ACKNOWLEDGEMENT

​ I, student of ​LLB,
2​nd year​, would like to pay my sincere gratitude towards
M.S. College of Law​, our respected ​Principal​, and our
beloved ​Professor Saleem Yusuf​, for arranging our visit to
Juvenile Court (Bhiwandi) for the purpose of
understanding the Children’s Home organization and there
functioning.
I am also thankful to ​the officials ​at the Juvenile
Court to allow us to visit the facility.

INTRODUCTION / PURPOSE OF VISIT

MS College of Law had arranged a visit to Juvenile Court


(Bhiwandi) for students of the LLB (2​nd​ year) and BLS (4​th
year).

The main purpose of this visit was to let the students


experience what they read in their books about Juvenile
Justice Board.

The visit targets at enabling the students to understand the


working and structure of Child care homes.

DETAILS OF THE VISIT

The visit to Juvenile Court – Bhiwandi was arranged by


Professor Saleem Yusuf on behalf of the College.

Students were split in two groups, the first group visited on


21​st​ February 2018 (Wednesday) and the second group
visited on 22​nd​ February, 2018 (Thursday). I was a part of
the first group.

We started the visit with a small introduction by Honorable


Judge, Mr. Savarkar, about the place and a brief on “Do's” and
Don’ts”, at the head office.

We were then accompanied by the teaching staff who guided


us through the different sections of the Juvenile Court. They
also gave us an overview of the layout of the Juvenile Court.

The first section where we got a chance to interact with the


children at the center was the section for children below the
age of 12. These children were happily engaged in different
Drawing and Crafts activities.

Children there were from various back ground, they were


brought to the Juvenile Court mainly through Central
Railways where they were either found begging or without
parents/guardians.

We then visited the kitchen where food was prepared for the
children at the unit. The kitchen was a very well maintained
and a tidy place.

From there, we moved to section where children above the


age of 12 were being taught. We were allowed to meet these
children and have a casual chat with them.
In this section, we came across a boy named Irfan, aged 12,
from Govandi. He was there on charges of breaking into a
house. However, he maintains he was tricked into this by his
friends.

We then visited the “Vocational Training Center”, here the


students were taught Plumbing and Wiring. This was the
newest addition to the Juvenile Court and a very valuable
one as well as it taught the children something with which
they could earn a living.

All of the above was at the Boy’s section; we then proceeded


towards the girl’s Section. There we met Mrs. Shailaja Chavre
who guided us around the different divisions of the girl’
section.

We concluded our visit by giving a bouquet of flowers to


Honorable Judge, Mr. Savarkar as a token of appreciation for
the hospitality we received from all the officials and staff
members at the Juvenile Court.

DETAILS OF SECTIONS AT JUVENILE COURT

1) HEAD OFFICE: It is the main administrative area of the


Juvenile Court.

2) ACCOUNTS DEPARTMENT: ​It is the place where major


accounting work of the Juvenile Court is conducted.

3) COMPUTER TRAINING CENTER: ​Here computer training


is provided to the children of Juvenile Court

4) ENTERTAINMENT AND EDUCATION CENTER: It is the


main area for providing education and entertainment
activities to the children.

5) MEDICAL ROOM:​ It is the room where medical assistance


is provided.

6) KITCHEN: It is the place where daily meals are prepared


and served.

7) DHAAMANKAR HALL: ​It is the Hall for different activities


at the Juvenile Court

8) JUSTICE ROOM: ​It is the place where Judge presides and
hearing is held.

9) GIRLS’ HOSTEL: ​It is the hostel for girls.

10) MEDICAL ROOM FOR GIRLS: ​It is medical room for


girls where medical assistance is provided.

11) HALL FOR GIRLS: ​A separate hall for Girls.

12) DORMITORY FOR GIRLS: ​It is a separate dormitory for


girls.

13) CLASS ROOM FOR GIRLS: ​There is a separate class


room for girls.

14) HALL FOR BOYS: ​There is a separate hall for boys.

15) DORMITORY FOR BOYS: ​There is a separate dormitory


for boys.

16) CLASS ROOM FOR BOYS: ​There is a separate class room


for boys.

17) LIBRARY: ​Library containing a variety of books.

18) LAUNDRY: ​There is a different room for laundry


machine.

19) GARDEN FOR GIRLS: ​There is a spacious well
maintained garden for Girls

20) GARDEN FOR BOYS: ​There is a spacious well


maintained garden for boys.

FUNCTIONS OF THE JUVENILE COURT

Two types of children are brought to this organization.


1) Children who are accused of committing certain crimes.
2) Children who are orphan or who are lost.

The organization has two wings


1) “BAAL NYAY MANDAL” i.e. “JUVENILE JUSTICE
BOARD”
2) “BAAL KALYAN SAMITI” i.e. “CHILD WELFARE
COMMITTEE”

JUVENILE JUSTICE BOARD:
Juvenile Justice Board is one of the most socially important
features of the modern judicial system. Children accused of
committing crimes are brought forward to this board. A
child should have completed 7 years or more and should not
be more than 18 years of age to be on this board.

There are certain rules to be followed by Police officers.


They have to submit various documents. Police officer has to
submit a copy of FIR. Police officer has to submit a copy of
“PANCHNAMA”. Police officer should submit a documentary
evidence of “INTIMATION GIVEN TO PARENTS”.
Police officer is required to file a declaration that the
accused child is brought before the Board within 24 hours
and the child was kept in a good environment.

The board enquires into the matter. It also determines and


fulfills developmental needs, safety needs etc. of the
children.

CHILD WELFARE COMMITTEE:
It is a socialist function carried out by the judicial system.
Those children who are orphan or who are lost are brought
to this Committee. Any children up to the age of 18 years can
be brought to this board.

The person bringing the child is known as “PRESENTER”.


The presenter has to follow rules and code of conduct.
The presenter is required to submit certain documents and
declaration.

The presenter has to give written statement declaring that


the child was not kept in Police custody or in a jail
The presenter has to give written statement that the child
was presented within 24 hours.

The presenter has to give a written statement that the child


was kept in a good environment.

The presenter should provide other relevant information.


The committee determines and fulfills developmental needs,
safety needs etc. of the children.

ORGANIZATIONAL HIERARCHY

The trustees ​are the apex group of the Juvenile Court. They
are the group who take important decisions and form plans,
rules and regulations (in line with the legal regulations) to
be followed by the Children, Staff and Officials of the Juvenile
Court.

CONCLUSION

Our visit to the Juvenile Court was a great learning and a


humbling experience.

One on hand, on our visit we learned about the actual


working of a Juvenile Court. This will help us connect dots
when we open our text books and it will also help us give
pictures from our memories of this visit to the Sections/Case
studies and answers that we read for our exams.

On the other hand, the visit also reminded all of us of the


perks that we enjoy being at our home, protected by our
parents and family members. The visit also reminds us that
Law has not forsaken children who are not as privileged or
children who easily fall prey to unlawful activities due to
their tender age.

The visit mainly highlights the fact that Law has made
provisions to look after such children and Law student like
us can make a meaningful difference to the society by using
our knowledge for the betterment of the people.
