AFFIDAVIT-COMPLAINT

I, Len Pacas, Filipino, 22 years of age, single and a resident of

Brgy. Doos del Sur, Hindang, Leyte, Philippines, after having been
duly sworn to in accordance with law, do hereby depose and state:

1. That I am a single mother and I have a son name Xian Jay

Pacas, one year old. His father is Waren Estillore Aparece, 22 years
old and a resident of Backlear, Sto Nino, Tabok, Mandaue City. Hereto
attached is the Birth Certificate of Xian Jay Pacas marked as Annex
“A”.

2. That I met Waren Estillore Aparece last January 2013 in

Cebu and we became lovers. Thereafter, I became pregnant and we
live together as husband and wife without the benefit of marriage in
their house in Backlear, Sto. Nino, Tabok Mandaue City.

3. That October 25, 2013, our child was born. At first, we are a
very happy couple and he was a very loving father to our child. He
showered us love, support and all the things that befit him as a good
father of the family. Hereto attached is our picture together as family
marked as Annex “B”;

4. That sometime on January 2014, he convinces us and

brought us back to our home province in Hindang Leyte then he
returned in Cebu. Thereafter, I noticed something wrong or irregular
with him as he seldom give support to our child. Even our
communication was becoming less and less. He sends us money
through his family last October 25, 2014 and that was the last of it.
Thereafter, he no longer gives us any support. Hereto attached is the
proof from Cebuana Lhuillier marked as Annex “C” hereof;

5. I contacted him thru Facebook and through other means of

communication and pleaded to him for support as our child badly
needed it plus the fact that the child was sickly but he adamantly
refuses to do so. Instead, he insulted me and threatened to get the
child out of my custody. I pleaded again for mercy but he just ignored
us. Hereto attached is the printout of our Facebook Conversation to
prove such fact and marked as Annexes “D” & “E” hereof;

6. Feeling hopeless of the situation, I went to the Public

Attorney’s Office of Hilongos Leyte to seek for legal assistance.
Thereafter, a letter, at my instance, was sent by the PAO to him last
February 4, 2015 but instead of heeding my plea, Waren Aparece still
refuses to give us any support or contacted us for that matter.
Instead, he badmouthed us including the PAO. Hereto Attached is the
letter marked as Annex “F”;

7. That because of these helpless situation, I was compelled to
file a criminal complaint against Waren Aparece, the father of my son
who is well earned enough to give support but refuses to do so, for
Economic Abuse in violation of Republic Act 9262 and other cases
this Honorable office may deem fit under the circumstances.
