents on my program, my J-2 dependents
and I will abide by the signed terms.
f) I authorize Greenheart Exchange, its
representatives, and its affiliates the irrevocable
use of any photographs accompanying this
application or any photographs/video taken while
participating on a Greenheart Exchange program
for promotion or publicity. I understand that I will
not receive compensation for the use of my
photograph(s)/video(s). I agree that Greenheart
Exchange may use such photographs/videos of
me with or without my name and for any lawful
purpose, including, but not limited to such
purposes as brochures, advertising, and website
content.
g) I understand that I must validate my program in
changes throughout my program via
GREENHEART EXCHANGE Online.
h) If I do not obey Greenheart Exchange program
rules and regulations, my program is subject to
program sponsorship termination without prior
notice.

i) I will not borrow funds from my Host Organization
or others. If I am unable to cover personal
expenses, or if I borrow heavily from hosts or
others during the program, I am subject to
possible program dismissal and
repatriation/termination.
j) I understand that visits by family or friends during
the program are discouraged as they can distract
from cultural immersion and exacerbate
homesickness.
14. Acknowledgement of Fee
Transparency
a) I confirm that I have received all of the following
information before entering into agreements and/or
paying non-refundable fees:
 Clear explanation of program activities and
terms and conditions of program, including the
terms and conditions of any employment
activities (job duties, number of work hours,
wages and compensation, and any typical
deductions for housing and transportation)
 An itemized list of all fees charged to me (i.e.,
fees paid to the sponsor or a third party
including the host organization)
 Insurance costs
 Other typical costs, conditions, and restrictions
of the exchange visitor program
 The type, duration, nature and importance of the
cultural components of the program
b) I confirm I understand any stipend or wages
outlined on my DS-7002 Training Plan might not
cover all of my expenses and that I should bring
additional personal funds.

LIABILITY RELEASE AGREEMENT

a) As a participant of the Greenheart Exchange program, I understand that circumstances may arise
that are outside of Greenheart Exchange’s control.
b) I renounce any claims against Greenheart Exchange and its representatives that may arise from
circumstances outside of Greenheart Exchange’s direct control.
c) I acknowledge that Greenheart Exchange cannot assure my personal security other than to vet the
Host Organization in the manner required by the Department of State.
d) Greenheart Exchange encourages participants on all of their exchange programs to volunteer while in
the United States. Should I do any volunteer work, whether coordinated by Greenheart Exchange of
otherwise, I agree to follow directions given by the volunteer coordinator, stay safe, and will only
perform tasks or responsibilities that I feel comfortable with. I agree to hold Greenheart Exchange
harmless from any and all liability, injury, and damages resulting from my experience as a volunteer.
e) I understand that it is my responsibility to inform Greenheart Exchange of any circumstances that may
cause me harm or bring notoriety to Greenheart Exchange or the U.S. Department of State.
f) I understand that Greenheart Exchange is not required to provide counsel for civil, criminal, or
administrative proceedings filed against me or by me.
g) I agree to accept the final judgment of Greenheart Exchange for intern or trainee assignments and
decisions made by Greenheart Exchange in regards to my program.
h) I will not hold Greenheart Exchange responsible for any civil or criminal liability incurred by me while
on my program.

i) I understand that there will be major differences between the lifestyle of my home country and the
U.S.
j) The laws of the State of Illinois (without giving effect to its conflict of laws principles) shall govern all
matters arising out of or relating to this Agreement, including, without limitation, its interpretation,
construction, performance, and enforcement. The parties hereby consent to the jurisdiction and

venue of the United States District Court for the Northern District of Illinois and any courts of the
County of Cook in the State of Illinois in which any suit, action, or proceeding shall be brought under
this agreement.
k) I waive any and all right to argue that this choice of forum provision is or has become unreasonable;
and any and all right to trial by jury in any action, proceeding or counterclaim related to or arising out
of this agreement.
l) I affirm that the provisions of this agreement are severable and, in the event any term or condition
hereof is found by a court of competent jurisdiction to be void or unenforceable, the remaining terms
and conditions of this agreement shall, if permitted by law, remain in full force and effect. This
agreement shall bind, and inure to the benefit of, the respective affiliates, relatives, heirs, trustees,
and successors and assigns of the parties hereto.
m) I authorize Greenheart Exchange, its representatives and its affiliates the irrevocable use of any
photographs/video accompanying this application or any photographs/video taken while participating
on a Greenheart Exchange program for promotion or publicity. I understand that I will not receive
compensation for the use of my photograph(s)/video(s). I agree that Greenheart Exchange may use
such photographs/videos of me with or without my name and for any lawful purpose, including, but
not limited to such purposes as brochures, advertising, and website content.

RECOGNITION OF AGREEMENT: By signing and submitting this form as part of my application, I

confirm that I have read and agree to abide by the conditions outlined in the 2019 Terms and Conditions
of Participation. There is no reason (pre-existing health condition, emotional, or behavioral problems,
etc.) why I should not be able to participate in the program. I confirm that I have not been convicted of
any felony, and understand that falsifying or withholding of any information on the application could
result in program dismissal.
