MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Agreement is entered into this _____day of ___________ 2015, in Tuguegarao City
by and between:

The DEPARTMENT OF HEALTH – Regional Office II with office address in Maharlika


Highway, Carig Norte, Tuguegarao City, Cagayan, represented by VALERIANO JESUS V.
LOPEZ, MD, MPH, MHA, CESO IV in his capacity as DIRECTOR IV, hereinafter referred to as
DOH-RO II;
And

The LOCAL GOVERNMENT UNIT of Aurora, Isabela herein represented by HON. WILLIAM
JOSE T. GUMPAL, CPA

T. UY in his capacity as Mayor, herein referred to as the LGU.

Witnesseth,

WHEREAS, the Health Sector Reforms through the Kalusugan Pangkalahatan (Universal Health
Care) is the overriding goal of the Department of Health that will help achieve the United
Nations Millennium Development Goals and the Philippines National Objectives for Health;

WHEREAS, EO 102 mandates the Department of Health to provide assistance to local


government units (LGUs), people’s organizations and other members of civil society in
implementing health programs, projects and services that will promote the health and well-

being of every Filipino; prevent and control diseases among population at risks; protect
individuals families, communities exposed to hazards and risks that could affect their health;
and treat , manage and rehabilitate individuals affected by diseases and disability;

WHEREAS, the Philippines and across regions is beset with slowing down in the reduction of
Infant Mortality Rate (IMR) and the Maternal Mortality Ratio (MMR) coupled with the high
burden from both infectious and chronic and degenerative diseases. And the burden of these
diseases is heaviest on the poor.

WHEREAS, Bottom-up Budgeting Process, an approach to preparing the budget proposal of

agencies, taking into consideration the development needs of poor cities/ municipalities as
identified in their respective local poverty reduction action plans (LPRAP) shall be formulated
with strong participation of basic sector organizations and other civil society organizations
shall be adopted to be able to fast track the achievement of the Millennium Development
Goals of reducing poverty;

WHEREAS, the LGU of Aurora, Isabela has identified several health initiatives that will enhance
their provision of Primary Health Care through improvement of their health facility, develop
the knowledge, skills and attitudes (KSA) of health personnel in the performance of their tasks.

WHEREAS, the DOH issued Sub-Allotment Advise #15-04-290 dated April 7, 2015 granting
subsidies to DOH – Regional Offices for the implementation of its different programs and the
Bottom-up Budgeting Local Poverty Reduction Action Plans of LGUs that are considered to be
eligible in contributing to local poverty reduction;
NOW, THEREFORE, in consideration of the foregoing premises stipulations herein set forth,
the Parties hereto agree as follows:

ARTICLE I
ROLES AND RESPONSIBILITIES OF BOTH PARTIES

Section 1.Responsibilities of the LGU:

1. Implement the different Maternal, Neonatal, Child Health, and Nutrition strategies for
Family health program including other health modalities according to recommended
technical protocol of the Department of Health ;
2. Ensure that regular human resource complement of both regular health staff and health
volunteers e.g. CHTs are arranged by the LGU to assist in providing health services to

target clients;

3. Allocate, release and use of funds for the continuing maintenance and operations of the
projects and its related activities;
4. Liquidate fund transferred from DOH-RO II duly verified by the COA Resident Auditor. “No
Report No Release Policy”
5. Maintain a Trust Account for the allocated amount;
6. Submit to DOH-RO a Work and Financial Plan in the beginning of the project
implementation and a terminal report of the physical accomplishment and project results
relative to its objectives. Similarly, an audited Fund Utilization Report and Credit Notice

issued by the local State Auditor shall be submitted to DOH-RO II within one (1) month

after the completion of the project;


7. Return to DOH-RO II unutilized portion of the allocated amount within 30 days from
completion of the project.

Section 2. Responsibilities of the DOH-RO II

1. Release the allocated amount to the LGU after necessary documentary requirements
have been satisfied;
2. Coordinate the necessary support and Technical Assistance (TA) to the LGU that will help

build their capacities in successfully implementing the project;


3. Undertake monitoring and evaluation with respect to the performance of the LGU;
4. Ensure the submission of supporting documents by LGU for the release of the allotted
amount;
5. Prepare and submit to DBM request for realignment from one allotment class to another
pursuant to Joint Memorandum Circular No. 6 dated February 27, 2015.

ARTICLE II
SPECIFIC AGREEMENTS

Section 3. Effectivity and Duration

This Agreement shall take effect upon signing of both parties and shall remain in
force until its target project implementation schedule.
Section 4. Financial Assistance

4.1. The Grant.

The DOH-RO II will release in FULL to the LGU a total amount of Five Hundred Forty Eight
Thousand Pesos (PhP 548,000.00) only to be used conscientiously for the implementation of
the following health development strategies as approved in the proposed work and financial
plan or program of work for the “TRAINING HEALTH PROVIDERS ON THE FF PROGRAMS:A)
BASIC EMERGENCY OBSTETRIC AND NEWBORN CARE (BEMONC), B) COMMUNITY HEALTH
TEAM (CHT), C) RABIES ELIMINATIONPARTNERS, D) LEPROSY, E) TB CONTROL, F) STI/HIV
AND AIDS PREVENTION, G) DENGUE CONTROL, H) HEALTH EMERGENCY MANAGEMENT”
project.

ARTICLE III

GROUNDS FOR TERMINATION FOR LGU PARTICIPATION

Section 5. Termination of the Agreement

This agreement may be terminated by the DOH-RO II upon proof of non-compliance of the
LGU to any of the terms and conditions set forth in this agreement in accordance with the
following:

5.1. The DOH-RO II will serve a Notice of Non-compliance to the LGU if the LGU fails to
start the implementation of the project within 30 days upon receipt of fund
allocation and if the DOH remains to be dissatisfied with the project
implementation based on approved Work and Financial Plan or program of work.
5.2. Within 30 days upon receipt of the Notice of Termination, the LGU shall revert to
DOH-RO II the entire unobligated/uncommitted BuB Grant.
