the following cargo loaded at this port and said to be:
Please note that you do not have authority to sign any bill of lading which does not
specifically incorporate the terms, conditions and exeptions of the Charter Party
ARBAT/BHP dated
31/07/2001 and/or the Hague Rules ( or legislation of similar effect ).
The destination shown in the bills of lading should be consistent with the provisions
of the Charter Party governing this voyage/Charter’s instructions, which stipulate that
the vessel will discharge at Singapore.
Please ensure that all bills are properly dated September 29, 2001.
On no account should “freight prepaid” bills be issued without the express authority of
my Company/Owners, to whom you should refer on this and any other matter concerning
the signing and issuing of bills of lading.

the vessel notes protest for the following, and reserves the right to extend it at time and
place convenient.
Actual discharging time consisted ______ hrs ______ min’s instead of ship’s
discharge capability at 05 hrs 40 min’s.
Delay ________hrs _______min’s due to high back pressure.
Within all time of discharging vessel maintained discharge pressure at ship’s manifolds
100 pci. The discharging facilities were insufficient to utilize my vessel’s full discharging
capacity.

As per Charter’s voyage orders my vessel is scheduled to load a cargo of Main Column
Bottoms from min16000 to max 20000 mt at Gellibrand pier.
As a consequence of above said orders I must submit the below calculation setting forth
the total cargo capacity available and additional quantity which could have been loaded
had my vessel been supplied up to max Summer Deadweight.
DEADFREIGHT 25 979. 60 mt

Dear Sirs,
With reference to the discharging operations at Gellibrand pier, the vessel notes
protest for the following, and reserves the right to extend it at time and place convenient.
Please be advised according to Letter of Protest dated 21/09/01 signed by Ray Dickson,
shore officer 495, Mobil Oil Australia, quote vessel allowed the overflow of cargo into Spill
tray and fully contained on starboard side manifold due to gasket/flange failure. As a
result of this overflow of cargo, cargo operations were suspended from 0940 to 1020
while clean up operations were undertaken and manifold blank flanged unquote.
The vessel not agree with terms “the overflow of cargo “, “ fully contained”, “while clean
up operations”.
At 0940 insignificant cargo leakage was observed on cargo line No 3 starboard manifold
through blank gasket into Spill tray. Cargo operations suspended.
Capacity of Spill tray is 10.52 cbm. Insignificant leakage of oil was collected into Spill tray
and discharged into port Slop tank. Quantity of slops the same before and after
discharging according to Slop tank certificates. So quantity of oil had been spilled and
discharged from starboard Spill tray into port slop tank immeasurable and insignificant
and cargo operations suspended for gasket renewing only.

concerned, I formally protested and hold your principals responsible for the
consequences, if any, caused due to not correct information in Letter of Protest.

Dear Sirs,
Unknown sediment of shore origin has been detected into ship’s cargo line No 2
on completion of loading of the first grade of cargo Gasoline S87 by ship’s cargo lines
NoS 2 and 3, and cargo arms disconnection. At the same time cargo line No 3 is clean.
Samples from cargo tanks and cargo survey not indicate any sediment into cargo tanks.
However a more correct assessment of any sediments will be possible at discharge port
because of insufficient settling time on completion of loading.
Herewith I note protest against the sediment found in the manifold’s line No 2, and
sediments that will be possible at discharge port, and on behalf of my Owners/Charterer’s
I hold you responsible for all or any claims, costs and losses they or either of them may
suffer.
On behalf of my Owner/Charterer’s I further reserve the right to take all such further
actions as may be considered necessary to protect interests of those parties.

total quantity to be loaded: to load as close as possible to 220 000 bbls not
exceeding 220 000 bbls.
Actual quantity loaded is 214 174. 162 bbls. Shortage 5 825. 838 bbls.

Dear Sirs,
This is to inform you that some dunnage was ordered by ship to load cargo of
sawntimber in packages on the deck of m/v “STK 1012”. This dunnage was necessary to
protect cargo from prominent parts of hatchcovers.
Plenty separated boards were used by stevedores of port of Bely Ruchey for dunnage
and were not included to the Bills of Lading.
Ship take all necessary steps to protect cargo during loading and during voyage.
According to ship’s and stevedores tallies at port of Bely Ruchey 522 packages of
sawntimber were loaded to m/v “STK 1012” and according to ship’s tally 522 packages
were discharged at port of Fecamp not counting separated boards used for dunnage.
In view of the above I repudate your claims concerned to quantity and quality of
cargo discharged at your port.

discharged today at port of Larvik.

from and badly deformed. In consequence of this, above mentioned sockets cannot be
used for proper accomodation and securing of four containers and ship’s container

This is to inform you that I am not in position to admit your claim
regarding the alleged wetness of cargo of UREA IN BULK in No.1 hold of m/v

On arrival to Kappeln and prior to discharge all cargo was looked
around by surveyor and found in good condition. Nowhere traces of water
were found. I suppose that cargo is not wet and only changed it colour
owing to touching with rusty bottom.

neither my m/v “VOLGO-BALT 112” nor my shipowners will bear no
responsibility for any claims which may arise in connection with wetness of
cargo of UREA IN BULK discharged from above said ship at port of Kappeln

Re: claims to quality cargo of D.A.P. in bulk loaded at Port of Muuga into Hold No.1 of m/v “STK 1012”
Dear Sirs,
This is to inform you that I am not in position to admit your claim regarding
the alleged damage of cargo of DIAMMONIUM PHOSPATE IN BULK in Hold No.1 of m/v
“STK 1012” for the following reasons.
1. Before loading cargo of D.A.P. at port of Muuga (Tallinn) the check of hatch
covers of Holds No. 1 and No. 2 on watertightness and pressure test of stop valves of
drainage system of above Holds were carried out by crew. For these tests we used main
fire pump with water pressure in the main 6 kgs/sq.cm. No leakage of water through
hatch covers and filtration through bilge containers and ballast tanks into the Holds were
not found. We also cheked bilge container level alarm and found it in good condition and
working properly.
2. Holds inspection was also carried out by surveyors. They found Holds No. 1
and No. 2 clean and dry without any foreign things and to be suitable for loading and
transportation of the above said cargo.
3. The air temperature during loading was about minus 5 – minus 3°C and air
humidity was high cause sometimes snow falled down and visibility was poor. During the
snow hatch covers were closed and loading did not take place. The wind during loading
was from northerly direction with speed about 15 m/s.
4. The loading was executed by tipping cargo from 20-foot containers into the
Holds. Containers were loaded from rail-wagons by grabs. Due to this and due to negative
air temperature cargo might contain wet frozen lump and pieces of ice.
5. Ship sailed from Muuga on the 25th December, 2000 and arrived to
Southampton on the 30th December, 2000. During the voyage the air temperature
changed from minus 3 to plus 5°C.
6. Due to it nature the cargo of DIAMMONIUM PHOSPATE is very hygroscopic
and may take moisture from air.
In reason of above I suppose that alleged damage of cargo arised as the result of
temperature difference and moisture condensation on the metallic surfaces like
bottom, boards and hatch covers of the Hold No. 1.
In the circumstances I have to make an official statement that neither my m/v “STK
1012” nor my shipowners will bear no responsibility for any claims which may arise in
connection with damage of cargo of D.A.P. IN BULK discharged from above said ship at
Port of Southampton.

port of Szczecin port tallymen were not present on the quay.
According to the ship’s tallies 143 bundles of aluminium ingots and 1626
aluminium T-bars discharged at port of Szczecin. Hold No.1 and Hold No.2
are empty. All discharging was recorded to videotape.
In view of the above I protest against any claims concerning quantity of

Lading 1395.79 cubic metres of coniferous sawlogs were loaded on board of
the m/v “STK 1012”. At the same time according to Notice of Readiness our
ship is in all respects ready to load her cargo of coniferous sawlogs, 1500.000
cubic metres and upto full and complete cargo as per Charter Party.
In reason of this I hold you responsible for the shortshipment and for
the dead freight inccured.

hold coaming and obstruct to close the holds by hatch covers.

ingress of moisture into the holds in the issue of precipitation.
Also, please, draw your attention to properly trimming cargo in the
holds. According to preliminary cargo plan it is necessary to fill Hold No.2 to
level of limit lines drawn at coaming and load in the Hold No.2 minimum 920.0
mt of cargo. The rest part of cargo should be loaded in Hold No.1 otherwise
ship could not take full cargo.
In view of above I shall hold Stevedoring Company for damage to the cargo

I have to draw your attention to the fact that during loading cargo of malt to
m/v “STK 1012” level of cargo should not exceed the height of hold coaming and
obstruct to close the holds by hatch covers.
Ship must have always good chance to close hatches to prevent ingress of
moisture into the holds in the issue of precipitation.
Also, please, draw your attention to properly trimming cargo in the holds.
According to preliminary cargo plan it is necessary to fill Hold No.2 to level of limit lines
drawn at coaming which are 30 cm below coaming edge and load in the Hold No.2 about
550.0 metric tons of cargo. The rest part of cargo should be loaded in Hold No.1 otherwise
ship could not take full cargo.
In view of above I shall hold Stevedoring Company for damage to the cargo and all

Letter of Protest
Dear Sirs,
This is to inform you that as a result of visual inspection of cargo of
sawntimbers in packages on quay and during loading above mentioned cargo to m/v
“STK 1012” the following facts were found:
1. Sawntimbers were kept on unprotected storage protractedly.
2. Some boards in packages changed colour as a result of long-term exposure of
moisture.
3. All packages are stained
4. Bands are weak.
In reason of this I shall bear no responsible for the all claims and other
consequences, which may arise therefrom and I have to make following remarks in all bills
of lading:
1. LOADED FROM OPEN STORAGE.
2. ALL PACKAGES COVERED WITH WET SPOTS AND STAINED, BOARDS
DISCOLOURED AND DARKEN.
3. BANDS ARE WEAK.
I would kindly request you advise the Shippers, Stevedoring Company, Consignees and
all concerned.

This is to inform you that vessel’s cargo (stowage) capacity is fully
used. In reason of this I am not able to take any more cargo of sawntimbers
in packages on board of m/v “STK 1012” and I shall bear no responsible for
the all claims and other consequences, which may arise therefrom.
I would kindly request you advise the Shippers, Stevedoring Company,
Consignees and all concerned.

Re: damage to cargo of monoammonium phosphate
Dear Sirs,
I have to draw your attention to the fact that owing to negligent and careless
handling of cargo much damage has been cased to the good.
Today, on the 8th December 2000 at 05.00 LT during loading cargo of M.A.P. via pipe
transporter to Hold No.2 of m/v “STK 1012” level of cargo has been exceeded the height
of hold coaming and obstruct to close the holds by hatch covers. This happened due to
failure by Chief Stevedore A. GANENKO to execute requirement of ship’s administration
concerning trimming of cargo which was handed to Stevedores in written form.
At 05.10 LT drizzle was started and trimming of cargo was fulfilled during precipitations
and some moisture ingressed into the Hold No.2.
In view of above I hold Stevedoring Company for damage to the cargo and all
claims and other consequences, which may arise therefrom and I would kindly request
you advise the said Stevedoring Company, Consignees and all concerned.
