MOTION TO RELEASE IMPOUNDED VEHICLE

COMES NOW, the undersigned owner of motor vehicle, unto this

Honorable Court most respectfully aver;

1. That he is the owner of the subject motor vehicle, Red

Suzuki Smash Motorcycle, with Engine No. ____________,
Chassis No. ____________ under Certificate of Registration
No. __________, and Official Receipt No. ___________;
copies of the said Certificate of Registration and Official
Receipt are hereto attached as Annex “1”;

2. That said motor vehicle was registered under the name of

____________ and was transferred to him by way of sale on
installment as evidenced by a Certification issued by
____________________; a copy of the said Certification is
hereto attached as Annex “2”;

3. That subject motor vehicle was confiscated by the

PNP________________ on ________ at
____________________, in connection of Criminal Case
No. ______; People of the Philippines vs _____________
for “____________________________________________”;

4. That the subject motor vehicle was not included and/or

marked as evidence by the prosecution against the accused
____________;

5. That since September 7, 2018, the afore-said vehicle was in

the possession of and in custody of PNP __________,
expose to the elements, pilferage, and theft of its
accessories.
 WHEREFORE, in view of the foregoing, it is most respectfully
prayed to the Honorable Court that an Order be issued that the
subject motor vehicle be returned to the herein movants with the
undertaking that it will be made available anytime to the prosecution if
needed.
