COMPLAINT-AFFIDAVIT

I, RYAN JAY C. CONOG, 28 years old, married, and a resident

of Bliss Project, Biga, Lugait, Misamis Oriental, after having been duly
sworn to in accordance with law, hereby deposes and says that:

1. I am a duly authorized Barangay Tanod of Brgy. Biga,

Lugait Misamis Oriental, working under the Barangay Road Clearing
Team and tasked to enforce Brgy. Ordinance No. 7-2015-123
otherwise known as the “Anti-Vendor Operation Ordinance of Brgy.
Biga”. Attached herewith are my Official Appointment issued by the
Barangay Executives and a copy of the said ordinance as Annexes “A”
and “B”;

2. Respondent JEFF M. MEISTER is a fish vendor, selling his

products along the national highway and passing to the hinterside of
the road on the Cagayan de Oro route;

3. The Barangay Executives implemented said ordinance,

thereby giving all street fish vendors a period of three (3) months within
which to apply and be issued a stationary permit to use a unit in the
barangay market stalls, of which said respondent failed to act upon;

4. During said clearing operation conducted by my team on

April 8, 2019 and while engaged in the performance of official duties
under said ordinance to act upon the clearing of unregistered vendors,
and on the occasion of such performance, said respondent resisted to
be removed from his occasioned place of selling, and employ force by
blowing me with a 2 by 3 blunt plywood three (3) times in repetition and
thereby resulting in one (1) concussive blow in my forehead and (2)
contusions in my waist. A medical examination was conducted by Dr.
Jarlim L. Jarales, local chief doctor of the Municipal Clinic of Lugait,
wherein said injuries sustained were officially described and attached
to this complaint-affidavit as Annex “C”;

5. Later on the aforementioned date, I reported the incident

to the Lugait Police Station and was officially recorded by SPO3
Jennifer D. Loyola in its blotter book. The original copy of the excerpt
of the police blotter is hereunto attached and made an integral part of
this complaint-affidavit as Annex “D”;

6. I am therefore executing this complaint-affidavit freely and

voluntarily in support of my intent to file a case for DIRECT ASSAULT
and/or the appropriate criminal case against Jeff M. Meister who is 26
years of age and a resident of Purok 2, Barangay Biga, Lugait, Misamis
Oriental.
