CROSS-EXAMINATION

1) Counsel: You said in your direct exam that you were tasked to do patrol in Brgy. Saimsim,
Calamba City on the night the incident happened. While on patrol, how far were you from the
place of the incident?

P: A few blocks away.

2) Counsel: You also said that on the night of the incident you heard a loud scream, am I correct
Ms. Witness.

P: Yes. Ma’am.

3) Counsel: How is it possible that you were able to hear the scream from a few blocks away.

P: Actually, I did not hear the scream. Someone else, a bystander heard it and since I was close
by patrolling I was called to the scene.

4) Counsel: So you’re telling this court that you did not personally hear the cry for help by the
victims.

P: Ahhm. No.

5) Counsel: So you just assumed from the report of the said bystander that there was a crime
committed which warranted you to proceed to the crime scene?

P: Yes.

6) Counsel: So when you proceeded to the crime scene, did you asked who screamed?

P: Yes. It was grandma who shouted. She told me that Wolf attacked them and that someone
defended them from their attacker, who in the process killed Wolf.

7) Counsel: Was this person who the Grandma was talking about present in the crime scene?

P: At first he was not. But while the crime laboratory experts were sweeping up the crime scene,
a man approached me. He introduced himself as Wood Katter, the man responsible for the death of
Wolf as a way of defending Grandma and Red.

8) Counsel: So let me just clarify this, he surrendered himself and confessed that he was the one
responsible for the crime as a way of defense of the person of Grandma and Red?

P: Yes.

9) Counsel: So why did you say in your direct examination that you apprehended him, contrary to
the statement that he voluntarily surrendered.

P: I meant in that statement that after he confessed to the crime, I accompanied him to the police
station.

10) Counsel: And where did this happen?

P: At Starbucks Calamba
11) Counsel: Is this confession in writing?

P: No. it was a verbal confession.

12) Counsel: How far is this Starbucks from the crime scene?

P: Around 30-minute walk from the crime scene.

13) Counsel: Was he informed of his Miranda Rights?

P: Yes.

14) Counsel: In what language?

P: In English and Tagalog to make sure he understood it.

15) Counsel: So the fact still stands that he voluntarily surrendered to you after committing the act?

P: Yes.

16) Counsel: After the voluntary surrender, did anything else happen?

P: Yes. In fact, Mr. Kater admitted that he attacked Wolfy but according to him, he did it to save
Grandma and Red because Wolfy was allegedly attacking them at that time.

17) Counsel: Who were the persons present at this point?

P: Me, my colleagues, Red, Grandma, and Kater.

18) Counsel: Where did this confession take place?

P: At the police station.

19) Counsel: Is this confession made in writing?

P: Yes. It is attached in the Police Report.

20) Counsel: You are referring to the Police Report marked as Exhibit A?

P: Yes

21) Counsel: And who signed this Police Report?

P: Me as investigating officer, Kater, Red and Grandma as witnesses.

22) Counsel: No one else?

P: None, sir.

23) Counsel: No signature of counsel?

P: No, sir.

24) Counsel: You said you saw the lifeless body of Wolfy on the floor at the crime scene.

P: Yes.
25) Counsel: Can you describe the body as you saw it lying on the floor?

P: It had incision on the neck area.

26) Counsel: Can you describe to us the size of this incision?

P: It was probably the same size as a bladed weapon.

27) Counsel: Does your description match this weapon you previously identified?

P: Yes.

28) Counsel: Other than the wound, were there any other marks you found to describe the body?

P: None.

29) Counsel: So, there was only one wound?

P: Yes.

30) Counsel: Only on the neck area?

P: Yes.
