Prosecution story in brief:

It has been alleged that prior to 8 days of the lodging of FIR the
complainant used to reside at, Coba chawl, Wadar Padar road no.
2, Hanuman Nagar, Kandivali, East, Mumbai. 400101. Along with
her Husband, Son and 2 daughters in a joint family. The husband
of the complainant is a tailor and through his earning the
maintenance of the family is been carried out. The elder son of the
complainant is a student of 12th class and the younger son is
studying in class 8th, whereas the victim, daughter has secured
admission in SNDT College, Malad but she preferred not to attend
the college hence she used to stay home.

It has been alleged that on 04/01/2017 the complainant had

lodged an FIR against Satish Sitaram Jadhav and his wife,
Sadhna Satish Jadhav for allegedly kidnapping the victim on the
pretext of taking her to Tirupati temple. On 10/01/2017 the
accused Satish and his wife, Sadhna were arrested by Satma
Nagar police station thereafter the investigation was being carried
out into the matter and accordingly, I and my friend Gita Dhotre
took my daughter/victim in confidence and accordingly the victim
had disclosed that the son of the accused, Satish i.e. Rohit had
carried out sexual harassment over her and therefore additional
statement was been recorded of the victim by the Samta Nagar
police station and thereafter the victim was protected in the
rescue home at, Dongri, Mumbai.

It has been alleged that on 17/01/2017 the victim was medically

examined at J. J. Hospital and it was revealed that the daughter
of the complainant was a victim of forcible sexual intercourse and
the alleged fact was been conveyed to the complainant by the
doctors at the J. J. Hospital . it has been further alleged that the
victim had informed the doctors that the present applicant had
carried out such indecent act with her.

It has been alleged on 24/01/2017 the complainant brought the

victim home from the rescue home at Dongri and tried to
investigate further in the matter but the victim used to remain
silent, but on 28/01/2017 the complainant took the victim into
confidence and further inquired about the alleged assault upon
her to which the victim had stated that in May, 2016 the
applicant on the pretext of having a love affair with the victim,
took the victim to his friend’s house in the vicinity and thereafter
carried out forcible sexual intercourse upon her over the period
between May 2016 - August 2016 for around 3-4 times and
therefore the victim started fearing the applicant/accused and
stopped meeting him since September 2016.
It has been alleged that the victim had informed the complainant
that initially the mezzanine floor of the house of Mrs. Asha
Kailash Temkar was used by the applicant/accused to carry out
the alleged offence. It has been further alleged that the victim had
state the aforesaid allegation against the applicant to the
complainant and accordingly the complainant went to Samta
Nagar Police station and lodged the present FIR.
